In redevelopment projects, the right to receive a newly built unit constitutes the most essential economic interest of landowners and other right holders. Article 76(1)6 of the Act on the Improvement of Urban Areas and Residential Environments (the "Urban Improvement Act") sets out the principle that one housing unit shall be supplied where one household or one person owns one or more houses or parcels of land, while Article 76(1)7(a) delegates the standards for housing supply with respect to jointly owned land to municipal and provincial ordinances. Pursuant to this delegation, Article 36 of the Seoul Metropolitan City Ordinance on the Improvement of Urban Areas and Residential Environments (the "Seoul Ordinance") prescribes the affirmative requirements for allotment recipients (Paragraph 1), the cases in which multiple owners are deemed a single allotment recipient (Paragraph 2), and the scope of land excluded from the calculation of previous land area and appraised right value (Paragraph 3).
These provisions are interconnected around the base date for right calculation as their pivotal reference point. In borderline cases where the timing, form, and area of acquisition are intertwined, gaps in interpretation arise, and such gaps have become a principal source of disputes over allotment eligibility.
Against this background, this study aims to systematically examine how defects in allotment eligibility, centering on the criteria for excluding allotment recipients under the Seoul Ordinance and the base date for right calculation, bear upon the validity of management and disposal plans.
The study first analyzes the structure of the standards for allotment recipients under the Urban Improvement Act and Article 36 of the Seoul Ordinance, building on the distinction among landowners, association members, and holders of allotment rights. It confirms that, because the current Article 36 coexists with Article 27 of the former Seoul Ordinance, the applicable ordinance and base date vary from one improvement zone to another, so that identifying the governing ordinance operates as a threshold question in eligibility disputes.
The study then conducts a typological analysis of lot splitting and the corresponding restrictions on allotment eligibility, confirming that interpretive gaps and borderline disputes arise in each type. In particular, with respect to co-owners of land under Article 36(2)3 of the Ordinance, the determination of the time of acquisition gives rise to a conflict between the general principle governing changes in real rights over immovables (registration) and the particularities of inheritance and partition by agreement among co-heirs. Through an analysis of case law, the study confirms that different doctrines on the timing of acquisition apply to acquisitions by juristic acts such as sale or gift, on the one hand, and acquisitions by inheritance, on the other. It further examines how questions to which the Ordinance provides no explicit answer—such as whether shared land areas may be aggregated, and whether successive transferees after the base date may succeed to the transferor's status—have become recurring sources of litigation.
The study further examines the effect of eligibility defects on the validity of management and disposal plans from three perspectives: the legal nature of the defect, the application of the severability doctrine, and the available remedies depending on the stage at which an ineligible recipient is discovered. Where an eligibility determination directly contradicts the text of the Ordinance, the plan risks being void for a grave and obvious legal defect; by contrast, where the statutory interpretation is genuinely contestable or factual assessments are involved, the defect is more likely to constitute merely a ground for revocation. The later the stage at which ineligibility is discovered, the more sharply the available legal remedies contract, and beyond a certain point relief through administrative litigation is, in principle, foreclosed.
Finally, the study identifies shortcomings of the current system—namely, the inadequate means of publicizing the base date for right calculation, the delegation of eligibility verification to redevelopment associations, and the limits of administrative review at the approval stage—and offers proposals for improvement: in the short term, introducing a procedure for prior confirmation of eligibility by the competent administrative agency before applications for allotment are filed; in the medium term, raising the ratio of reserved units; in the long term, strengthening the public notice effect of the base date by reflecting it in land use planning certificates; and, as a matter of legislative reform, clarifying the exception clauses of the Ordinance and codifying remedial procedures.
