This study focuses on changes in the automobile accident responsibility structure due to the development and commercialization of autonomous vehicle technology, and seeks directions to improve the self-driving vehicle accidents and automobile insurance legislation to respond to them. In particular, due to the introduction of autonomous vehicles, the existing responsibility system centered on ‘human drivers’ has faced limitations that do not fit the reality. By comparing and analyzing the responses of major countries accordingly, we intend to review the direction of the self-driving vehicle insurance legislation in Korea.
Self-driving cars have developed in stages from Level 0 to Level 5 in accordance with the standards of the International Association of Automotive Engineers (SAE). However, at Level 4 and above, the intervention of the ‘human driver’ is limited or excluded, resulting in a problem that the responsible subject becomes unclear in the event of an accident. This phenomenon leads to a situation in which it is impossible to maintain the traditional responsibility structure for automobile accidents that has been developed around “driver’s responsibility, etc.” Therefore, the legal system for responsibility allocation needs to be reorganized and the automobile insurance system needs to be reorganized accordingly.
In the case of Korea, despite the efforts of the authorities to commercialize autonomous vehicles, the response to the Automobile Damage Compensation Guarantee Act is insufficient. It is questionable whether the government believes that it will be able to respond to autonomous vehicle accidents while maintaining the traditional driver responsibility system. In fact, it is confirmed that the auto insurance terms and conditions cover limited risks of autonomous driving through some special agreements, which may be because autonomous driving technology is still developing, and the time has not come for members of our society to feel changes in the new risks of the risk structure at each stage of autonomous driving.
Meanwhile, major foreign countries are making preemptive efforts to respond to accidents of autonomous vehicles due to the development of autonomous driving technology. For example, Germany newly stipulated the concept of technology supervisor in legal terms and reorganized the legislation along with the responsibility of the holder, and in the case of an autonomous vehicle accident, the UK prioritized the insurer’s relief for victims. In Japan, special agreements exist for each stage of autonomous driving, and the duties of supervisors have been flexibly legislated. Each country is revising, establishing, and supplementing laws according to the development of autonomous driving technology according to the situation of the country. In these countries, it can be seen that in the era of autonomous vehicles, related liability laws and insurance systems perform the function of adjusting responsibility beyond simple risk coverage or risk distribution functions.
This study attempted to analyze the direction of national policy on accountability according to the improvement of the technology stage of autonomous vehicles. Specifically, the legislation examples of Germany, the UK, and Japan were confirmed. At the same time, it aims to clarify the limitations of Korea’s current legislation and automobile insurance system, and to find a direction on how the subject of responsibility should be reorganized according to the development of science and technology in automobile accidents, and how the insurance system changes in accordance with the change of the subject of responsibility, and to fulfill the original role of the insurance system of risk distribution.
This researcher has doubts about whether all foreign self-driving vehicle-related laws are superior to those of Korea. This is because Korea’s legal system has reflected our society’s unique transportation culture, geographic environment, and accident handling methods and systems so far. Therefore, it is important to analyze the strengths and weaknesses of foreign legislation and prepare an optimal legal system for our society through a legislative process to suit the domestic situation.
Self-driving cars are evaluated as a combination of important achievements of the 4th Industrial Revolution. Unlike conventional industrial revolutions, the 4th Industrial Revolution is rapidly progressing as various technologies interact in a hyperconnected state. With the development of science and technology, the operating behavior of vehicles such as automobiles, ships, and aircraft will change, as well as the transportation system, road conditions, and driving culture. In that sense, the discussion in this paper only reflects the current level of science, and this topic will inevitably spread to more diverse discussions in the future.
