Complex Regional Pain Syndrome (CRPS) is a chronic neuropathic pain disorder triggered by trauma or surgery, characterized by disproportionately severe pain, autonomic dysfunction, and motor disturbances. This study comparatively analyzes the legal evaluation of CRPS across four legal domains in Korea—tort damages litigation (including medical malpractice), industrial accident compensation, national merit (veterans’) compensation, and disability welfare law—and proposes practical improvement measures directly applicable to insurance and compensation practice. From the perspective of insurance law, the study ultimately seeks a reasonable balance between deterring moral hazard and protecting genuine CRPS victims.
The principal findings are as follows. First, the Budapest revised diagnostic criteria have been established as the de facto diagnostic standard across all four legal domains, yet disability assessment methodologies remain inconsistent from domain to domain.
Second, despite identical clinical conditions, the scope of compensation and disability rating vary substantially depending on the claim channel chosen, with the presence or absence of prior administrative expert review producing significant differences in evidentiary practice.
Third, following Supreme Court Decision 2009Da77198, no unified alternative standard has emerged to replace the McBride disability rating table, resulting in severe divergence in expert appraisals depending on the evaluation methodology applied. Fourth, the 2020 amended veterans’ disability rating standard contains structural flaws—including the chronicity paradox, whereby grades decline as objective signs subside with disease chronification—and inequities in the treatment-method scoring system.
Fifth, the Disability Welfare Act, by maintaining a categorical exclusion of pain-based disability, effectively leaves severe CRPS patients without accompanying motor dysfunction in a protection blind spot.
In response to these problems, this study proposes four reform measures.
First, institutionalization of CRPS-specific disability evaluation criteria focused on pain-induced functional impairment in medical appraisal practice.
Second, establishment of guidelines for liability-limitation ratios that discourage the double-deduction of causation and liability scope on grounds of disease rarity, replacing current practice with objective criteria based on the quality of medical evidence.
Third, harmonization of evaluation standards across legal domains, to be achieved through through revision of the veterans’ disability rating standard and introduction of a pain-induced functional disability category in the Disability Welfare Act.
Fourth, standardization of insurance claims procedures, encompassing Budapest-criteria-based diagnostic verification, pain-genuineness verification, mandatory disclosure of the appraiser’s evaluation methodology, and present-value calculation of spinal cord stimulator costs and long-term opioid prescriptions in future medical expense assessments.
This study aims to provide a rational foundation on which the legal evaluation of CRPS patients can secure normative legitimacy.
