Maintenance projects are large-scale initiatives aimed at restoring urban functions by improving or constructing aged and deteriorated buildings. Although the urban maintenance association—one of the main entities implementing these projects—is a public corporation holding the status of an administrative subject, various corrupt practices, such as collusion between association executives and construction companies, unfair increases in construction costs, and non-transparent fund execution, have consistently emerged as serious social issues. In response, Article 124 of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter referred to as the "Urban Maintenance Act") mandates the disclosure, inspection, and copying of documents and related materials concerning the implementation of maintenance projects. It also imposes criminal penalties on association executives who violate these obligations, thereby aiming to secure the transparency and public interest of maintenance projects and to guarantee the members' right to know.
This thesis aims to comprehensively review the significance and content of the information disclosure system under the Urban Maintenance Act, analyze the problems that have surfaced during its implementation process, and propose measures for improvement. To this end, this study first examines the significance and legislative purpose of the information disclosure system and traces its legislative history over the past 20 years since its enactment in 2002. Next, regarding the specific details of the current system, the thesis provides a detailed analysis of the distinction between mandatory disclosure obligations and inspection/copying obligations, the entities subject to disclosure obligations, the scope of data to be disclosed, the procedures and methods for disclosure, the restrictions on the system, and sanctions such as criminal penalties for violations, focusing on statutory provisions and relevant judicial precedents. Furthermore, it explores the relationship with related statutes, such as the Act on Special Cases Concerning Vacant Houses and Small-scale Housing Maintenance and the Official Information Disclosure Act.
Based on this review, this thesis identifies four major problems within the current system and proposes corresponding improvement plans:
First, a legislative improvement plan to address the omission in the regulations regarding eligible applicants for inspection and copying requests directed at the promotion committee for association establishment, which is formed prior to the designation and public notice of a maintenance area.
Second, an improvement plan addressing the controversy over whether "related materials" subject to disclosure violate the principle of clarity under the principle of legality (nulla poena sine lege).
Third, supplementary measures for procedural deficiencies regarding information disclosure, such as the commencement date for the inspection and copying deadline, regulations on the obligation to notify the list of items to be disclosed, and the method of stating the purpose of use.
Lastly, a legislative improvement plan to resolve the regulatory loophole in penalties that occurs when there is a defect in the authorization of the association's establishment.
By proposing solutions to these issues, this thesis aims to contribute to revitalizing the information disclosure system and enhancing its practical effectiveness.
