    This thesis explores how different capitalist systems shape national legal responses to cybercrime within digital platforms, applying the Varieties of Capitalism (VoC) framework to the United States, Japan, South Korea, and China. While digital platforms have become essential infrastructures of global coordination, their governance reflects divergent institutional logics. The study employs a qualitative comparative method to analyze legislation, enforcement mechanisms, and platform responsibilities across two key regulatory dimensions: content regulation and infrastructure security.
    Findings reveal that liberal-market economies such as the United States emphasize market autonomy and self-regulation, granting platforms broad immunity as private intermediaries. Coordinated-market economies like Japan adopt consensus-based co-regulation and administrative guidance, promoting shared responsibility between state and industry. South Korea represents a hybrid model where platforms act as quasi-public gatekeepers under strong state supervision, balancing innovation with moral and social order. In contrast, China’s state-capitalist model integrates platforms into national security and ideological governance, imposing mandatory censorship and data localization.
    The comparative analysis concludes that these variations derive from deeper ideological orientations toward cyberspace—whether it is regarded as a private market domain or a public sphere subject to state authority. Although the VoC framework remains effective in explaining domestic regulatory diversity, it falls short in accounting for transnational and hybrid governance emerging in the platform economy. The study calls for an expanded framework that incorporates digital sovereignty and international legal cooperation, particularly through mechanisms such as the Budapest Convention on Cybercrime, to foster a more coordinated global cyber order.

    이 논문은 자본주의의 다양한 체제가 디지털 플랫폼 내 사이버범죄에 대한 국가의 법적 대응을 어떻게 형성하는지를 탐구하며, 이를 위해 자본주의 다양성(Varieties of Capitalism, VoC) 이론을 미국, 일본, 한국, 중국에 적용한다. 디지털 플랫폼은 전 세계적 경제조정의 핵심 인프라로 자리잡았지만, 그 거버넌스 방식은 각국의 제도적 논리에 따라 상이하게 나타난다. 본 연구는 질적 비교 연구(qualitative comparative method) 를 통해 각국의 관련 입법, 집행 메커니즘, 그리고 플랫폼의 책임 체계를 콘텐츠 규제(content regulation) 와 인프라 보안(infrastructure security) 이라는 두 가지 주요 규제 차원에서 분석하였다.
    연구 결과, 미국과 같은 자유시장경제(Liberal Market Economy)는 시장 자율성과 자기규제를 중시하여 플랫폼을 사적 중개자(private intermediaries)로 보고 폭넓은 면책을 부여한다. 일본과 같은 조정시장경제(Coordinated Market Economy)는 합의 기반의 공동 규제(co-regulation)와 행정지도(administrative guidance)를 통해 국가와 산업 간의 공동 책임을 강조한다. 한국은 혁신과 사회·도덕적 질서의 균형을 추구하면서, 플랫폼을 강한 국가 감독 아래 준공공적 게이트키퍼(quasi-public gatekeepers)로 규정하는 혼합형(hybrid) 모델을 보인다. 반면 중국은 국가자본주의(state-capitalist) 모델로서 플랫폼을 국가 안보 및 이념 통제 체계에 통합하여, 검열과 데이터 현지화를 의무화한다.
