Fair Play Beyond the Field: Sports Sanctions as a Mechanism for Upholding Core Rules of International Law : Focusing on the 2022 Russian Invasion Case = 경기장을 넘어선 페어플레이 - 국제법 핵심 규칙 유지를 위한 매커니즘으로서의 스포츠의 제재: 2022년 침공 사례를 중심으로

국문 초록 (Abstract)

본 연구는 국제법적 관점에서 국제 체제 내 규범 행위자로서 스포츠의 역할이 어떻게 변화하고 있는지를 분석하고, 국제 규범 위반에 대한 대응 수단으로서 스포츠 제재의 기능과 정당성을 고찰한다. 전통적으로 스포츠는 정치적 중립 원칙에 따라 정치와 분리된 영역으로 인식되어 왔으나, 최근에는 글로벌 위기 상황에서 국제적 법적·윤리적 기준을 수호하는 잠재적 집행 주체로서 보다 적극적인 역할을 수행하고 있다. 이를 바탕으로 본 연구는 2022년 러시아의 우크라이나 침공을 주요 사례로 삼아, 국가의 침략 행위에 대응한 집단적 스포츠 제재가 국제 규범 집행의 정당한 수단이 될 수 있는지를 검토한다. 특히 제재의 정당성, 인권적 함의, 국제법 및 글로벌 스포츠 거버넌스 체계와의 정합성을 중심으로 종합적인 평가를 실시한다. 연구 방법으로는 올림픽 헌장, 유엔 결의안, 관련 법적 문서 등 1차 자료와 학술 문헌, 법률 해설, 언론 보도, 공식 성명 등 2차 자료를 활용한 질적 사례연구를 적용하였다. 본 연구는 러시아 사례가 향후 침략 전쟁과 같은 중대한 국제 규범 위반 상황에서 중요한 선례로 기능할 가능성을 제시하고, 스포츠의 자율성과 도덕적 국제 정의 사이의 균형을 유지하기 위한 거버넌스 개선 방향을 도출하고자 한다. 이를 통해 국제법과 스포츠가 교차하는 학술적 논의의 공백을 보완하고, 변화하는 국제 환경 속에서 스포츠 제재의 정당성을 둘러싼 복합적 쟁점에 대한 이해를 심화하는 데 기여하고자 한다.

This study examines the evolving role of sport as a normative actor in the international system through the lens of international law, analyzing sports sanctions as mechanisms for upholding international norms. Although sports have traditionally adhered to the principle of political neutrality, in which sports and politics remain separate, they are increasingly taking on a more active role as potential enforcers of maintaining international legal and ethical standards in global crises. With the 2022 Russian invasion of Ukraine as the primary focus, this paper examines whether the imposition of collective sports sanctions in response to state aggression is a justified means of norm enforcement, assessing their legitimacy, human rights implications, and consistency with international law and global sports governance. By adopting a qualitative case study design, this research draws on primary sources, including the Olympic Charter, United Nations resolutions, and other relevant legal instruments, as well as several secondary sources such as academic literature, legal commentaries, media reports, and public statements, to assess the justifiability of such sanctions. Through this approach, the findings of this study ultimately aim to shed light on how the Russian case can serve as a critical precedent for future cases involving international norm violations, particularly in regard to those related to war of aggression, and to offer recommendations for developing good governance procedures that keep the balance between the integrity of sport and moral international justice. By doing so, this study fills a gap in the discussion at the intersection of international law and sport, contributing to a deeper understanding of the complexities surrounding the legitimacy of sports sanctions within the current international landscape.
