제재처분은 행정의 실효성을 위하여 중요한 역할을 하면서도 제재처분 상대방에게 직접적으로 침익적인 효력을 미치는 행정행위이므로, 공익과 사익의 조화가 잘 정립되어야 한다. 적정한 제재처분을 부과하기 위해서는 어떠한 행위를 몇 개의 위반행위로 파악할지가 중요한 전제라고 할 것인데, 아직까지 행정법 학계에서 이에 대한 논의가 많지 않다. 이러한 문제의식 하에 본 논문은 위반행위의 수 판단 및 위반행위의 수에 따른 제재처분을 연구대상으로 한다.
‘법위반사실에 대한 응보적 벌’이라는 관점에서 제재처분은 형사처벌과 구조적으로 유사한 부분이 있다. 형사법은 범죄의 수를 판단하고 한 사람이 복수의 범죄를 저질렀을 때 형벌을 산정하는 기준에 대한 죄수론이 정립되어 있으므로, 위반행위의 수를 판단함에 죄수론을 참고할 수 있을 것이다. 그러나 행정법상 위반행위은 형사법상 죄와 본질적인 차이가 있으므로, 형사법의 죄수론을 참고하되 행정법상 독자적인 논의의 필요성이 있다고 할 것이다. 이에 본 논문은 행정법상 ‘위반행위수론’을 제언하고자 한다.
위반행위의 수를 어떻게 판단하는지에 따라서 법령의 개정이 있는 경우 어떤 법령을 적용하여야 하는지, 그 법령이 위반행위의 수에 따라 제재처분의 기준을 달리 규정하고 있는 경우 어떤 기준을 적용하여 제재처분을 어떻게 산정할 것인지, 위반행위 요건 성립의 판단 및 입증의 정도, 처분시효 도과 여부 등이 달라진다. 또한 위반행위 수를 평가함으로써 국민이 중첩적인 제재처분을 부과받았는지 여부를 판단하고 과도한 제재처분을 방지할 수 있다. 위반행위 수에 대한 판단은 행정실체법뿐만 아니라 행정소송절차에도 광범위하게 영향을 미치는 상당히 중요한 쟁점이다.
형사법의 죄수론이 일죄와 수죄로 나누고, 일죄는 단순일죄와 포괄일죄, 수죄는 상상적 경합과 실체적 경합으로 나누는 것을 참고하여, 본 논문은 ‘하나의 위반행위’와 ‘복수의 위반행위’를 나누어 논의한다.
‘하나의 위반행위’는 하나의 행위가 하나의 위반행위에 해당하는 ‘협의의 하나의 위반행위’와 복수의 행위가 하나의 위반행위로 평가되는 ‘포괄적 하나의 위반행위’로 나눌 수 있다. 외관상으로 복수의 위반행위가 경합하지만 위반사유 상호간의 논리적 관계 때문에 하나의 위반행위가 인정되는 ‘위반행위의 법조경합’도 하나의 위반행위에 포함해서 논한다.
‘복수의 위반행위’는 하나의 행위가 복수의 위반행위에 해당하는 ‘위반행위의 상상적 경합’과 복수의 행위가 복수의 위반행위에 해당하는 ‘위반행위의 실체적 경합’으로 나눌 수 있다.
위반행위수론은 제재처분의 특성을 고려하여 각 위반행위의 수별로 판단기준을 정립하고, 제재처분을 부과하면서 발생할 수 있는 쟁점을 검토한다. 또 위반행위의 실체적 경합 처리와 관련하여 개별 법령에 규정하고 있는 현행법의 내용을 분석한다.
마지막으로 형사법의 죄수론은 형법에 경합범 처리에 관한 일반법 규정을 두고 있지만, 행정법에서는 위반행위의 수에 따른 제재처분에 관하여 일반법 규정이 없으므로, 본 논문은 제재처분의 특성을 고려한 입법론을 제언한다.

Administrative sanctions play an important role in ensuring administrative effectiveness, yet they directly impose disadvantageous effects on the subjects of disposition, making the harmony between the public interest and private interests essential. For imposing suitable sanctions, it is crucial to determine how many violations particular acts comprise; however, this topic has not yet been thoroughly discussed in the field of administrative law. This thesis explores the criteria for counting violations and the handling of administrative sanctions accordingly.
From the perspective of ‘retaliatory punishment for facts in violation of law’, administrative sanctions share structural similarities with criminal punishment. As criminal law has developed theories for determining the number of crimes and the basis for sentencing when a person commits multiple offenses, such theories may provide useful reference points for counting violations in administrative law. Nevertheless, since violations in administrative law differ fundamentally from crimes in criminal law, it is important to develop an independent discussion for administrative violations even as criminal law theories are referenced. This thesis therefore proposes a framework for counting violations specific to administrative law.
Depending on how the number of violations is assessed, various issues arise: which law should be applied in the event of legislation changes; what standard should be used when administrative law provides different criteria for the number of violations; how to determine and prove the requirements for violations; and whether the expiration period for administrative disposition has lapsed. Consequently, the determination of the number of violations is a significant issue, impacting not only substantive administrative law but also administrative litigation procedures.
By referring to criminal law’s theory, which divides offenses into single and multiple crimes; with single crimes further classified into simple and comprehensive forms, and multiple crimes into conceptual and substantial concurrence; this thesis discusses ‘single violations’ and ‘multiple violations’. ‘Single violations’ are categorized into ‘simple single violations’, where one act counts as a single violation, and ‘composite single violations’, where several acts count as one violation. Instances of ‘legal concurrence of violations’, where multiple apparent violations are recognized as a single violation due to logical connections among the causes, are included in the discussion of single violations.
‘Multiple violations’ are divided into ‘ideal concurrence of violations’, where one act constitutes multiple violations, and ‘real concurrence of violations’, where multiple acts constitute multiple violations.
The thesis develops criteria for judgment tailored to each category of violations and reviews possible issues arising in the imposition of sanctions, including analysis of current law provisions regarding substantial concurrence of violations. Finally, unlike criminal law, which has general provisions for handling concurrent crimes, administrative law lacks such general provisions for sanctions according to the number of violations. This thesis therefore suggests legislative reform considering the nature of administrative sanctions.
