Marriage is a contract between two parties. Article 36(1) of the Constitution also advocates a contractual view of marriage based on the free will of two autonomous adults. However, when addressing issues within marriages, courts and the Constitutional Court have shown a pronounced tendency to interpret this constitutional provision from the perspective of institutional safeguards. This tendency has had the effect of transforming issues of conflict between spouses, such as infidelity, divorce, and domestic violence, into a state versus private individual dichotomy. Consequently, the issue of how a spouse's ‘self-determination’ affects the other spouse has been marginalized. Shifting away from viewing marriage as an institution forming the foundation of social order and reinterpreting it as an autonomous contractual relationship between individuals allows marriage law to be restructured with a focus on safeguarding individual rights, equality, and mutual consent. This could also provide a theoretical foundation for more inclusive regulation of intimate relationships encompassing all minorities currently excluded from the scope of existing law.
As the patriarchal extended family and gender inequality provisions of the original Civil Code gradually conflicted with the constitutional principle of gender equality and were amended, marriage law became hollowed out, delegating its substantive content to spousal agreement. Meanwhile, we have arrived at a post-industrial society where the male breadwinner model has transformed into and persists as work-oriented conservatism, and individualization proceeds without individualism. These social changes brought a sharp decline in marriage and birth rates, yet paradoxically prepared fertile ground for a lighter form of marriage and a contractual view of marriage to take root in Korean society—one that alleviates the burdens of gendered division of labor stereotypes, reproduction, and kinship obligations. The theory of marriage contracts provides a foundation for creating personalized rules and agreements through mutual negotiation between parties, and possesses the potential to evolve to encompass new types of intimate relationships that perform functions similar to marriage. Conversely, criticism exists that marriage contracts conceal inequality between parties, create submissive relationships, and are an institution favoring the privileged. Concerns have also been raised that introducing a contractual perspective may threaten the interests of third parties and weaken fundamental bonds between people.
However, compared to traditional marriage views that have enforced rigid gender roles and systematically restricted women's choices, the theory of marriage contracts—which supports individual autonomy and embraces diverse family forms—has distinct advantages. While recognizing the shortcomings of the marriage contract theory, we should pursue gradual improvements: supporting contractual arrangements that empower the socially and economically disadvantaged, while regulating those that do not. In domains like marriage where intimacy and contract overlap, actors build relationships not only through affection but also through contributions to shared material well-being. Within this dynamic, intimacy and contract are not mutually exclusive; rather, they mutually reinforce each other. This suggests that within the marriage contract, there exists a considerably broad scope for aspects amenable to a certain degree of rational measurement and evaluation. Therefore, at the very least, in areas where rational management is feasible, marriage partners should be guaranteed the right to access legal dispute resolution procedures. The validity of contracts between spouses depends on the given context and the dynamics triggered by both parties. Therefore, consent to actions posing a significant threat to autonomy should require a high duty of good faith from the other party. If regret arises from the marriage contract's outcome limiting one party's future autonomy, the contract should be amendable even retrospectively.
While marriage and family are functionally closely related, marriage is not a pre-established or instrumental concept for forming a family; it is a separate community unit independent of the constitutional family. The Civil Code's classification, which treats marriage as a subset of family and kinship, needs reconsideration. Case law relativizes the various marital obligations by recognizing that marriages exempting certain obligations under the Civil Code can still be valid. Consequently, it remains ambiguous what elements must be present for a union to be called a marriage. While a socially accepted, formalized marriage contract exists, this represents only the basic rules provided by law; it does not preclude the possibility of parties circumventing its application through individual agreements. Viewing the marriage contract as a combination of various elements—separate yet interrelated, detachable and reattachable—according to the bundle theory is a more appropriate method for explaining the diverse marriage contracts that exist in reality. Legislation is needed that distinguishes between avoidable default rules and non-avoidable mandatory provisions, and categorizes them as ‘strong’ default rules requiring strict circumvention procedures and ‘weak’ default rules requiring loose circumvention procedures, based on an assessment of their impact on the autonomy and freedom of the parties.
A marriage contract based on individual dignity and gender equality is a one-to-one contract. However, there is no inherent necessity for it to be a union between opposite sexes. Modern marriage contracts, detached from reproductive functions, are relational contracts oriented toward a companionate relationship. The contracting parties aim for the establishment of the relationship itself—one that is holistic, comprehensive, and exclusive—rather than the various legal effects accompanying the marital relationship. Marriage partners may demand each other's participation in ‘relationship work,’ which constitutes marital obligations. The original meaning of spousal support is difficult to adjudicate and enforce, though claims for alimony are possible. The obligation of economic support transforms into a measurable ‘status-based property right.’ This should be recognized regardless of whether the couple is separated. The relational contractual nature extends to the formation of kinship ties. In Korean marriage, where complete differentiation from paternal kin has failed and economic and emotional dependence on parents persists, this ancillary effect has become one cause of marriage avoidance. When assigning tasks that impose significant burdens on the parties, such as caring for in-laws, agreements on compensation should also be possible.
The marital contract is generally a sexual contract, passively encompassing the duty of sexual fidelity and actively encompassing the possibility of sexual contact. Given the nature of the sexual contract, infidelity should be viewed as a breach of contract causing unique harm to the other party. Furthermore, marriage is a continuing contract; its effect persists unless one party takes active steps to terminate it. The indefinite nature of the marital contract serves as a mechanism to encourage long-term investment by the parties, but conversely, it can also motivate strategic termination. Given the nature of continuing contracts where personal mutual trust is crucial, termination due to changed circumstances is broadly recognized. Therefore, protective legislation is necessary to safeguard the rights of the socially and economically vulnerable spouse and children upon termination.
Marriage is typically an economic community contract, meaning each party has a share in the formation of joint property. For the separate property system to be rational, women must be guaranteed equal income and property acquisition opportunities with men, and care work must be fairly distributed. However, for Korean women, marriage and children actually act as factors that deepen the gender wage gap. Considering that decision-making power tends to be concentrated with the spouse who stands to lose less upon dissolution of the marriage contract, we support a revised approach to liquidate joint property upon marriage termination based on the principle of shared benefits. In inheritance matters, the surviving spouse's contribution—including physical, emotional, and time-based care provided to the deceased spouse—and special benefits should be more actively recognized.
When a spouse breaches the marriage contract, the legal remedies available to the other spouse seeking to maintain the marriage are limited. Marital property agreements, though currently used extremely rarely, could serve as a means to circumvent the limitations of the separate property system. Property division upon divorce should also be determinable by marital property agreement. The court will decide its validity based on the timing and quality of the decision-making process. It should be possible to enter into a marital property agreement under court supervision even after marriage. Next, regarding claims for compensation for wrongful acts, the adulterous spouse bears liability for breach of the sexual contract. However, cases where compensation is claimed against the adulterous spouse without a divorce petition are rare. Conversely, claims for damages against third parties complicit in the adultery have surged since the abolition of the adultery crime. If divorce occurs, compensation for the wrongful act should be determined considering the sexual contract. Since divorce compensation is based on liability for breach of contract, it is reasonable that the recognized amount varies according to individual contracts. Case law recognizing the statute of limitations for the liability of participants when the adultery causing marital breakdown persisted for a long period, and case law stating that the participant's tort liability does not arise if both parties' divorce compensation claims are dismissed, require reconsideration. Finally, considering the relational contractual nature, I support applying the special criminal procedure of family protection proceedings to domestic violence, which constitutes a breach of the marital contract. However, the provisions regarding the purpose of ‘restoring peace and stability in the family’ and the obligation to respect the victim's wishes should be removed. Instead, temporary measures and protective dispositions should be utilized as the exercise of the victimized spouse's right to request temporary separation.
