헌법 제54조는 정부의 예산편성권과 국회의 심의·의결권을 규정하여 행정부와 입법부 간의 재정권한분장을 실현하고 있다. 의회와 행정부의 합의를 통해 결정된 그해의 예산에 합치하도록 국가를 운영하는 것은 국가의 안정적 발전을 위한 중요한 과제다. 하지만 예상하지 못한 지출상황은 변동하는 사회현상에 의해 필연적으로 발생한다. 이에 대응하기 위하여 1년예산주의의 예외인 예비비와 예산의 전용, 추가경정예산 등의 제도가 활용된다.
하지만 기존 예산의 범위에서 그 활용을 조정하는 다른 제도들과 달리, 추가경정예산 제도에 근거한 예산편성의 경우, 그 결과로 새로 편성된 예산과 관련한 헌법상 권한 검토가 필요한 경우가 발생한다. 헌법 제57조는 행정부의 동의 없는 국회의 예산 각항의 증액 및 새 비목 설치를 금하고 있기 때문이다. 이는 행정부의 예산편성권과 국회의 심의·의결권뿐 아니라 입법권의 영역까지 논의될 수 있는 쟁점이다. 국가재정법 제89조의 추가경정예산 편성요건에는 ‘법령에 따라 국가가 지급하여야 하는 지출이 발생하거나 증가하는 경우’가 포함되기 때문이다. 그중에서도 본예산 성립 후 입법된 재정수반법령의 지출이 추가경정예산 편성을 요구하는 규모인 경우, 그러한 경정을 통한 예산의 증액 및 그 집행 과정에서 형성되는 행정부와 입법부 간의 관계는 아직까지 본격적으로 논의된 적이 없다. 이는 대한민국 예산의 성격과 국가재정법상의 명문 규정뿐만 아니라 재정수반법률의 성격, 거슬러 올라가 행정부의 예산편성 및 국회의 심의·의결권을 규정한 헌법 조항에 대한 해석을 통해 판단되어야 하는 영역이다.
이 글은 추가경정예산의 편성을 요하는 규모의 예산이 수반되는 입법의 헌법적 정당성을 검토하는 것을 그 목적으로 한다. 그를 위해 헌법상 국회와 행정부의 재정권한분장 내용을 이해하는 과정에서 헌법 제54조, 제57조를 중심으로 그 내용을 살핀 후, 헌법 제56조에 규정된 추가경정예산 조항과 국가재정법의 예산 및 추가경정예산 편성에 관한 규정의 연혁, 제·개정 과정에서 이루어진 논의, 해외 법제상 예산규정 및 재정수반법률의 입법 요건을 검토한다. 나아가 추가경정예산이 헌법 제57조의 적용을 받는 ‘예산’에 해당하는지 여부, 예산 확정 후 새롭게 추가적 재정지출의 내용을 포함하는 입법에 대한 정부의 집행 의무 등의 검토를 통해 입법을 통한 의무지출의 발생이 유형에 따라 정부의 동의를 요하는 새로운 ‘예산의 편성’으로 판단될 수 있는지에 대한 기준을 모색해보고자 하였다.
이후 국가의 예산편성 의무를 규정한 여러 종류의 법안을 구체적으로 분석하여, 위 장에서 정립한 기준이 실제 입법 사례들에서 적용되었을 때의 결과를 분석하고, 마지막으로 적용 사례에서 드러난 현행 제도의 특성과 한계를 고려하여 추가경정예산 편성을 요하는 재정수반법률 입법의 개선을 위해 취할 수 있는 방안의 제언을 시도한 후, 전체 내용을 요약하며 글을 마무리한다.

Abstract
Article 54 of the Constitution of the Republic of Korea allocates national budgetary authority by stipulating the government’s power to formulate the budget and the National Assembly’s power to examine and approve the budget bill. Governing the state in conformity with the annual budget determined through agreement between the legislative and executive branches is a crucial issue for the stable development of the state. However, unforeseen expenditure needs inevitably arise as a result of changing social conditions. To address such circumstances, institutional mechanisms such as contingency funds, budget transfers, and the formulation of supplementary budgets—exceptions to the principle of annual budgeting—are utilized.
Unlike other mechanisms that merely adjust the use of funds within the scope of an existing budget, the formulation of a supplementary budget may require constitutional review regarding the expansion of the annual budget resulting therefrom. This is because Article 57 of the Constitution prohibits the National Assembly from increasing budgetary expenditures or creating new budget items without the consent of the executive branch. This issue implicates not only the government’s power to formulate the budget and the National Assembly’s power of deliberation and resolution, but also the scope of legislative power itself. Article 89 of the National Finance Act includes “cases where expenditures are required by statute” among the requirements for the formulation of a supplementary budget. In particular, where statutes enacted after the establishment of the original budget impose expenditures of a scale that necessitates a supplementary budget within the same fiscal year, the relationship between the executive and legislative branches with respect to budget increases and execution through such adjustments has not yet been fully examined.
Accordingly, this issue must be assessed through an interpretation not only of the nature of the national budget and the explicit provisions of the National Finance Act, but also of the nature of statutes accompanied by fiscal expenditures, and ultimately of the constitutional provisions governing the executive’s power to formulate the budget and the National Assembly’s power to deliberate and approve it. The purpose of this study is to examine the constitutional legitimacy of legislation accompanied by expenditures of a scale that requires the formulation of a supplementary budget.
To this end, the study first reviews Articles 54 and 57 of the Constitution to understand the constitutional allocation of budgetary authority between the National Assembly and the executive, and then examines Article 56 concerning supplementary budgets, along with the legislative history and deliberations surrounding the enactment and amendment of the National Finance Act’s provisions on budgeting and supplementary budgets. In addition, it analyzes budgetary provisions and legislative requirements for statutes accompanied by fiscal expenditures in foreign legal systems. Through this analysis, the study seeks to determine whether a supplementary budget constitutes a “budget” subject to Article 57 of the Constitution, whether the government bears an obligation to execute, within the same fiscal year, newly imposed fiscal expenditures arising from legislation enacted after budget approval, and under what circumstances such mandatory expenditures may be regarded as a new “formulation of a budget” requiring the consent of the executive.
Finally, the study conducts a concrete analysis of various types of bills that impose obligations on the state to formulate budgets, examines the outcomes of applying the criteria established in the preceding chapters to actual legislative cases, and, taking into account the characteristics and limitations of the current system revealed through these cases, proposes measures to improve the legislative framework governing statutes accompanied by fiscal expenditures that require the formulation of supplementary budgets. The paper concludes with a summary of its findings.
