This paper seeks to answer the fundamental questions: “What is discrimination, and how should the law judge it?” To address these questions, one must first recognize that not all cases of discrimination are equally wrongful; rather, each case carries its own distinct "weight" of wrongfulness. Accordingly, an accurate legal standard for discrimination must serve a dual purpose: it must act as a binary tool to distinguish discrimination from non-discrimination, while simultaneously functioning as a spectrum to identify which acts are “more” wrongful. Based on this premise, this study establishes a theoretical foundation for the essence of discrimination and proposes a practical "Discrimination Judgment Model" for systematic and consistent evaluation of individual cases.
The development of this standard begins with an analysis of the concept of discrimination. As suggested by the title, the definition of discrimination and its legal judgment are inextricably linked. In various legal systems, the concept of discrimination typically follows a dual structure consisting of: 1) unfavorable treatment based on a prohibited ground or a specific trait (formal requirement), and 2) the wrongfulness of such treatment (substantive requirement). The first element, "unfavorable treatment based on a specific trait," functions as a formal requirement for inclusion as a discrimination case. Crucially, the "trait" here does not encompass every possible human characteristic, but specifically those related to structures of inequality. This normative nature of the formal requirement reflects the goal of anti-discrimination law to combat "status inequality." Therefore, the core of the first element is "status," which mediates between the individual and the unequal structure. Consequently, the formal requirement should be understood as "unfavorable treatment of a status group(disadvantageous group)."
The judgment of discrimination consists of a formal assessment to identify "unfavorable treatment of a status group" and a substantive assessment to evaluate whether the resulting wrongfulness can be justified. Given the central role of "status" and the purpose of anti-discrimination norms, "status harm" emerges as the pivotal criterion for judgment. Status harm is defined as "rendering an individual in an unequal structure even more unequal," manifesting as subordination, infringement on deliberative freedom, or restricted access to basic goods. Severe status harm treats individuals as "second-class" threatening the moral equality of human status presumed by law. Thus, the most wrongful domain of discrimination is that which poses a risk of infringing upon these fundamental moral rights.

The values for each element are determined by answering specific investigative questions proposed in this study. The "Status-Harm Discrimination Judgment Model" possesses practical legitimacy by applying a consistent standard to handle the issue inclusion, determination, and degree of discrimination. Furthermore, it is normatively and theoretically justified as it aligns with the purpose of anti-discrimination norms and bridges the two components of the discrimination concept through the axis of status harm. By moving beyond the binary approaches of existing literature and treating discrimination as a "matter of degree," this model offers significant academic value in its ability to encompass the scope, existence, and severity of discrimination within a single, unified framework.
