    China’s response to minor offenses is structured through a dual-track punitive system grounded in criminal law and administrative law. Conduct that exceeds a certain threshold of social harmfulness is punished as a crime under the Criminal Law, whereas conduct deemed insufficiently harmful to constitute a crime is diverted to the realm of administrative sanctions under the Public Security Administration Punishments Law. While this system serves the function of enhancing administrative efficiency by enabling the swift and simplified handling of a large volume of minor cases, it simultaneously entails a structural tension insofar as sanctions involving deprivation of liberty may be imposed and enforced by administrative authorities outside the sphere of judicial control. In particular, administrative detention constitutes a sanction that directly deprives individuals of personal liberty even for a short duration, and despite its formal classification as an administrative punishment, it produces effects substantively comparable to criminal penalties, thereby raising acute concerns regarding its justification and control.
    This dual-track punitive system became historically entrenched through the legislative development of modern China. The legislative trajectory from the Regulations on Petty Offenses and the Great Qing Code on Petty Offenses in the late Qing period to the Petty Offenses Punishment Act during the Republican era illustrates the process by which punitive authority over minor order violations was institutionalized around police power rather than judicial authority. This structure was subsequently inherited after the founding of the People’s Republic of China through the Public Security Administration Punishments Regulations and the current Public Security Administration Punishments Law, providing an institutional foundation for the continued existence of administrative detention as a functional substitute for criminal punishment across the periods before and after the enactment of the Criminal Code.
    Within the current legal framework, Article 13 of the Criminal Law of China defines criminal liability based on the degree of social harmfulness and excludes from criminal punishment acts that are “manifestly minor in circumstances and not seriously harmful,” thereby institutionalizing the principles of subsidiarity and ultima ratio in criminal law.     Administrative detention under the Public Security Administration Punishments Law constitutes a short-term liberty-depriving administrative sanction imposed by public security organs, with investigation, decision-making, and enforcement all conducted internally within those organs. In order to reassess this structure within the broader discourse on the justification of criminal justice, this study undertakes a comparative analysis drawing on the theoretical frameworks of the crime control model and the due process model, the historical development of the due process principle, and the institutional experiences of South Korea. In particular, the historical trajectory from colonial-era police justice in Korea to the post-liberation introduction of summary trial procedures, as well as the gradual expansion of independent review and procedural control in administrative detention contexts such as infectious disease quarantine, involuntary hospitalization, and immigration detention, demonstrates that deprivation of liberty cannot be justified solely by reference to the public interest of administrative objectives and that the effectiveness of control mechanisms constitutes a core element of justification.
    China’s administrative detention system derives formal legitimacy from multiple layers of legal authority, including the Constitution, the Legislation Law, the Administrative Penalty Law, and the Public Security Administration Punishments Law. However, this form of justification exhibits structural limitations in that it fails to concretely design an allocation of powers, procedural safeguards, and independent external review commensurate with the severity of liberty deprivation. In particular, unlike criminal detention, which requires a court decision or prosecutorial approval, administrative detention lacks a clearly regulated independent external review mechanism, thereby creating the risk that the principle of legality may fail to function as a substantive norm of control. As a consequence, legality may be reduced to a formal justification that rationalizes restrictions on liberty rather than serving as a genuine safeguard.
    On the basis of this analysis, the improvement of China’s administrative detention system should not be pursued through comprehensive criminalization, but rather through the preservation of the dual-track punitive structure while progressively integrating control mechanisms proportionate to the deprivation of liberty involved. In the short term, quasi-judicial external review mechanisms should be introduced to buffer the concentration of authority within public security organs, while in the long term, pre- and post-deprivation review centered on the judiciary should be established so as to vest final control over liberty-depriving decisions in a more independent adjudicator.
