이 연구는 소규모 대중음악 공연장인 라이브클럽이 법적으로는 음식점 형식으로 등록·운영되는 괴리 현상에 주목하여, 해당 현상을 사회학적 제도주의와 규제정책의 관점에서 분석하였다. 이를 위해 질적 사례연구 설계를 바탕으로 문헌 자료와 관련 행위자들을 대상으로 한 인터뷰 자료를 수집·분석하였으며, 인터뷰의 경우 근거이론에 따른 방법을 활용하였다. 연구 결과 공연법과 식품위생법 간의 상위 규범 불일치가 라이브클럽에 이중적 압력을 부여하고 있다는 점, 지방정부와 라이브클럽 관련 행위자들의 대응이 제도적 괴리를 구조화하는 요인으로 작동한다는 점이 확인되었다. 이러한 규범 불일치와 괴리 지속 현상은 디커플링이 개별 사업장의 영업 전략을 넘어 구조적 현실로 작동하고 있음을 보여준다.
이 연구는 한국 라이브클럽의 제도적 지위, 규제정책의 작동 방식, 제도와 현실 간의 괴리를 확인한 초기 연구로서 두 가지 측면에서 의의가 있다. 첫째, 이 연구는 사회학적 제도주의 분석 틀을 적용하여 라이브클럽 관련 디커플링이 왜 발생하는지에 대해 실증적 정보를 제시한 첫 번째 연구라는 측면이다. 둘째, 이 연구는 규제정책의 관점에서 상위 법령의 구조적 모순, 지방정부의 버퍼링 전략, 현장 행위자의 전략적 적응이 상호작용하여 디커플링을 고착화하는 과정을 체계적으로 분석하였다는 측면이다. 나아가 이 연구는 비공식적 관행에 의존하는 현재의 디커플링 구조가 위기 시 현장의 불안정성을 야기할 수 있음을 지적하며, 이를 해소하기 위해서는 디커플링을 해소할 수 있는 라이브클럽의 제도적 지위 재설계 방안 등을 탐구할 필요가 있음을 제안한다.

This study analyzes the gap in which liveclubs―small-sacle popular music venues―are legally registered and operated as restaurants, despite their primary function as performance venues. Drawing on perspectives from sociological institutionalism and regulatory policy, this research examines the nature and causes of this phenomenon. To this end, a qualitative case study design was employed, utilizing literature review and in-depth interviews with relevant stakeholders. The interview data were specifically analyzed using grounded theory methodology.
The findings reveal that the normative inconsistency between the Public Performance Act and the Food Sanitation Act imposes dual pressures on liveclubs. Furthermore, the responses of local governments and liveclub stakeholders act as factors that structurally solidify this institutional gap. This persistence of normative inconsistency and the gap demonstrates that decoupling operates not merely as a business strategy for individual venues, but as a structural reality.
This research is one of the first studies to identify the institutional status of Korean liveclubs, the mechanics of regulatory policy, and the gap between institutions and reality, and thus holds significance in two primary aspects. First, it is the first study to provide empirical information on why decoupling occurs in the context of liveclubs by applying the analytical framework of sociological institutionalism. Second, from a regulatory policy perspective, it analyzes the process by which the structural contradictions of higher-level statutes, the buffering strategies of local governments, and the strategic adaptations of field actors interact to entrench decoupling.
Furthermore, this study points out that the current decoupling structure, which relies on informal practices, can lead to instability in the field during times of crisis. Consequently, it suggests the need to explore measures to redesign the institutional status of liveclubs to resolve this decoupling.
