디지털 기술의 발전과 함께 스마트폰과 클라우드 서비스는 개인의 일상과 사회 전반에 깊숙이 자리 잡았으며, 그 결과 디지털 증거는 범죄 수사에서 핵심 증거로 기능하게 되었다. 그러나 개인정보보호를 핵심 가치로 내세운 글로벌 IT 기업들의 정책 강화는 적법한 절차에 따른 수사에서 디지털 증거에 대한 실질적 접근을 어렵게 만드는 새로운 문제를 야기하고 있다. 특히 애플(Apple)의 강력한 암호화 구조와 개인정보보호 정책은 기존의 압수·수색 및 디지털포렌식 기법이 전제해 온 증거 확보 방식에 근본적인 재검토를 요구한다.
이러한 문제의식에 기초하여, 본 논문은 애플의 개인정보보호 정책과 암호화 및 보안 구조가 디지털 증거 수집 과정에 어떠한 제약을 형성하는지를 기술적·법적 관점에서 분석하였다. 기기 내 암호화와 클라우드 기반 보호 체계가 수사 현장에서 디지털 증거 접근을 제한하는 구조적 요인을 검토하고, 이를 국내 형사 절차와 개인정보보호 법제, 헌법적 원칙과의 관계 속에서 고찰하였다. 아울러 해외 주요 규범과의 비교를 통해 애플 정책의 특성과 그로 인한 법적 긴장을 구체화하였다.
분석결과, 본 논문은 데이터 접근의 한계를 전제로 한 메타데이터 중심의 증거 수집 경로, 수사과정에서의 사용자 참여와 투명성 확보, 그리고 기업 협조에 대한 사후적 통제 장치의 필요성을 도출하였다. 이를 바탕으로 애플의 개인정보보호 정책과 암호화 구조를 분석한 결과에 기초하여, 최소한의 정보 접근 원칙 하에서 프라이버시 보호와 공공의 이익을 조화시키는 디지털 증거 수집의 균형 모델을 제시하였다. 이러한 논의는 헌법상 영장주의와 비례원칙을 존중하면서도 디지털 환경 변화에 부합하는 수사절차의 방향을 제시한다는 점에서 의의를 지닌다.

With the advancement of digital technologies, smartphones and cloud services have become deeply embedded in everyday life and across society, resulting in digital evidence playing a central role in criminal investigations. However, the strengthening of privacy protection policies by global IT companies has created new challenges for law enforcement by limiting practical access to digital evidence, even when investigations are conducted in accordance with lawful procedures. In particular, Apple’s robust encryption architecture and privacy protection policies call for a fundamental reassessment of conventional digital forensic methods that presuppose technical accessibility to data through search and seizure.
Based on this problem awareness, this study analyzes how Apple’s privacy protection policies and encryption-based security structures impose constraints on the collection of digital evidence from both technical and legal perspectives. It examines the structural factors through which device-level encryption and cloud-based protection mechanisms restrict access to digital evidence in investigative practice, and evaluates these factors in relation to domestic criminal procedure, personal data protection legislation, and constitutional principles. In addition, the study clarifies the distinctive characteristics of Apple’s policies and the legal tensions they generate through comparative analysis of major foreign regulatory frameworks.
The analysis identifies the necessity of metadata-oriented evidence collection pathways under conditions where direct access to data is limited, as well as the importance of user participation, procedural transparency, and ex post oversight of corporate cooperation. Building on these findings, the study proposes a balanced model for digital evidence collection that reconciles privacy protection with the public interest under the principle of minimal information access. This model presents a direction for investigative procedures that is consistent with evolving digital environments while respecting constitutional safeguards such as the warrant requirement and the principle of proportionality.
