    The question of whether the International Criminal Court (ICC) can recognize a politically contested entity as a “State” extends beyond a factual inquiry to encompass issues of jurisdiction, international politics, and judicial legitimacy. Focusing on the ICC Pre-Trial Chamber I’s 2021 decision on the territorial jurisdiction over Palestine, this study empirically analyzes 16 amicus curiae briefs submitted by 29 NGOs out of 43 total submissions. The analysis traces how NGO arguments were adopted, excluded, or transformed in the Chamber’s reasoning. While the Chamber avoided explicitly citing NGOs for reasons of neutrality and judicial economy, it converged with pro-jurisdiction NGOs’ functional and teleological interpretation based on the Rome Statute’s accession procedure and the principle of effectiveness, while rejecting the textual approach grounded in the Montevideo criteria. These findings suggest that NGOs functioned as interpretive resources that helped the Chamber manage political constraints and reinforce institutional legitimacy. The study contributes to understanding how non-state participation operates as a legitimacy-building mechanism in international criminal justice.

    국제형사재판소(ICC)가 국제사회에서 ‘국가인지 여부’가 논란이 되는 영토적 실체를 국가로 인정할 수 있는지의 문제는 단순한 사실판단을 넘어 재판관할권, 국제정치, 그리고 사법적 정당성이 교차하는 쟁점이다. 특히 2021년 2월 5일 ICC 제1전심재판부의 팔레스타인 영토 관할권 결정은 NGO 법정조언자(amicus curiae)의 의견 제출이 재판부의 법적 논리 형성에 실질적인 영향을 미칠 수 있음을 보여준 중요한 사례였으나, 그 작동 경로에 대한 실증 연구는 부재했다. 본 연구는 해당 결정에서 제출된 43건의 법정조언서 중 NGO가 제출한 16건을 전수 분석하여, NGO의 논리가 재판부의 판단 과정에서 수용·배제·변형되는 방식을 추적하였다. 분석 결과, 재판부는 정치적 중립성과 재판 효율성을 이유로 NGO의 주장을 명시적으로 인용하지 않았으나, 로마규정 가입 절차와 실효성의 원칙에 기반한 기능적·목적론적 접근을 채택함으로써 관할권 인정 진영 NGO의 논리 구조와 실질적으로 수렴하였다. 반면, 몬테비데오 협약 요건에 대한 철저한 문리적·형식적 국가성 해석은 배제되었다. 이러한 선택적 수용은 NGO가 판결의 결론을 직접 좌우하기보다, 재판부가 정치적 부담을 관리하고 제도적 정당성을 확보하는 데 필요한 논증 자원으로 활용되었음을 보여준다. 본 연구는 ICC에서의 비국가 행위자 참여가 가지는 기능적 의미를 실증적으로 규명함으로써, 국제형사사법의 민주적 정당성과 제도적 진화에 관한 논의에 기여한다.
