    This study examines the emergence and development of climate litigation for future generations through the analytical framework of Legal Opportunity Structure. By comparing East Asian jurisdictions—South Korea, Japan, and China—with leading global precedents in the Netherlands, Germany, Colombia, and the United States, the research explores how various factors in access to courts, legal stock, and judicial receptivity affect the prospects of success in climate litigation for future generations.
    The analysis finds that the outcome of climate litigation for future generations depends less on institutional design or the presence of explicit environmental rights than on judicial culture. Climate litigation is likely to succeed in jurisdictions where courts perceive themselves as legitimate actors in enforcing the state’s duty to protect those yet to be born from climate harm, yet broader access to judicial review and legislative development can still foster judicial transformation and expand interpretative openness. The study contributes to the growing literature on climate litigation by analyzing East Asian cases within a comparative perspective based on the Legal Opportunity Structure framework.

    본 연구는 법적 기회 구조 (Legal Opportunity Structure) 분석 틀을 통해 미래세대를 위한 기후소송의 등장과 발전 과정을 탐구한다. 한국, 일본, 중국 등 동아시아 국가들을 네덜란드, 독일, 콜롬비아, 미국의 주요 판례와 비교함으로써, 각국의 사법체계 내 법원 접근성, 이용 가능한 법적 자원, 그리고 사법적 수용성이 기후소송의 등장과 결과에 어떠한 영향을 미치는지를 분석한다.
    분석 결과, 미래세대를 위한 기후소송의 성패는 제도적 설계나 명시적 환경권의 존재 여부보다는 사법문화와 해석적 지향에 더 크게 영향을 받는 것으로 나타났다. 기후소송은 법원이 기후 위험으로부터 아직 태어나지 않은 세대를 보호할 국가의 의무를 집행할 정당한 행위자로 스스로를 인식하는 사법 환경에서 성공할 가능성이 높다. 다만, 사법적 심사 접근성의 확대와 입법적 발전은 사법의 변화를 촉진하고 해석의 개방성을 확장할 수 있다. 본 연구는 법적 기회 구조 틀에 기반하여 동아시아 사례를 비교적 관점에서 분석함으로써 기후소송 연구에 학문적으로 기여한다.
