    Since the Marrakesh Agreement Establishing the World Trade Organization and the Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU) entered into force in 1995, the WTO dispute settlement system has been regarded as the cornerstone of the multilateral trading order. Its apex body—the Appellate Body (AB)—was long praised as the “crown jewel” of this system. The AB’s permanent character, its expert-based review, and its two-tiered finality enhanced the authority and predictability of WTO rulings, providing members with a legally binding means of resolving trade disputes. However, this institutional architecture began to collapse in 2017, when the United States, citing systemic concerns about the Appellate Body’s functioning and alleged judicial overreach, started to block new appointments. By December 11, 2019, the Appellate Body had ceased operating due to a lack of quorum. Since then, the two-tier system has effectively disintegrated: a losing party can “appeal into the void” to delay implementation, thereby undermining the overall authority of WTO law.
    This thesis examines whether arbitration, when used as a substitute for the WTO AB, is compatible with Article 25 of the DSU. It was inspired by the Multi-Party Interim Appeal Arbitration Arrangement (MPIA), through which a group of WTO Members have sought to reconstruct an appellate tier by means of “appeal-type” arbitration in the wake of the AB’s paralysis. The study thus asks a central legal question: whether, as a matter of treaty law and institutional design, DSU Article 25 authorize arbitration to function as an appellate mechanism.
    This topic matters, first, because multilateralism and the WTO Appellate Body (AB) have long been central to keeping international trade disputes under legal, rather than power-based, control. The AB anchored the system by providing authoritative interpretations, stabilizing expectations, and offering smaller economies a meaningful remedy against measures taken by larger partners. After the AB’s paralysis in 2019, this carefully constructed two-tier system effectively disintegrated, and the WTO’s dispute settlement mechanism entered a visible crisis. Yet members, through MC12, MC13 and subsequent processes, have repeatedly expressed the expectation of restoring a “fully and well-functioning” dispute settlement system, including an effective appeal stage. In this environment, any response to the crisis must not only be politically attractive but also legally sound and system-preserving. Second, the question is important because this thesis clarifies that even as a temporary mechanism, the MPIA or any attempt to use DSU Article 25 arbitration as a substitute for the AB is illegal, unreasonable and inconsistent with the DSU. Doctrinal analysis shows that Article 25 was designed for ad hoc, consent-based, “expeditious arbitration” in certain defined disputes, with awards that are merely notified to, not adopted by, the DSB, and therefore lack systemic precedential effect. Practice under DS160 and the post-2019 MPIA cases (such as DS591 and DS611) confirms that “appeal-type” arbitrations, even when they mimic appellate procedures, remain outside the panel, adoption, appeal sequence and retain only inter partes effect. An institutional comparison of arbitration and appeal further demonstrates that arbitration and appeal embody different institutional identities. Third, answering this question provides orientation for future reform of WTO dispute settlement. Despite WTO rules must evolve and its institutions must be recalibrated, the multilateral trading system remains a cornerstone of global economic governance that should be preserved, not abandoned It shows that DSU Article 25 arbitration—at least in its current design—should not become the new default model for a second instance, but that the procedural advantages tested under Article 25 (stricter timelines, narrower issues on appeal, roster-based adjudicators and more streamlined procedures) should instead feed into a reformed DSU Article 17 or a newly designed appellate structure within the WTO framework. In this way, the thesis insists that crisis management must stay anchored in multilateral rules, and that preserving the WTO requires rebuilding an appellate mechanism that is both effective and lawful, rather than normalizing a legally untenable use of Article 25.
    Looking forward, the thesis argues that meaningful reform must return to DSU Article 17 and rebuild appellate review on an explicit, membership-wide mandate, while selectively absorbing procedural lessons from the MPIA. By clarifying the legal limits of Article 25 and outlining elements of a re-engineered appellate mechanism, the study contributes to debates on restoring the effectiveness and legitimacy of the WTO dispute settlement system now and in the future.
