21세기 초반 세계 경제를 지탱하던 다자주의 기반의 자유무역 질서는 2008년 글로벌 금융위기와 2020년 COVID-19 팬데믹을 거치며 중대한 전환점을 맞이하였다. 효율성 중심의 글로벌 공급망(GVC)은 안보 중심의 가치사슬로 재편되고 있으며, 주요국들은 자국 산업 보호와 경제 안보 확보를 위해 보조금과 비관세장벽을 적극 활용하는 ‘신(新)보호무역주의’ 기조를 강화하고 있다.
본 연구는 이러한 통상 환경의 구조적 변화 속에서 2022년 발효된 미국의 ‘인플레이션 감축법(Inflation Reduction Act, 이하 IRA)’이 갖는 보호무역주의적 본질을 국제 통상법적 관점에서 고찰하고, 동 법안이 한국의 핵심 주력 산업인 자동차 및 배터리 산업에 미치는 영향을 분석하여 실효성 있는 법적·제도적 대응 방안을 모색하는 데 그 목적이 있다.
이를 위해 본 연구는 문헌 연구와 사례 분석을 병행하였다. 우선 IRA의 핵심인 ‘전기차 세액공제(Section 30D)’ 조항을 WTO 규범에 비추어 법리적으로 분석한 결과, 해당 조치는 GATT 제1조(최혜국대우)와 제3조(내국민대우) 원칙을 위반하는 법률상 차별에 해당함을 확인하였다. 특히 북미 최종 조립 요건과 특정국 광물 배제 규정은 SCM 협정이 엄격히 금지하는 수입대체 보조금의 성격을 띠고 있어 그 위법성이 명백하다. 미국 측이 주장하는 환경 보호(GATT 제20조) 및 국가 안보(GATT 제21조) 예외 논리는 수단의 적합성과 비례성 원칙을 충족하지 못하여 법적 정당성이 결여된 것으로 판단된다.
산업적 측면에서 IRA는 한국 산업에 복합적인 파급효과를 미치고 있다. 국내 자동차 산업은 보조금 수혜 제외로 인한 단기적인 가격 경쟁력 약화와 함께, 강제된 현지화 투자로 인한 국내 생산 기반의 공동화 우려에 직면해 있다. 배터리 산업의 경우, 중국 기업의 배제로 인한 시장 선점의 기회와 첨단제조생산세액공제(AMPC) 수혜라는 긍정적 요인이 존재하나, 해외우려단체(FEOC) 규정에 따른 공급망 재편 비용 증가와 투자 리스크라는 구조적 위기가 공존하고 있음이 밝혀졌다.
이러한 분석을 바탕으로 본 연구는 다음과 같은 법적·제도적 접근 방향을 제언한다. 첫째, 다자적 차원에서는 WTO 분쟁해결절차 제소를 전략적 레버리지로 활용하되, 유사 입장국과의 공조를 통해 미국의 태도 변화를 압박해야 한다. 둘째, 양자적 차원에서는 한미 FTA 채널을 적극 가동하여 FTA 체결국 지위의 유연한 해석과 주요 독소 조항의 한시적 유예를 확보해야 한다. 셋째, 국내적 차원에서는 정부 주도의 핵심 광물 확보 지원과 차세대 배터리 기술 R&D 투자를 통해 공급망의 대외 의존도를 낮추고 산업의 기초 체력을 강화해야 한다.
결론적으로 본 연구는 IRA가 단순한 산업 정책을 넘어선 경제 안보의 법제화임을 시사하며, 한국이 급변하는 통상 질서 속에서 국익을 수호하기 위해서는 규범에 입각한 원칙적 대응과 공급망 내재화를 통한 실리적 대응을 병행하는 고도의 경제 안보 전략이 필요함을 역설한다.

The global trade order, once anchored in multilateralism and free trade, has reached a critical turning point following the 2008 global financial crisis and the COVID-19 pandemic. Global Value Chains (GVCs), previously centered on efficiency, are being reorganized into security-oriented value chains. Major nations are intensifying "New Protectionism" by actively utilizing subsidies and non-tariff barriers to protect domestic industries and secure economic security.
Amid these structural changes, this study aims to examine the protectionist nature of the U.S. Inflation Reduction Act (IRA) of 2022 from the perspective of international trade law. Furthermore, it analyzes the impact of the act on South Korea's key industries—automotive and battery—to propose effective legal and institutional response strategies.
To this end, this study employed literature review and case analysis methods. First, an analysis of the "Clean Vehicle Credit (Section 30D)"—the core of the IRA—against WTO norms reveals that the provision constitutes de jure discrimination, violating GATT Article I (Most-Favored-Nation Treatment) and Article III (National Treatment). Specifically, the "North American Final Assembly" requirement and the exclusion of critical minerals from specific countries function as "Import Substitution Subsidies," which are strictly prohibited under the SCM Agreement. The potential U.S. defenses based on Environmental Protection (GATT Art. XX) and National Security (GATT Art. XXI) lack legal justification as they fail to meet the principles of necessity and proportionality.
From an industrial perspective, the IRA exerts complex effects on Korean industries. The automotive industry faces weakened short-term price competitiveness due to subsidy exclusion and concerns over the "hollowing-out" of domestic production bases due to forced localization investments. The battery industry faces a dual reality: opportunities arising from market preemption via the exclusion of Chinese firms and benefits from the Advanced Manufacturing Production Credit (AMPC) coexist with the structural crisis of rising costs and investment risks due to Foreign Entity of Concern (FEOC) regulations.
Based on this analysis, the study suggests the following legal and institutional approaches: First, at the multilateral level, the WTO dispute settlement mechanism should be utilized as strategic leverage, while pressure on the U.S. should be exerted through coalitions with like-minded countries. Second, at the bilateral level, the KORUS FTA channel must be actively utilized to secure flexible interpretations of "FTA partner" status and temporary exemptions for critical provisions. Third, at the domestic level, government-led support for securing critical minerals and R&D investment in next-generation battery technologies are essential to reduce external dependency and strengthen industrial fundamentals.
In conclusion, this study implies that the IRA represents the legalization of "Economic Security" beyond mere industrial policy. It argues that for South Korea to safeguard its national interest in this rapidly changing trade order, a sophisticated economic security strategy combining principle-based responses with pragmatic supply chain internalization is imperative.
