본 연구는 2020년 7월 시행된 계약갱신요구권과 전월세상한제가 임대 시장 구조와 거래 행태에 미친 영향을 실증적으로 규명하는데 목적이 있다. 이를 위해 서울시 부동산 시장을 선도하는 KB50 아파트의 실거래 데이터(2018.1∼2025.7)를 활용하여, 제도 도입이 야기한 미시적 시장 분화와 구조적 변화를 분석하였다.
주요 분석 결과는 다음과 같다.
첫째, 시장의 구조적 분절과 이중 가격 구조(Dual Price Structure)의 고착화이다. 제도 시행 이후 시장 원리가 작동하는 신규(Market-following Group)와 제도의 통제를 받는 갱신(Regulatory Compliant Group) 간의 가격 동조화가 약화되면서 구조적인 가격 괴리(Decoupling)가 발생하였다. 두 집단 간의 가격 차이는 통계적으로 매우 유의미(t=-43.77)하였으며, 시장 상황에 따라 격차가 확대되거나 역전되는 비선형적 패턴을 보였다.
둘째, 자율 협의 시장의 형성과 삼중 가격 구조(Triple Price Structure)의 확인이다. 갱신 시장 내부의 이질성을 분석한 결과, 법적 상한선(5%)을 초과하여 합의하는 자율 협의(Negotiated Price)그룹이 독자적인 가격대를 형성하고 있음이 밝혀졌다. 이는 임대인과 임차인이 거래 비용 절감과 리스크 회피를 위해 형성한 관계 프리미엄(Relationship Premium) 기반의 타협 가격으로, 신규(시장 주총)와 갱신(규제 순응) 사이의 회색 지대(Gray Zone)를 구축하며 시장을 삼중 구조로 분화시켰다. 이러한 가격 괴리는 갱신 시장 내부의 분화를 초래하여, 법적 상한선(5%)을 초과해 합의하는 자율 협의 시장을 형성시켰다.
셋째, 주택 특성에 따른 차별적 시장 반응이다. 임대인의 협상력이 높은 대형 평형과 구축 아파트에서는 자율 협의가(Negotiated Price)가 신규 가격에 수렴하며 실질적 이중 구조로 회귀한 반면, 거래가 활발한 중소형 및 준신축 평형에서는 뚜렷한 삼중 가격 구조가 유지되는 차별성이 관찰되었다.
넷째, 규제로 인한 풍선 효과(Balloon Effect)와 월세화의 가속이다. 전월세상한제로 인해 갱신 시장에서 억눌린 가격 상승 압력은 신규 및 자율 협의 시장((Gray Zone)으로 전가되었다. 이는 고가 아파트 시장에서 임차인의 유동성 제약을 심화시켜, 보증금 증액분을 월세로 전환하는 보증부월세화(Shift to Monthly Rent with Deposit) 현상을 가속화시키는 기제로 작용하였다.
결론적으로, 본 연구는 획일적인 임대료 규제가 시장의 미시적 다양성과 충돌할 때 발생하는 규제의 역설을 실증하였다. 시장은 자율 협의 시장(Gray Zone)과 보증부월세라는 우회로를 통해 제도 변화의 충격을 흡수하였음을 확인하였으며, 향후 정책은 기계적인 갱신율 제고를 넘어 임차 가구의 실질적 현금 흐름 부담 완화에 초점을 맞춰야 함을 시사한다.

This study empirically examines the impact of the Tenant’s right to renew and
the rent increase cap on the rental housing market. To clearly capture the effects of
these policies, the study selected 50 major apartment complexes in preferred
locations within Seoul as the analysis targets. Utilizing actual transaction data for
Jeonse (lump-sum deposit) and monthly rent from these complexes, this research
analyzes rent trends and lease contract behaviors.
The key findings are as follows:
First, the study identifies a structural segmentation of the market and the
entrenchment of a Dual Price Structure. Through Type I analysis, the market was
dichotomized, revealing that the price synchronization between the Regulated Group
(subject to legal caps) and the Unregulated Group (driven by market forces)
weakened, leading to a structural price decoupling. The price divergence between
these two groups was statistically significant (t=-43.772) and exhibited a non-linear
pattern, widening or inverting depending on market conditions.
Second, the formation of a market for Negotiated Rents and the confirmation of
a Triple Price Structure were observed. Type II analysis revealed heterogeneity
within the Unregulated Group, identifying that contracts exceeding the 5% legal cap
through mutual agreement formed a distinct Gray Zone between Market Rents (new
contracts) and Regulated Rents (capped renewals). This suggests that market
participants created an intermediate segment reflecting a "relationship premium" to
minimize transaction costs and risks, effectively differentiating the market into a
triple structure even under uniform regulation.
Third, differential market responses were observed based on housing
characteristics. In large-sized and older apartments where landlords hold higher
bargaining power, Negotiated Rents tended to converge with Market Rents, reverting to
a de facto dual structure. Conversely, in small-to-medium-sized and newer apartments
with active trading, a distinct triple price hierarchy (New/Negotiated/Regulated) was
maintained.
Fourth, the study verifies the Balloon Effect and the acceleration of the shift to
monthly rent as a regulatory paradox. The suppressed price pressure in the regulated
renewal market spilled over into the unregulated new and negotiated markets.
Notably, a sharp decline in Jeonse contracts and a surge in quasi-monthly rent
contracts (deposit-based monthly rent) were observed in the negotiated market. This
indicates that liquidity constraints faced by tenants due to soaring deposits structurally
accelerated the conversion of deposit increases into monthly rent payments.
In conclusion, this study demonstrates the paradox that arises when uniform rent
control conflicts with market diversity. The findings confirm that the market
absorbed the policy shock through the creation of a Gray Zone and the shift
toward deposit-based monthly rents. These results suggest that future housing
policies should look beyond mechanical renewal rates and focus on alleviating the
actual cash flow burden on tenant households.
