A Study on the Enhancement of Pre-Assessment Taxpayer Remedies in Tax Dispute Resolution

    Hyunsoo Park
    Department of Law
    Sungkyunkwan University

Once a tax assessment is imposed, taxpayers who seek relief through contentious procedures must undergo a complex sequence of administrative appeals—beginning with pre-assessment review—and potentially proceed through three levels of judicial litigation, incurring substantial time and financial burdens. From the standpoint of taxpayer rights, effective relief at the pre-assessment stage represents the most desirable and efficient form of protection.
The right to request a pre-assessment review is derived from the constitutional principle of due process under Article 12(1) of the Constitution. Korean courts have consistently held that a tax assessment suffers from a grave and manifest procedural defect, rendering it null and void, where the tax authority fails to issue a pre-assessment notice or a notice of tax audit results, or where an assessment is imposed before a pending request for pre-assessment review has been decided. Despite the constitutional and procedural significance of pre-assessment remedies, empirical data indicate a decline in both the number of pre-assessment review requests and their acceptance rates in recent years, suggesting that pre-assessment taxpayer remedies remain insufficiently utilized.
In response, this study conducts a comparative analysis of pre-assessment taxpayer remedy systems in major jurisdictions—focusing in particular on the United States, where such mechanisms are highly developed—and proposes institutional reforms tailored to the Korean legal and administrative context to revitalize pre-assessment review and strengthen pre-assessment taxpayer protection.
First, this study proposes the introduction of a Fast Track Settlement mechanism at the tax audit stage, which constitutes the earliest point at which tax disputes arise. Given the strict application of the principle of legality in taxation, the scope of Fast Track Settlement should be limited to disputes concerning factual determinations rather than issues of statutory interpretation. Institutionally, Fast Track Settlement should be administered by a dedicated unit within the Office of the Taxpayer Advocate of regional and local tax offices that conduct audits, with staffing adjusted according to demand. The procedure should be initiated upon the taxpayer’s application and formally commenced only after review and approval by the Fast Track Settlement body following consultation with the audit division. This approval mechanism is critical to the effectiveness of the system, as it directly affects both accessibility and utilization. Experience in the United States demonstrates that the absence of systematic data on rejected Fast Track Settlement applications and their reasons has impeded meaningful evaluation of underutilization factors. To promote procedural efficiency, statutory processing deadlines—such as 60 or 90 days depending on case size and disputed tax amounts—should be established. Agreements reached through Fast Track Settlement should bind the tax authority to assess, or refrain from assessing, taxes in accordance with the agreement, while taxpayers should be precluded from filing a pre-assessment review request or subsequent appeals based on identical facts and issues.
Until the Fast Track Settlement system becomes fully institutionalized, it remains necessary to maintain the existing Tax Fact-Finding Advisory Review mechanism for high-value cases exceeding a specified monetary threshold. Moreover, prior to the formal introduction of Fast Track Settlement, the current system should be reformed to allow taxpayers themselves to apply for fact-finding advisory review.
Second, this study recommends the gradual reduction of committee-based deliberation procedures at the pre-assessment review stage. Comparative experience demonstrates that pre-assessment remedies—whose primary functions are inquisitorial review and administrative self-correction—can effectively fulfill their role without reliance on quasi-judicial, collegial decision-making bodies.
Third, this study proposes abolishing the optional objection procedure and extending the statutory processing period for pre-assessment review from 30 days to 60 days. Resolving disputes at the pre-assessment stage that would otherwise be granted relief through subsequent objection procedures would enhance both taxpayer satisfaction and administrative efficiency.
This study advances reform proposals aimed at revitalizing and strengthening pre-assessment taxpayer remedies in tax dispute resolution. Such reforms align with the core policy objectives of Taxpayer Advocate within the National Tax Service and warrant legislative and administrative refinement that carefully balances procedural effectiveness with institutional efficiency.
