    디지털증거는 수사 과정에서 핵심적 증거로 활용되고 있으며, 이에 따라 압수·수색 절차의 적정성과 무결성 확보가 더욱 중요해지고 있다. 특히 현장에서 유관정보의 선별이 어려운 경우에는 현장 외 압수 절차가 불가피한데, 이 과정에서 피압수자의 참여권이 실질적으로 보장되지 못하는 문제가 지속적으로 제기되고 있다. 기존 연구는 원격 참여나 화상 기반의 참여 방식을 제안하였으나, 전자정보에 대한 기술적 접근 통제와 무결성 확인, 참여 사실의 기술적 입증 측면에서 여전히 한계를 가진다. 본 연구는 이러한 문제점을 해결하기 위해 암호화 기반 전자봉인시스템을 중심으로 하는 디지털증거 봉인 모델을 제안하였다. 제안된 구조는 디지털증거를 암호화하여 저장하고, 봉인해제를 위해 필요한 복호화 키를 피압수자와 수사기관이 공동으로 보유하도록 설계하여, 원격 환경에서도 피압수자의 참여를 기술적으로 보장할 수 있도록 하였다. 또한 봉인·봉인해제·재봉인 절차 전반의 흐름과 기록 구조를 통합적으로 정의함으로써, 절차적 정당성과 무결성 검증을 가능하게 하였다.
    본 시스템은 데스크탑 기반의 전자봉인시스템과 웹 기반 원격 참여시스템으로 구성되며, 디지털증거의 암·복호화, 봉인지 생성, 전자서명 및 시점확인, 키 분할·복구, 절차 이력 관리 기능을 포함한다. 절차 반복성이 고려된 기록 구조는 봉인-봉인해제-재봉인의 전 과정을 연속적으로 추적할 수 있도록 하여, 수사 과정에서의 투명성과 재현성을 높인다.
    본 연구는 봉인 모델의 동작 흐름과 구성 요소를 설계하고, 주요 기능의 적용 가능성을 분석함으로써 전자봉인의 기술적 실효성을 검토하였다. 아울러 실무·제도적 관점에서 전자봉인의 도입 가능성과 한계를 검토하고, 향후 개선 방향과 정책적 시사점을 제시하였다.

    Digital evidence plays a critical role in criminal investigations, rendering the procedural legitimacy and integrity of seizure and search processes increasingly important. When selective identification of relevant information at the scene is impractical, off-site seizure procedures become unavoidable; however, in such situations, the suspect’s right to participation has remained a persistent concern. Although prior studies have proposed remote or video-based participation mechanisms, they continue to face limitations in terms of technical access control to electronic information, integrity verification, and reliable technical proof of participation.
    To address these limitations, this study proposes a digital evidence sealing model centered on an encryption-based electronic sealing system. In the proposed model, digital evidence is encrypted upon storage, and the decryption key required for unsealing is jointly controlled by the suspect and the investigative authority. This structure provides a technical guarantee of the suspect’s participation even in remote environments. Furthermore, by systematically defining the procedural flow and record structures of sealing, unsealing, and resealing, the model enables procedural legitimacy and supports integrity verification throughout the entire process.
    The proposed system consists of a desktop-based electronic sealing system and a web-based remote participation system. It incorporates functions including digital evidence encryption and decryption, sealing record generation, electronic signatures and trusted timestamping, key splitting and recovery, and procedural history management. The record structure is designed to support procedural repetition, allowing continuous tracing of the sealing–unsealing–resealing lifecycle and thereby enhancing transparency and reproducibility in investigative processes.
    This study presents the design of the proposed sealing model and analyzes the applicability of its core functions to assess the technical effectiveness of electronic sealing. In addition, the practical and institutional feasibility of adopting electronic sealing is discussed, along with its limitations, future improvement directions, and policy implications.
