근로자는 인간으로서의 존엄과 가치를 지닌 인격체이고 자신의 전인격을 근로의 과정에 투입하고 있다는 점에서 근로의 과정은 근로자의 인격과 분리될 수 없다. 또한 근로자는 근로를 통해서 자아를 실현하므로 근로자가 자신의 인격을 실현시킬 수 있도록 사용자는 업무명령권의 행사와 조화를 이루는 범위 내에서 배려해야 할 근로계약상 안전배려의무를 부담한다. 국가는 산업안전보건법을 통하여 사업주에게 근로자의 안전과 건강을 유지·증진하고 근로조건을 개선할 의무를 부과하였는데, 사용자의 보호의무가 있는 건강에는 신체적 건강뿐만 아니라 정신적 건강까지도 포함된다. 이에 따라 사용자는 물적 근로환경뿐만 아니라 비가시적인 인적 근로환경이 근로자의 정신건강을 침해하지 않도록 에방하고 관리할 의무가 있다.
직장 내 괴롭힘 금지법의 입법 배경은 직장에서 비상식적인 갑질 행위로 인해 근로자가 스스로 목숨을 잃거나 인격권을 침해당하는 상황들이 사회적 공분을 사게 되면서 직장에서의 괴롭힘 문제가 단순히 개인 간 갈등의 문제가 아니라 국가가 법으로 보호해야 할 근로조건임에 사회적 공감대가 형성되었기 때문이다.
이에 따라 근로기준법 개정을 통해 2019년 7월 직장 내 괴롭힘 금지제도가 시행되었다. 2019년 시행된 직장 내 괴롭힘 금지제도는 우리 사회의 노동인격에 대한 인식을 강화하고 직장문화에 많은 변화를 가져왔다. 법 개정 이전에는 조직문화나 인사관리라는 미명하에 용인됐던 행위들도 법 개정 이후에는 부당한 인격권 침해라고 여겨지면 신고할 수 있게 되었다. 직장 내 괴롭힘 금지제도는 시행 이후 6년 동안 사회 인식과 직장문화에 큰 변화를 가져왔지만 성급한 입법으로 인해 반영되지 못했던 한계점들이 드러났다. 이에 따른 개선점들이 정리되었는데, 선행연구에서 공통적으로 나타난 한계점은 아래와 같다.
첫째, 현행 직장 내 괴롭힘의 성립요건에 대해 지적되는 한계점이다. 괴롭힘 성립요건의 개념이 모호하여 괴롭힘인지 객관적 판단이 어려우며 괴롭힘 신고 단계부터 오남용과 허위신고가 발생하는 점이다.
둘째, 직장 내 괴롭힘 구제제도가 인격권 침해의 구제수단으로 실효적이지 못한 한계점이다. 현행 괴롭힘 구제제도는 사업장 자율적 해결을 원칙으로 하며 괴롭힘 발생시 사용자에게 조치 의무를 부과하고 있다. 그러나 사업장 자율 해결방식을 통해서는 조사나 구제의 적정성에 한계가 있다. 마찬가지로 고용노동부나 국민권익위원회의 구제방식은 집행력이나 강제력 측면에 한계가 있다. 민사소송을 통한 손해배상책임의 사후적 구제방식으로는 원상회복이 불가한 한계점이 있었다.
선행연구에서 확인된 한계점에 대해 각각 개선방안을 연구하였다.
첫째, 성립요건의 한계점을 검토하기 위해 직장 내 괴롭힘 금지에 관한 내용이 입법된 국가들의 내용을 비교법적으로 검토하여 시사점을 도출하였다. 이를 바탕으로 직장 내 괴롭힘 적용범위를 확대하는 입법적 개선방안과 성립요건의 모호성을 제거하는 성립요건의 재정립을 연구하였다.
둘째, 직장 내 괴롭힘 구제제도가 실효적이지 못한 한계점을 개선하기 위해 새로운 직장 내 괴롭힘 구제수단으로서 금지청구권과 노동위원회 구제제도의 도입을 연구하였다.
마지막으로 허위신고 및 오남용 문제 해결을 위해 허위신고자에 대한 제재방안과 신고 절차를 명확히 하는 방향을 연구하였다.

Workers are human beings who possess inherent dignity and value, and the process of work cannot be separated from their personality, as they invest their full personhood into their labor. Because workers realize their identity and self through work, employers bear a contractual duty of care to respect and protect workers’ personality interests within the scope consistent with the exercise of managerial authority. The Occupational Safety and Health Act further obligates employers to safeguard workers’ safety and health and to improve working conditions, with the concept of health encompassing both physical and mental well-being. Accordingly, employers have a duty to manage invisible aspects of the work environment—such as interpersonal conflict, organizational culture, and personnel management practices—so that they do not harm workers’ mental health.
The enactment of the workplace harassment prohibition under the Labor Standards Act in July 2019 stemmed from a growing societal consensus that abusive conduct in the workplace, which had led to loss of life and violations of dignity, constituted not merely interpersonal conflict but working conditions requiring state regulation. Since its introduction, the system has significantly shaped workplace culture and social awareness, reclassifying many previously tolerated behaviors as infringements of personality rights.
However, six years after its implementation, several limitations of the initial legislation have emerged. Prior studies identify two major issues: ambiguity in the legal requirements for establishing workplace harassment, which has led to inconsistent assessments and misuse of the reporting process; and the lack of effectiveness in remedial mechanisms, which rely solely on employers’ internal investigations and offer limited restoration through post-hoc procedures such as administrative petitions or civil litigation.
This study addresses these deficiencies through comparative legal analysis and a review of relevant civil and administrative case law. By examining the regulatory frameworks of major jurisdictions—France, Japan, and Australia—and relevant ILO standards, the study proposes clearer definitional elements, an expanded scope of protection, and structural improvements to the current system. It further suggests introducing a preventive injunction mechanism and establishing remedial procedures before the Labor Relations Commission, while also presenting measures to address false or abusive reporting.
This research contributes academically and policy-wise by structurally re-evaluating the substantive requirements and remedial framework of Korea’s workplace harassment prohibition and by proposing practical reform measures grounded in comparative and case-based analysis.
