    현대 국제금융 질서에서 금융제재는 실효적인 외교·안보 정책 수단을 넘어, 국제거래와 금융시스템의 구조적 작동 방식에 직접적인 영향을 미치는 규범적 장치로 기능하고 있다. 특히 달러 결제망과 글로벌 금융중개 구조를 중심으로 집행되는 미국의 금융제재는 제재대상국에 대한 압박을 넘어, 제3국 금융기관과 기업의 거래 구조, 위험관리 방식, 준법체계 전반에까지 실질적인 제약을 형성해 왔다. 이와 같은 금융제재의 작동 방식은 전통적으로 유엔 안전보장이사회 결의에 기초한 다자제재를 중심으로 발전해 온 국제법적 제재 논의에 새로운 분석 과제를 제기한다.
    이러한 문제의식을 바탕으로, 일방적 금융제재, 특히 미국의 금융제재가 국제법 질서에서 어떠한 법적 성격과 한계를 가지는지를 검토한다. 미국의 금융제재는 형식적으로는 자국 국내법에 근거한 집행이라는 외형을 취하지만, 실제로는 글로벌 금융 인프라에 대한 접근 통제를 통해 제3국 행위자에게까지 사실상의 규율 효과를 발생시킨다. 이로 인해 관할권, 역외적용, 불간섭원칙, 대항조치, 안보예외와 같은 국제법의 전통적 분석 틀만으로는 그 작동 방식과 규범적 함의를 포섭하기에는 일정한 제약이 있다.

    In the contemporary international financial system, financial sanctions operate not only as instruments of foreign and national security policy but also as regulatory mechanisms that shape the structure of international transactions and financial markets. In particular, U.S. financial sanctions implemented through the dollar-clearing system and global financial intermediation networks extend their effects beyond targeted states, influencing the transaction structures, risk-management practices, and compliance frameworks of third-country financial institutions and corporations. These features challenge international legal approaches to sanctions that have traditionally focused on multilateral measures authorized by United Nations Security Council resolutions.
    This dissertation examines the legal character and limits of unilateral financial sanctions, with particular attention to U.S. practice, within the framework of international law. Although formally grounded in domestic legal authority, U.S. financial sanctions generate de facto regulatory effects on third-country actors by controlling access to global financial infrastructure. As a result, their operation cannot be fully captured by established international legal doctrines concerning jurisdiction, extraterritorial application, non-intervention, countermeasures, or security exceptions.
    These limitations are most evident in the context of secondary sanctions targeting foreign financial institutions. Even in the absence of a traditional jurisdictional nexus with the United States, such measures induce compliance through the restructuring of financial transactions. While primary sanctions rely on personal or territorial connections to justify the application of U.S. law, the U.S. nexus in secondary sanctions functions ex post as a reference point for managing sanctions-related risk. Accordingly, secondary sanctions are better understood as infrastructure-based regulatory mechanisms operating through control over access to the dollar-clearing system and U.S. financial markets.
    On this basis, the dissertation argues that although secondary sanctions may be subject to review under international law, their nature and effects cannot be adequately assessed within existing evaluative frameworks. This limitation reflects the difficulty of applying conduct- and territory-based legal concepts to regulatory practices mediated through global financial infrastructure, and highlights the need to reconsider the role and limits of international law in addressing unilateral financial sanctions.
