This thesis, from a comparative perspective on the legal systems of South Korea and China, analyzes copyright disputes concerning secondary creations based on historical and cultural content. Such secondary creations are not merely “reproductions”; rather, they bring to the forefront the question of by what standards elements in the public domain and creative expressions should be distinguished and protected. However, in practice it is often difficult to clearly separate the form of a cultural relic itself (as a public-domain element) from the reconstructed results derived from that form (as protected expression). Moreover, in infringement determinations, the analyses of “dependence/derivation (access or reliance)” and “substantial similarity” are sometimes applied without clear differentiation, leading to doctrinal confusion.
Accordingly, this thesis adopts the hierarchical structure of “public domain – re-creation – cultural commodities” as its analytical framework. Building on common doctrines in South Korean and Chinese copyright law—such as the idea/fact/expression distinction, the merger doctrine, and the scènes à faire doctrine—it reconstructs the analytical path for determining the establishment of secondary works and the scope of their protection. Under South Korean law, the originality requirement for secondary works and the assessment of “substantial modification” are typically developed within a two-step structure: “derivation (access/probative similarity) → substantial similarity.” By contrast, Chinese law tends to present an integrated approach, often described as “access + substantial similarity = infringement,” in which the relevant elements are addressed in a more unified manner. Under a shared premise, both jurisdictions compare only the “residual layer of protected expression” after filtering out public-domain elements. Nevertheless, notable differences remain in the standards for assessing substantial similarity and in how the boundary between “improper use” and “fair use” is drawn in practice.
In particular, taking real-world scenarios involving traditional patterns, cultural relic imagery, and museum images/data as its factual premise, this thesis concretizes the criterion of “filtering public-domain elements first and then comparing only the remaining expressive layer.” On this basis, it distinguishes the comparative objects at the derivation stage (probative similarity) from those at the substantial similarity stage, and proposes practical compliance checkpoints that combine administrative permissions (where applicable), copyright licenses, and identification measures.
In addition, this thesis examines how cultural-heritage-related administrative controls—such as permits for access, photography, reproduction, and rubbings—established under China’s Law on the Protection of Cultural Relics and South Korea’s Cultural Heritage Protection Act, interact with copyright licensing. Through practical communication with museums and record-heritage management institutions, cultural product developers, and practicing lawyers and researchers, together with an analysis of contracts and related documents, this thesis empirically confirms that administrative permissions and copyright licenses often need to be obtained in parallel, yet neither substitutes for the other. It further offers practical implications for verifying the chain of title, securing authorization for the creation of secondary works, and designing sublicensing structures.
Ultimately, this thesis seeks to more clearly demarcate the boundary between public-domain material and protectable creative expression in the re-creation and commercialization of historical and cultural resources. By comprehensively considering the copyright and cultural-heritage legal regimes of South Korea and China, it proposes compliance standards aimed at promoting a balance among cultural heritage preservation, market development, and copyright protection.
