    Legal interpretation refers to the work of an interpreter facing a specific case to embody the law, that is, the application of the law. Legal norms help maintain legal stability by giving a particular order to the legal reality as it is, resulting in relatively predictable results even in unexpected situations. However, humans can't enact laws that can specifically address every real situation. Therefore, the law is inevitably composed of general and abstract legal texts.
    ConsIdering the general and abstract nature of the law as an inevitable phenomenon, one may wonder whether it is desirable to give these laws a compulsory effect that governs reality, unlike other texts. In response, Aristotle emphasizes the utility of 'application', saying that we can always understand abstract concepts only in the context of specific events. If so, it can be saId that it is reasonable, despite its inevitability, to respond to concrete reality with abstract laws.
    However, despite the high probability that the concrete meaning of the law can be secured through application, the task of embodying the law is not simple. As such, the work of deriving a definite meaning by resolving the law's uncertainty and ambiguity in a specific case is the work of a legal interpretation methodology.
    In general, legal interpretation methodologies used in academia and legal practice include textualism, intentionalism, and purposivism. Textualism refers to an approach that focuses on the linguistic and grammatical analysis of legal texts to secure their clear meaning, which is the goal of interpretation. Textualism emphasizes that legal texts are the sole criterion for interpretation, as the formal structure of the legislative process is generally implemented in representative democracies.
    However, it is questionable whether textualism can achieve the goal of interpretation expected by relying solely on the legal text. Of course, even if the legal text is open, it can be interpreted ambiguously over time and in the changed environment it creates. It is questionable whether this will fit common sense if the creator of the law 100 years ago and the current interpreter interpret the same law on the same legal text. In the end, if it boils down to choosing the result of interpretation, the interpreter's point of view, along with the legal text, serves as another criterion for interpretation. This means that literalism cannot declare the end of interpretation with the single interpretation criterion it claims.
    The same problem applies to intentionalism. Intentionalism relies on a method of imaginary reconstruction to secure this, arguing that the original intention of the legislature at the time of enactment was the most decisive criterion for interpretation. However, like textualism, this methodology also views the law as a static entity. In addition to text, data belonging to the horizon of text, such as legislative history, may narrow the options for interpretation. Still, in the end, it may face a problem of choice, and if so, it may end up as the interpreter's subjective imagination rather than the expected reconstruction.
    Another interpretive method is purposivism, which views the law in question as recently enacted and replaces the perspective of historical law with that of the interpreter. Since the current legislative policy is applied from the interpreter's perspective, there is a high probability that a dynamic interpretation will result.
    Nevertheless, this methodology can make an error like that of textualism or an intentionalism method, which consIders only the horizon of historical legal texts in the interpretation process. This is because the history of interpretation related to the text is unfairly excluded from the interpretation. Each traditional legal interpretation method can be viewed through a single criterion. Still, this fundamentalist interpretation method cannot be a general theory of interpretation because other interpretation criteria cannot be excluded. W. Eskridge presents a dynamic legal interpretation method with this point in mind.
    Since law is a variable of time rather than a fixed entity independent of time, the evolution of situational context always has a decisive effect on interpretation. Still, it is not as absolute as purposive interpretation. This is because the interpreter and the legal text are connected within a tradition of interpretation, and its historicity conditions the present horizon that shapes the interpreter's point of view. In the dynamic legal interpretation method, interpretation is a conversation between the interpreter and the text about a specific situation. The two subjects of interpretation seek a common understanding through repeated dialectical processes of mutual verification, without excluding each other, within hermeneutic cycles.
    This study critically assesses the problems with existing legal interpretation methodologies. It also applies traditional and dynamic legal interpretation to landmark Supreme Court of Korea and U.S. Supreme Court cases to theoretically investigate how each methodology operates and the results it yields.

    법률해석이란 구체적 사건에 직면한 해석자가 법을 구체화해내는 작업, 즉 법의 적용을 말한다. 법규범은 있는 그대로의 법적 현실에 일정한 질서를 부여하여 예상치 못한 상황에서도 비교적 예측 가능한 결과를 도출함으로써 법적 안정성을 유지하는 데 도움이 된다. 그런데 모든 현실의 상황에 대응할 수 있는 법률을 구체적으로 제정하는 것은 유한한 인간에게 불가능한 작업이다. 그렇기에 법률은 불가피하게 일반적·추상적 법문으로 구성될 수밖에 없다.
    이처럼 법률의 일반적·추상적 성격을 피할 수 없는 현상이라고 간주한다면, 이러한 법률에 다른 텍스트들과 달리 현실을 규율하는 강제적 효력을 부여하는 것이 바람직한가 하는 의문을 가질 수 있다. 이에 대해 Aristotle은 ‘적용’의 효용을 강조하면서, 우리는 언제나 추상적 개념을 구체적 사건의 맥락 속에서만 이해할 수 있다고 한다. 그렇다면 구체적 현실에 추상적 법률로 대응하는 것은 그 불가피성에도 불구하고 타당하다고 할 수 있다.
    그렇지만 적용을 통하여 법률의 구체적 의미를 확보할 수 있을 것이라는 고도의 개연성에도 불구하고 법을 구체화하는 작업은 간단하지 않다. 다소 거칠게 표현한다면, 이처럼 추상적 법률에서 나타나는 법문의 불확실성, 중의성의 문제를 구체적 사건의 맥락 속에서 해소함으로써 확정적인 의미를 도출하는 작업을 법률해석방법론이라고 할 수 있다.
    대체로 학계와 법 실무에서 운위되는 법률해석방법론으로는 문언주의, 의도주의, 목적주의를 들 수 있다. 문언주의는 그 해석의 목표인 법문의 명백한 의미를 확보하기 위하여 법문의 언어학적, 문법적 분석에 주력하는 접근법을 말한다. 문언주의는 대의제 국가에서 일반적으로 실행되는 입법과정의 형식적 구조를 만족하는 유일한 해석기준이 법문이라는 점을 강조한다.
    그러나 오직 법문에 의존하는 것으로 문언주의가 기대한 만큼 해석의 종결을 성취할 수 있는지는 의문이다. 법문이 개방적인 경우는 물론이지만, 상당히 명백해 보이는 경우도 시간의 경과와 이로 인해 변화된 환경으로 인해 법문은 중의적으로 파악될 수 있다. 100년 전 법률의 제정자와 현재의 해석자가 같은 법문을 대상으로 같은 법 해석을 하게 된다면 이것이 과연 상식에 부합할지 의문이다. 결국 해석 결과에 대한 선택의 문제로 귀결된다면 법문 이외에 해석자의 관점이 또 하나의 해석기준으로 작용하는 것이다. 이것은 문언주의가 자신이 주장하는 단일한 해석기준으로 해석의 종결을 선언할 수 없다는 것을 의미한다.
    의도주의적 해석론의 상황도 마찬가지이다. 의도주의는 법 제정 당시의 입법부의 원본 의도를 가장 강력한 해석의 기준이라고 주장하면서, 이것을 확보하기 위하여 상상적 재구성의 방법에 의존한다. 그러나 이것 역시 문언주의와 마찬가지로 법을 정태적인 실체로 파악하는 방법론이다. 문언 이외에 입법역사와 같은 텍스트의 지평에 속하는 자료들이 해석의 선택지를 좁히는 효과를 기대할 수 있지만, 결국 선택의 문제에 봉착할 수 있고 그렇다면 기대한 재구성보다는 해석자의 주관적 상상에 그칠 수 있다.
    다음은 목적주의적 해석론인데, 이것은 문제가 되는 법률을 최근에 제정된 것으로 간주하고, 역사적 법률의 관점을 해석자의 관점으로 대체하는 접근법을 말한다. 현재의 입법 정책이 해석자의 관점을 통하여 해석에 적용되기에 역동적 해석이 이루어질 개연성이 크다. 그럼에도 이러한 방법론은 역사적 법률 텍스트의 지평만을 해석 과정에서 고려하는 문언주의나 의도주의적 방법론과 유사한 오류를 범할 수 있다. 텍스트와 관련된 해석의 역사가 부당하게 해석에서 배제되기 때문이다. 현재 운위되는 기존의 전통적인 법률해석론은 각각 자신이 내세우는 단일한 해석기준으로 해석이 완결될 수 있다고 자처하지만 이러한 근본주의적 해석론은 다른 해석기준의 개입을 배제할 수 없기에 해석에 관한 일반이론이 될 수 없다. W. Eskridge는 이 점에 착안하여 역동적 법률해석론을 제시한다.

    본 연구에서는 기존의 법률해석방법론들이 지닌 문제점들을 분석하고, 한국의 대법원과 미국의 연방대법원의 주요 판례에 전통적 법률해석방법론과 역동적 법률해석론을 적용하여 각각의 방법론이 작동하는 방식과 그 과정을 통해 도출된 결과의 차이를 이론적으로 규명해 보고자 한다.
