본 연구는 미국과 중국의 초국경기술기업(Transnational Technology Companies, TTC)이 아프리카와 유럽연합(EU)의 데이터 주권에 제기하는 구조적 도전을 비교 분석하고, 이러한 도전이 지역별 제도적 역량의 차이에 따라 어떻게 상이하게 수용되거나 제약되는지를 규명한다. 디지털 전환이 가속화되는 환경에서 데이터는 핵심적인 전략 자원으로 부상하였으나, 데이터의 초국경적 이동과 이를 관리·활용하는 글로벌 기술기업의 확장은 전통적인 영토 기반 주권 개념에 근본적인 재구성을 요구하고 있다.
본 연구는 데이터 주권을 규범적·위치적·인지적 세 층위로 개념화한다. 규범적 데이터 주권은 데이터 생성·수집 단계에서 개인정보 보호 규범을 설정하고 집행하는 국가의 권한을 의미하며, 위치적 데이터 주권은 데이터 저장·전송 단계에서 데이터의 물리적 위치와 국경 간 이동을 통제하는 권한을 가리킨다. 인지적 데이터 주권은 데이터 소비·활용 단계에서 정보 생태계와 공론장에 대한 통제권으로서, 알고리즘 기반 정보 큐레이션이 민주적 숙의에 미치는 영향을 포함한다. 이러한 개념화는 관할권의 삼분법(입법·사법·집행 관할권)과 데이터 가치사슬의 세 단계를 결합한 분석틀을 통해 작동하며, 제도적 응집도를 조절변수로 설정하여 EU(높은 제도적 응집도)와 아프리카(낮은 제도적 응집도)의 대조적 맥락을 비교한다.
연구 방법으로는 질적 비교사례연구를 채택하였다. 분석 대상은 미국의 TTC(Google, Meta, X)와 중국의 TTC(TikTok, Huawei, Transsion, CloudWalk)이며, 법률 조문, 정책 문서, 기업 보고서 등 1차 자료와 학술논문 및 언론보도 등 2차 자료를 종합적으로 활용하였다.
분석 결과, 제도적 응집도가 높은 EU에서는 강력한 규범 체계에도 불구하고 데이터 주권이 주로 형식적으로 방어되는 반면, 실질적 통제는 기술적·제도적 우회 전략을 통해 지속적으로 잠식되는 양상이 확인되었다. 데이터 생성·수집 단계에서는 동의와 합법성 요건이 형식적으로 충족되지만 실질적 선택권은 제한되며, 저장·전송 단계에서는 관할권 충돌이 반복적으로 발생한다. 데이터 소비·활용 단계에서는 알고리즘 기반 정보 유통이 공론장을 구조적으로 재편함으로써 인지적 데이터 주권을 약화시킨다.
반면 아프리카에서는 제도적 규제 공백 속에서 TTC의 사적 규범이 공적 규범을 대체하는 경향이 두드러진다. 이 지역에서는 데이터 생성부터 저장·활용에 이르는 전 과정에서 국가의 개입과 집행이 제한적으로 작동하며, 결과적으로 데이터 주권은 형식적 보호조차 확보되지 못한 채 외부 행위자의 규범과 기술적 표준에 의해 재구성된다.
본 연구는 제도적 응집도가 TTC의 데이터 주권 도전에 대한 대응 방식과 결과를 결정짓는 핵심 조절변수임을 밝힌다. EU와 아프리카는 서로 다른 제도적 조건 속에서 상이한 대응 경로를 보이지만, 두 지역 모두에서 데이터 주권은 완전한 회복보다는 형태를 달리한 약화 양상을 보인다. 이론적으로 본 연구는 데이터 주권을 다층적 개념으로 재정식화하고, 제도적 응집도를 중심으로 한 비교 분석틀을 제시함으로써 디지털 시대 주권 연구의 범위를 확장한다.

This dissertation presents a comparative analysis of how U.S. and Chinese Transnational Technology Companies (TTCs) challenge data sovereignty in the European Union (EU) and Africa, and how these challenges are mediated by differences in regional institutional capacity. As data has become a strategic resource in the context of accelerated digital transformation, cross-border data flows and the global expansion of technology firms have generated sustained pressures on territorially grounded conceptions of sovereignty.
The study conceptualizes data sovereignty along three analytical dimensions—normative, locational, and cognitive—corresponding to the stages of data generation, storage and transfer, and use and consumption. Integrating the tripartite concept of jurisdiction with the data value chain, the analysis introduces institutional cohesion as a moderating variable to compare the contrasting contexts of the EU and Africa.
Using a qualitative comparative case study approach, the dissertation examines U.S.- and China-based TTCs through legal texts, policy documents, corporate materials, and existing academic and media sources. The findings indicate that in the EU, despite a dense regulatory framework, data sovereignty is largely defended in a formal sense, while substantive control is progressively undermined through technological and institutional circumvention. In Africa, by contrast, regulatory gaps allow private corporate norms and technical standards to substitute for public regulation across the data lifecycle.
The dissertation demonstrates that institutional cohesion plays a decisive role in shaping both responses to TTC challenges and their outcomes. Although the EU and Africa follow different institutional trajectories, data sovereignty in both contexts is characterized less by recovery than by differentiated forms of weakening. The study contributes to digital sovereignty scholarship by reconceptualizing data sovereignty as a multi-layered construct and by advancing a comparative analytical framework centered on institutional cohesion in the digital age.
