As a production factor of the new generation, data is rapidly penetrating various economic and social sectors. With the transformation of human society's mindset, organizational structures, and operational systems, the practical utility of data continues to rise, while the corresponding need for its protection must also be addressed. At present, as the intrinsic value of data gains widespread societal recognition, a series of associated risks have also become prominent. For instance, unauthorized access and acquisition of data, destruction and tampering of data, intentional data leakage, and illegal data transmission occur frequently. Furthermore, issues such as irregular processing methods and inadequate storage practices often arise when data is stored in the cloud or transmitted across borders. Problems like data misuse and data manipulation directly infringe upon the rights of relevant stakeholders. Data is no longer merely a tool but has evolved into the target of infringements and the focus of new types of crimes, with its diverse and complex characteristics amplifying security risks. Against the backdrop of the Fourth Industrial Revolution, the establishment of a legal framework for data security is a critical global governance issue. Among these, criminal law serves as the first line of defense for national security, making the regulation and prevention of data crimes within the criminal law domain of paramount importance.
Current Chinese criminal law primarily focuses on the protection of computer systems when regulating data crimes. Analyzing the types of crimes, data-related offenses can be broadly classified into two categories: traditional crimes that use data as a tool, and new types of crimes that target data itself as the object. This study specifically focuses on the latter, categorized as object-targeted crimes. This classification stems from two main aspects. On the one hand, there is often a temporal gap between the legislative philosophy in the field of data security and the development of the modern data era, failing to fully align with the characteristics of data as a factor and its actual security needs. On the other hand, judicial practice exhibits varying interpretations of the application methods of relevant legal provisions, which directly impacts the effectiveness of law enforcement. An analysis of existing court cases reveals that judicial authorities tend to interpret data crime cases narrowly as computer system-related crimes, and this restrictive interpretation undermines the effectiveness of data protection.
South Korea has ensured the contemporary relevance of its legal system by explicitly extending traditional crimes to the digital domain and enacting specific provisions tailored to the characteristics of digital crimes in its criminal law. Additionally, it has established a multi-layered legal framework to promptly address data crimes, enacting special laws to regulate such offenses. This approach allows for swift adaptation to the continuously evolving nature of data crimes and helps deter new types of offenses. The insights from this legal framework are worthy of study to address the challenges in China's criminal law regulation of data crimes.
For the aforementioned purposes, this research will first examine the theoretical foundations of data crimes in China, followed by a comparative study of the relevant provisions in Chinese and South Korean criminal law. Finally, it will identify the problems in China's criminal law regulation of data crimes and propose improvement measures based on the insights drawn from South Korea's approach to regulating data crimes through criminal law.
