최근 IT기술의 발달로 국가 안보를 위협하는 군사기밀 유출 등의 군사안보범죄가 첨단화되고 있어 기존 수사 방법으로 수사하는 것이 한계에 도달하였다. 특히, 암호화 통신 기술과 안티포렌식 행위가 확산됨에 따라 수사기관이 군사안보범죄와 같은 대형 범죄에서 디지털 증거를 확보하는 것에 많은 어려움을 겪고 있다. 특히, 군사안보범죄는 타국과의 연계성, 계획성, 조직성, 그리고 군 작전 환경의 특수성 등으로 인해 더욱이 기존의 수사 방법만으로는 해결에 어려움을 겪고 있다.
본 연구는 이러한 기존의 수사 방법의 단점을 보완하고, 첨단화되어 가는 국가 안보 위협인 군사안보범죄에 대응하기 위해 '온라인 수색'을 도입하는 방안을 제안한다. 온라인 수색은 피처분자 모르게 다양한 수단을 통해 비밀리에 정보저장매체 등에 접근해 범죄 혐의와 관련된 데이터를 탐색 및 수집하는 수사 방법이다. 이미 미국, 영국, 독일, 프랑스 등 해외 여러 국가들에서는 법제화되어 EncroChat 사건, Sky ECC 사건, ANOM 사건, Patriotische Union 사건 등에서 첨단 IT기술을 활용한 범죄에 대응할 수 있는 유용한 수단이라는 것이 증명되었다.
다만 온라인 수색은 사생활의 비밀 등 헌법상 기본권을 침해할 수 있는 수사 방법이기 때문에 본 연구에서는 권한 남용을 방지하기 위한 강력하고 다층적인 통제 방안을 도입의 전제 조건으로 제시한다.
첫째, 적용 대상을 군형법의 적용을 받는 '군인, 군무원 및 준군인'으로 엄격히 한정한다. 이는 군사안보범죄 발생 시 대상자들이 범죄의 주요 역할을 담당하며, 군 조직의 일원이라는 특성상 국가 안보라는 공익을 위해 기본권이 민간인보다 넓게 제한될 수 있기 때문이다.
둘째, 대상 범죄를 ① 첩보·간첩 및 기밀유출 ② 테러 및 조직적 반국가 범죄 ③ 사이버 군사안보범죄 등 국가 안보에 치명적 위협이 되는 중대범죄로 한정하고, 다른 수사 방법이 없는 경우에만 최후의 수단으로 사용하는 보충성의 원칙을 적용한다.
셋째, 사법부의 사전 통제를 강화하기 위해 '이중허가제'를 도입한다. 인터넷 패킷 감청의 사례처럼 1단계에서 데이터 수집에 대한 포괄적 허가를 받고, 2단계에서 수집된 데이터 중 혐의와 관련된 정보만 선별하여 증거로 사용하기 위한 별도의 허가를 받도록 하는 이중의 사법 심사를 거치게 한다.
넷째, 사후 통제를 위해 국방부가 매년 온라인 수색 집행 현황을 집계하여 국회에 의무적으로 보고하고, 관련 통계를 대외에 공개하여 투명성을 확보하도록 한다.
결론적으로, 암호화 기술 등의 IT기술의 발전이 군사 안보의 중대한 위협이 된 이상, 온라인 수색제도의 도입은 더 이상 미룰 수 없는 과제이다. 본 논문에서 제안한 바와 같이, 적용 대상과 범죄를 엄격히 제한하고 이중허가제 등 강력한 제동 장치를 함께 마련한다면, 국가 안보 수호라는 공익과 국민의 기본권 보장이라는 헌법적 가치를 조화시킬 수 있을 것이다.

With the recent development of IT technology, military security crimes such as military intelligence leakage that threaten national security are becoming more advanced, and investigation with existing investigation methods has reached its limit. In particular, as cryptographic communication technology and anti-forensic behavior spread, it is difficult for investigative agencies to secure digital evidence from large crimes such as military security crimes. In particular, military security crimes are more difficult to solve with existing investigation methods alone due to their connection with other countries, planning, organization, and specificity of the military operation environment.
This study proposes the introduction of an 'equipment interference system' to compensate for the limitations of existing investigation methods and to respond to military security crimes, which are becoming a sophisticated national security threat. Remote online search is an investigative method that secretly accesses information storage media through various means without the knowledge of the suspects (or targets) to search and collect data related to criminal charges. It has already been legislated in several foreign countries, including the United States, the United Kingdom, Germany, and France. Furthermore, it has proven to be an effective tool for combating crimes involving advanced IT technology, as seen in the EncroChat, Sky ECC, ANOM, and Patriotische Union cases.
However, as an equipment interference is an investigative method that can infringe upon fundamental constitutional rights, such as the right to privacy, this study presents strong, multi-layered control measures as a prerequisite for its introduction to prevent the abuse of authority.
First, the application of this system shall be strictly limited to 'soldiers, military civilian employees, and quasi-military personnel' who are subject to the Military Criminal Act. This is because these individuals are the main actors in military security crimes and, as members of the military organization, their fundamental rights may be more broadly restricted than those of civilians for the sake of public interest, namely national security.
Second, the principle of subsidiarity, which is used as a last resort, is applied only when there is no other way to investigate, and the target crimes are limited to serious crimes that pose a fatal threat to national security, such as terrorism and organized anti-state crimes.
Third, a 'double permit system' is introduced to strengthen the judiciary's prior control. As in the case of internet packet eavesdropping, comprehensive permission for data collection is obtained in the first stage, and only information related to the allegation is selected from the data collected in the second stage and separate permission is obtained for use as evidence.
Fourth, for post-action oversight, the Ministry of National Defense must annually compile and report the status of online search operations to the National Assembly and publicly disclose relevant statistics to ensure transparency.
In conclusion, as the advancement of IT, including encryption technology, has become a significant threat to military security, the introduction of an equipment interference system is a task that can no longer be postponed. As proposed in this thesis, by strictly limiting the targets and applicable crimes and simultaneously establishing strong safeguard mechanisms such as the dual-permission system, it will be possible to harmonize the public interest of defending national security with the constitutional value of guaranteeing fundamental rights.
