본 연구는 국가폭력에서 지금까지 국가폭력 가해자를 처벌하지 못한 현실에 주목하여, 국가폭력의 주체를 실효적으로 처벌하기 위한 형사법적 대응모델을 제시하는 것을 목적으로 한다. 국가폭력은 민주적 법치국가에서 국가 또는 공무원이 공권력을 행사하면서 형법상 범죄구성요건에 해당하는 행위를 함으로써 국민의 자유권적 기본권을 침해하고, 그 행위가 국가의 목적 실현·이익 보호와 본질적으로 밀접한 관련이 있거나 국가를 위하여 행해진 경우에 성립한다. 여기서 국민의 자유권적 기본권 침해라는 요건을 통해 국가폭력과 일반 공무원 범죄를 구별할 수 있다. 국가폭력은 형법적 불법인 동시에 국민의 자유권적 기본권을 침해하는 헌법적 불법이라는 점에 그 본질이 있으므로, 국가폭력과 일반 형사범죄는 질적으로 구별된다.
본 연구는 형법과 헌법의 관계를 “형법은 자유제한법, 헌법은 자유보장법”으로 파악하고, 형법의 수범자는 국민인 반면 헌법의 수범자는 국가라는 점을 출발점으로 삼았다. 이에 따라 국민의 기본권을 침해한 국가폭력 주체는 스스로를 보호하기 위해 일반 국민과 동일하게 헌법상 법치국가원칙을 자신에게 적용하도록 요구할 수 없다. 더 나아가 국가와 개인의 관계를 수평적이고 대등한 관계로 재정립할 경우, 개인이 국가에 대해서 국가폭력의 형사책임을 추궁할 수 있는 근거가 된다.
이러한 전제 하에서 국가폭력 사건에서 법치국가원칙 적용의 상대화의 근거를 법철학적·규범론적 차원에서 검토하였다. 법철학적 관점에서 칸트의 인간존중사상, 라드브루흐 공식, 야콥스의 적형법이론은 국가폭력에서 법치국가원칙의 적용을 상대화할 수 있는 논거로 원용될 수 있다. 규범론적 관점에서는 먼저 (1) 국가폭력은 이중적 불법구조를 가지므로, 일반 형사범죄와 다른 차별적 대응이 가능하다는 점, (2) 기본권 보호의무 위반자가 법치국가원칙을 자기보호 논거로 원용할 수 없다는 점, (3) 법치국가적 헌법질서를 교란한 국가폭력 주체에 대해서 법치국가원칙을 그대로 적용하는 자기모순이라는 점을 근거로 할 때 국가에 대해서 법치국가원칙의 상대화가 가능하다. 다음으로 국가폭력 행위자인 공무원에 대해서도 (1) 공무원의 행위와 국가행위는 동일시할 수 있다는 점, (2) 국가폭력에서 공무원은 공권력 행사의 주체일 뿐 기본권 수혜자로서 이중적 지위를 가지지 않는다는 점을 근거로 법치국가원칙을 상대화할 수 있다.
끝으로 국가폭력 주체를 직접적 행위자인 공무원과 국가 내지 국가기관으로 나누어 각각에 대해 형사책임을 물을 수 있는 가능성 및 구체적인 방안에 대해 검토하였다. 국가폭력 행위자인 공무원에 대해서는 공소시효 완성 후 진정소급입법의 허용, 일사부재리원칙의 적용 배제, 피고인에게 불이익한 재심 제도의 도입 허용, 국가폭력 범죄에 대한 사면 제한 입법의 허용 등을 통해 공무원을 처벌할 수 있도록 하는 제도 개선을 제안하였다. 더 나아가 국가폭력 행위자인 공무원의 배후에 있는 국가에 대해서 국가폭력으로 인한 형사책임을 부과할 수 있음을 논증하였다. 다만 현행법 체계상 국가 처벌규정의 부재를 고려하여, 국가형사책임 도입을 위해 개헌 또는 특별입법이 필요함을 전제로 입법 가이드라인을 제시하였다.
결론적으로 국가폭력이 가지는 이중적 불법을 근거로 국가폭력을 형법과 헌법이 교차하는 영역의 범죄로 자리매김하고, 국가폭력 주체에 대해서 법치국가원칙의 적용을 상대화함으로써 처벌할 수 있는 이론을 구체화하였다. 국가폭력 행위자인 공무원 처벌에 장애가 되는 요인들을 제거하고 국가 자체에 대한 형사책임을 도입하기 위한 해석론 및 입법안을 제안함으로써 국가폭력에 대한 실효성 있는 형사법적 대응모델을 제시하였다.

This study addresses the persistent reality that, despite the clarification of facts through retrial (reopening) proceedings and other truth-finding processes, perpetrators of state violence have rarely been held criminally accountable. It aims to propose a criminal-law response model that enables effective punishment of the agents of state violence. State violence is defined as conduct whereby the state or public officials, in exercising public authority within a democratic constitutional state governed by the rule of law, commit acts satisfying the elements of an offense under criminal law, thereby infringing citizens’ liberty rights under the Constitution, and where such conduct is intrinsically linked to the realization of state purposes or the protection of state interests, or is carried out on behalf of the state. The requirement of infringement of citizens’ liberty rights serves to distinguish state violence from ordinary offenses committed by public officials. Because state violence constitutes not only “criminal unlawfulness” under criminal law but also “constitutional unlawfulness” as an infringement of liberty rights, it is qualitatively distinct from ordinary crimes.
This study takes as its point of departure the normative relationship between criminal law and constitutional law, understanding criminal law as law that restricts liberty and constitutional law as law that guarantees liberty. Whereas criminal law is primarily addressed to citizens, constitutional law is addressed to the state. Accordingly, the agents of state violence—having themselves violated citizens’ fundamental rights—cannot demand that the constitutional principle of the rule of law be applied to them in the same manner as it is applied to ordinary citizens in order to shield themselves from criminal accountability. Moreover, reconceiving the relationship between the state and individuals as horizontal and equal provides a normative basis for individuals to hold the state itself criminally responsible for state violence.
On these premises, the study examines the grounds for relativizing the application of the principle of the rule of law in cases of state violence from both legal-philosophical and doctrinal perspectives. From a legal-philosophical viewpoint, Kant’s idea of respect for persons, the Radbruch formula, and Jakobs’s theory of “enemy criminal law” can be invoked as arguments supporting the relativization of the rule-of-law principle in response to state violence. From a doctrinal standpoint, the study argues that the state may be subject to such relativization because: (1) state violence embodies a dual structure of unlawfulness and thus permits differentiated responses from those applicable to ordinary crimes; (2) an entity that has breached its constitutional duty to protect fundamental rights cannot invoke the rule-of-law principle as a self-protective justification; and (3) applying the rule-of-law principle mechanically to a state-violence actor who has disrupted the constitutional order is self-contradictory. The same approach is extended to public officials who directly commit state violence, on the grounds that: (1) officials’ acts may be identified with acts of the state; and (2) in cases of state violence, officials are not beneficiaries of fundamental rights in any “dual” capacity but are solely agents exercising public power, which justifies relativizing the rule-of-law principle with respect to them as well.
Finally, the study distinguishes between (i) public officials as direct perpetrators and (ⅱ) the state or state organs as institutional actors, and explores concrete avenues for imposing criminal responsibility on each. With respect to officials, it proposes institutional reforms to remove obstacles to punishment, including permitting true retroactive legislation after the expiration of statutory limitations in narrowly defined contexts, excluding the application of the ne bis in idem principle, allowing the introduction of retrial procedures adverse to the defendant, and legislating restrictions on amnesties for state-violence crimes. Furthermore, it argues that the state—standing behind public officials—can, in principle, be subjected to criminal responsibility for state violence. Given the absence of positive-law provisions for punishing the state under the current legal framework, however, the study presents legislative guidelines on the premise that constitutional amendment or special legislation is required to introduce state criminal liability.
In conclusion, by grounding its approach in the dual unlawfulness of state violence, this study situates state violence as a category of wrongdoing at the intersection of criminal and constitutional law, and elaborates a theory enabling punishment through the relativization of the rule-of-law principle with respect to state-violence actors. By proposing interpretive arguments and legislative measures to eliminate barriers to punishing public officials and to introduce criminal responsibility of the state itself, the study offers an effective criminal-law response model for state violence.
