인공지능 기술의 급격한 발전과 생성형 인공지능의 대중화로 인해 인간과 인공지능이 협업하며 아이디어를 창출하고, 창작물을 만들어내는 시대가 되었다. 이에 지식재산권과 관련된 문제들도 주목받고 있다. 인공지능과 관련한 지식재산권 문제는 판례나 관련 법·제도가 미비한 상황이라 논쟁의 여지가 많다. 지식재산권 교육을 위해 사회과나 기술·가정과에서 교과별 성취기준을 마련하였지만, 인공지능 관련 지식재산권 교육은 인공지능 기술과 함께 다루어야 하는 주제로, 인공지능의 작동 원리를 다루고 구현하는 정보 교과에서 다루는 것이 적합하다.
본 연구는 고등학교 정보 교과에서 AI 지식재산권 교육 현황을 분석하고 개선 방안을 제시하는 것을 목적으로 한다. 이를 위해 혼합연구방법을 사용하였다. 먼저 인공지능 교육의 현황과 인공지능 윤리기준을 분석하고, 인공지능 윤리교육, 지식재산권 교육의 현황을 살펴보았다. 이후 최근 발생한 AI 관련 지식재산권 쟁점들에 대해 분석하고, 정보 교과에서 활용할 수 있는 AI 지식재산권 교육 사례들을 도출하였다. 이후 고등학교 정보 교과 4과목의 인정 교과서 34종을 분석하여 현행 교육과정에 반영된 지식재산권 내용을 파악하였다. 문헌 연구와 교과서 분석을 바탕으로 AI 지식재산권 교육에 대한 설문조사를 개발하고, 현직 정보 교사 108명에게 학생의 생성형 AI 이용 현황, 교육과정 성취기준에 대한 의견, 지식재산권 교육이 적합한 교과, 교육 내용, 교육 방법, 애로사항 등 다양한 의견을 수집해 교육 개선 방안을 탐색하였다.
본 연구의 결과로는 첫째, 문헌 분석을 통해 저작권, 특허권, 상표권, 영업비밀 4가지의 지식재산권을 교육 대상으로 선정하고 AI 관련 주요 쟁점들을 도출하였다. 둘째, 고등학교 정보 교과의 교과서 34종을 분석해 현행 고등학교 정보 교과에는 주로 저작권, 오픈 소스, 영업비밀 관련 내용이 포함됨을 확인하였다. 셋째, 저작권과 비교해 특허권, 상표권, 영업비밀에 대한 교사 이해도가 낮고, 이를 개선하기 위한 교사 재교육이 필요함을 확인하였다. 넷째, 학생들은 생성형 AI를 과제 및 보고서 작성의 목적으로 주로 사용하며, 생성형 AI 활용 윤리교육에 대한 공감대가 높았다. 다섯째, 교사들은 저작권 영역의 필요성을 다른 영역에 비해 높게 느끼고 있으며, 기존 단원에 AI 지식재산권 내용을 포함하는 것을 선호하며, AI 지식재산권 교육의 주요 장애 요인이 정보 교과 시수 부족임을 파악하였다.
구체적인 개선 방안으로는 지식재산권을 정보 교과의 성취기준에 명시하고 교육의 근거를 마련해야 한다. 정보 교사들이 지식재산권 교육을 위해 선호하는 방법은 사례 기반 토론 수업이다, 이에 교사 전문성 향상을 위한 연수 프로그램을 개발하고, 최신 사례를 바탕으로 구성된 교육 자료를 제공할 필요가 있다.
이 논문의 의의는 고등학교 정보 교과에서 AI 지식재산권 교육의 타당성을 제시하고, 교육과정이나 학교 현장에 도입하기 위해 고려할 내용들을 체계적으로 도출하였다는 점이다. 기존 정보 교과에서 이루어지는 인공지능 윤리교육의 새로운 방향성을 제시하였고, 창작자의 권리가 존중받는 디지털 사회를 만들기 위해 필요한 AI 윤리교육의 토대를 마련할 것으로 기대된다. 다만 본 연구가 실효성을 갖기 위해서는 정보 교과의 적절한 수업 시수 확보를 위한 정책적인 지원이 필요하다.

The rapid progress of Artificial Intelligence (AI) and the widespread use of Generative AI have created an era where humans and AI collaborate to produce ideas and creative works. As a result, questions surrounding Intellectual Property (IP) rights have become a major focus. However, IP issues involving AI remain controversial because there are few legal precedents, and existing laws and systems are often inadequate to handle them. Although achievement standards for IP education exist in subjects like social studies or technology/home economics, AI-related IP education is best addressed alongside the technology itself. Therefore, it is most appropriate to cover this topic in informatics classes, where students learn the operating principles of AI and how to implement it.
The purpose of this study is to analyze the current status of AI-related IP rights education within the high school informatics curriculum and to suggest directions for improvement. To achieve this, a mixed-methods research approach was employed. Initially, the current status of AI education and AI ethics standards was analyzed, and the status of AI ethics education and IP education was examined. In the next phase, recent issues of AI-related IP rights were investigated, and cases of AI-related IP that can be used in informatics subjects were examined. After that, a total of 34 textbooks in four high school informatics subjects were analyzed to identify the contents of IP rights reflected in the current curriculum. Based on literature research and textbook analysis, a questionnaire on AI-related IP education was developed. This tool was used to collect various perspectives from 108 informatics teachers concerning students' use of Generative AI, curriculum achievement standards, and the necessity of IP education to explore effective pathways to improve education.
As a result of this study, first, four IP rights (copyright, patents, trademarks, and trade secrets) were identified as the primary subjects of education through literature analysis and major issues related to AI were derived. Second, an analysis of 34 textbooks confirmed that the high school informatics curriculum mainly includes content related to copyright, open source, and trade secrets. Third, compared to copyright, teachers' understanding of patents, trademarks, and trade secrets was relatively low, indicating a need for teacher training. Fourth, while students mainly used Generative AI for the purpose of writing assignments and reports, teachers reached a high consensus on the necessity of AI ethics education. Fifth, teachers expressed a higher demand for the copyright area compared to other areas, preferred to include the content of AI intellectual property in existing units, and found that the main obstacle to AI intellectual property education was the lack of instructional time to teach informatics.
According to the results, IP rights should be formally integrated into high school informatics standards to establish educational rationale. Educators preferred case-based discussion methods and it is necessary to develop training programs for improving teachers expertise, and provide education materials composed of latest cases.
This study shows that AI-related IP is feasible to teach within high school informatics curriculum. It also suggests practical strategies for strengthening IP education. In addition, it presents a new perspective on AI ethics education in informatics and contribute to the development of a digital society that respects creators' rights. Achieving these goals, however, will require policy support to make sufficient instructional time for informatics teachers.
