    2009년 비트코인의 등장 이후 가상자산 시장은 급격히 성장하여 2024년 기준 국내 주요 거래소의 누적 금액이 1,000조 원을 넘어설 만큼 거대한 시장으로 성장하였다. 그러나 가상자산은 탈중앙성, 비물질성, 익명성, 고변동성, 국경 초월성 등 전통적 자산과는 본질적으로 다른 특성을 보이며 기존의 형사법 체계로는 효과적인 대응이 어려운 유형의 범죄를 양산하고 있다. 특히 가상자산의 비물질성과 같은 특수성으로 물건 중심의 몰수 규정에 적절히 포섭되지 않는다. 이에 가상자산을 재산상 이익으로 해석하여 특별법의 몰수 규정으로 규율하고 있으나 특별법의 대상 범죄에 속하지 않으면 여전히 몰수할 수 없게 된다. 또한 부가형 몰수 방식은 범인이 도주하거나 사망하여 기소하지 못할 때는 자산 환수가 원칙적으로 불가능하며 특히 국제공조가 필요한 상황에서 더욱 두드러진 제약으로 작용하고 있다.

    이러한 문제의식을 바탕으로 가상자산 범죄 피해재산의 실질적 회복 할 수 있는 방안을 제시하고자 하였다. 첫째, 가상자산을 몰수·추징의 대상으로 명확히 포섭할 수 있도록 몰수·추징 규정의 체계 정비 및 정합성 제고(관련 법규의 단일화 등)가 필요하다. 이는 가상자산을 형법 내에서 명확하게 포섭할 수 있는 기반이 될 것이다. 둘째, 유죄판결 없이도 범죄수익을 몰수할 수 있는 독립몰수제도를 검토·도입함으로써 범인의 도망, 사망, 범죄수익만 발견되었을 때 등으로 기소할 수 없는 상황에서도 자산 환수를 가능케 하는 제도적 토대를 마련할 필요가 있다. 셋째, 범죄피해재산 환부에 관한 특례를 ‘가상자산이용자보호법’에 도입하여 형사절차를 통해 확보된 재산이 피해자에게 실질적으로 반환될 수 있도록 할 필요가 있다. 또한 이를 뒷받침하기 위해 가상자산에 대한 지급정지(동결) 규정과 국제공조에 관한 조항 역시 요건·절차·기간·이의제기 등 운용 기준이 명확히 정립되도록 체계적으로 규정함으로써 환수·환부 절차의 실효성을 보완하고자 한다. 마지막으로 거래소와 같은 법인에 대해서도 환수·환부의 실효성을 제고할 수 있도록 협조·내부통제 강화를 유인하는 제도적 장치가 필요하며 그 방안으로 법인을 대상으로 하는 조건부 기소유예 약정(DPA) 등의 도입 가능성을 검토하였다. 이러한 방안들을 통해 피해자에게는 실질적 회복의 기회를 제공할 수 있을 것이다.

    The virtual asset market has grown quickly since the introduction of Bitcoin in 2009. The size of the market was demonstrated by the fact that by 2024, the total transaction volume on South Korea's major domestic exchanges had surpassed 1,000 trillion KRW. However, because virtual assets differ fundamentally from traditional assets in ways like decentralization, intangibility, anonymity, high volatility, and transnational mobility, they have given rise to new types of crime that are challenging to control under the current criminal justice system.
    Since virtual assets don’t have a physical form, it’s hard to apply traditional confiscation laws designed for tangible property. Some special laws do allow virtual assets to be treated as financial gains and confiscated in certain cases, but this only applies to a limited range of offenses. If the crime falls outside that scope, the law doesn’t permit confiscation at all. And because the current system often requires a conviction before confiscation can happen, it becomes impossible to recover assets when the suspect has fled, died, or can’t be prosecuted for some reason. Things get even more complicated when international cooperation is needed, especially with assets that move quickly across borders.
    Furthermore, crimes involving virtual assets frequently happen swiftly and in several jurisdictions. This makes it challenging to use conventional international cooperation mechanisms to quickly track down and freeze illegal proceeds. These systems are incapable of handling the real-time, fragmented nature of virtual asset transactions since they are usually built for people or tangible objects and are reliant on ex post procedures. In order to enable quicker identification, freezing, and securing of digital assets in practice, current international cooperation procedures must be upgraded.
    There must to be a system in place for returning such assets to victims once they have been secured. However, current laws do not offer compensation to victims, and even Act on Special Cases Concerning the Confiscation and Return of Property Acquired Through Corrupt Practices only covers specific violations. Since it is very difficult to prove harm and recover losses through civil proceedings, they are typically not a viable choice for individuals. If victims do not pursue civil claims, criminal proceeds remain unrecovered without appropriate alternatives, leading to an unfair conclusion.
    In light of this, the purpose of this article is to offer workable alternatives for recovering victim assets in virtual asset crimes. In order to specifically include virtual assets, confiscation and forfeiture measures must first be updated and harmonized, perhaps by unifying related legislation. This would give the criminal law system a strong legal basis for integrating virtual assets.
    Second, the implementation of a confiscation system that is not predicated on convictions ought to be taken into account. As long as the assets' illicit origin can still be shown, this would permit asset recovery even in cases when the suspect cannot be charged because of death, flight, or other circumstances.
    Third, Act on the Protection of Virtual Asset Users should probably have something in it about giving victims their assets back.
