서울시 관내에서 무등록 자동차 도장업소 단속 사례를 검토한 결과, 관할 관청에 신고되지 않은 채로 주거지 인근이나 주요 지역 주변에 천막 또는 컨테이너 형태의 옥외 작업장에서 무등록 도장업소가 도장 부스나 방지시설을 갖추지 않은 상태로 운영을 지속하는 가운데 매년 꾸준하게 단속되는 양상을 확인하였다. 이들은 단속된 이후에도 동일한 영업 형태를 유지한 채 지속적으로 운영·작업을 이어 나가고 있는 실태이다. 이러한 배경에는 단속 이후 처리 과정에서「자동차관리법」과 「대기환경보전법」에 근거한 단속·수사·행정처분 체계와 형사처벌법상 포괄일죄와 같이 현실과는 괴리감 있는 제도 운영의 전반적인 실태가 반복 위반을 억제하는 데 있어서 한계점을 드러내고 있다고 판단된다. 이를 바탕으로 본 연구에서는 무등록 자동차 도장업소 단속 이후의 전반적인 처리 과정에서 어떠한 구조적 제약이 존재하는지, 포괄일죄 적용과 행정·형사 절차 분리가 반복 위반에 어떤 영향을 미치는지 현행 법령과 제도를 전반적으로 검토하였다. 본 연구자는 서울시 관내 무등록 자동차 도장업소 단속 자료를 수집해 사건 처리 기간과 검찰 처분 유형을 통계적으로 분석하고, 구청 담당 공무원과 중앙부처 관계자, 무등록 업소 업주를 대상으로 심층 인터뷰를 진행하였다. 그 결과 단속부터 사건 종결까지 상당한 시간이 소요되면서 제재의 효과가 현장에서 즉각적으로 체감되기 어려운 것을 알 수 있었으며, 포괄일죄 적용과 불기소 또는 약식명령 등의 처리 방식이 동일 업소의 반복 위반에도 형사 제재 수위가 뚜렷하게 높아지지 않는 구조를 확인할 수 있었다. 또한 각 기관 간 정보 공유와 후속 조치에 대해 단절 또한 확인되었는데, 이는 서로 다른 기관에서 분리되어 진행된 행정처분과 형사고발이 효율적인 현장 단속을 억제하고 더 나아가 실제 영업 중단으로 이어지지 않는다는 점이 공통적으로 지적되었다. 이러한 결과를 바탕으로, 본 연구는 단속과 사건 처리 절차에 대한 단속 한계와 제도 개선을 위한 실태를 파악하고, 향후 무등록 자동차 도장업소 단속·관리 제도와 정책을 재검토하는 데 참고가 될 기초 자료를 제시한다.

Unregistered automobile paint shops in Seoul have continued to operate near residential areas and major districts without being reported to or registered with the competent local authorities. Many of these shops work in makeshift outdoor facilities such as tents or containers, often without spray booths or air-pollution control equipment, and are repeatedly subject to enforcement actions on a yearly basis. Nevertheless, the same shops frequently resume operations after enforcement. This pattern suggests limits in deterrence under the current institutional framework, in which enforcement, investigation, and administrative measures are implemented under the Automobile Management Act and the Clean Air Conservation Act, while criminal liability is addressed through doctrines such as the comprehensive crime doctrine.
Against this backdrop, this study reviewed the overall post-enforcement process to identify structural constraints and to examine how the application of the comprehensive crime doctrine and the separation between administrative sanctions and criminal procedures affects repeat violations. To this end, enforcement case data on unregistered automobile paint shops in Seoul were collected and analyzed statistically, focusing on case processing time and types of prosecution outcomes. In-depth interviews were also conducted with district office officials, central government personnel, and an unregistered shop owner.
The analysis shows that a substantial amount of time elapses from enforcement to case closure, making the effects of sanctions difficult to perceive immediately in practice. It also confirms that prosecution outcomes such as non-prosecution decisions and summary orders, together with the application of the comprehensive crime doctrine, limit the extent to which criminal sanctions escalate even when the same shop repeatedly violates the law. In addition, interview participants commonly pointed to discontinuities in inter-agency information sharing and follow-up actions, as administrative measures and criminal charges are processed separately by different institutions, which weakens the likelihood that enforcement results in actual cessation of business activities.
Based on these findings, this study presents empirical evidence on limitations in the enforcement and case-handling system and provides foundational data for reviewing policies and institutional arrangements for the enforcement and management of unregistered automobile paint shops.
