몽골과 한국의 영사조력체계 강화방안 연구 = A Study on Strengthening the Consular Assistance System between Mongolia and Korea

This paper, “Study on the Strengthening the Consular Assistance System between Mongolia and Korea” focuses on the institutionalization for the Mongolian-Korean consular assistance systems.

This study was directly prompted by an incident that occurred while the researcher was serving as Consul of Mongolia in Busan, Republic of Korea. In particular, the study was conducted with the aim of establishing a legal basis for consular relations to strengthen the relationship between the two countries.

The idea started from the belief that in order to further strengthen the consular assistance system between Mongolia and Korea, it is necessary to establish consular treaties between Mongolia and Korea, and between Korea and Mongolia. I believe that this could also serve as an opportunity to lay the foundation for the development of relations between the two countries.

This study is composed of six chapters.

Chapter 1 is the introduction, which explains the research background and objectives, as well as the methods and scope.

Chapter 2 is written on the significance and system of consular assistance.
In Section 1, the concept of consular assistance is explained, and in Section 2, the general principles are described. The consular system is an institutional framework that has been utilized between countries based on relations between their citizens throughout a long history, encompassing various cases and historical experiences among nations. The issue of consular assistance has historical origins and traditions based not only on diplomatic relations but also on civil relations.

Chapter 3 examines the current status and development process of Korea's consular assistance legislation through the legislative process for the protection of overseas Koreans, focusing on the 2018 'Overseas Koreans Protection Act.' It also explores the legal system for the protection of overseas Koreans through consular treaties, deriving its characteristics and implications.

Chapter 4 examined Mongolia's legal system for the protection of its nationals abroad. It described Mongolia's overseas national protection legal system starting from the 1929 Consular Regulations, discussed Mongolia's 1990 "Law on Diplomatic Affairs" following democratization, and explained the "Consular Regulations" enacted in 2002.

Chapter 5 conceptualized the development plan for Mongolia's consular assistance legislation. It explained the issues and necessity of strengthening the protection of Mongolians abroad and proposed legislation for the protection of citizens overseas. In this context, a Mongolia-Korea consular agreement was proposed as a measure to enhance cooperation in the consular field between Mongolia and Korea.

Chapter 6 concludes by expressing the hope that strengthening Mongolia's consular support system will contribute to deepening and developing the relationship between Mongolia and Korea for a future where civilian exchanges are expanded.

국문 초록 (Abstract)

이 논문은 “몽골과 한국의 영사조력체계 강화방안 연구”로서 한국에서의 몽골 국민에 대한 영사조력 강화방안을 중심으로 논의하였다.

이 연구는 연구자가 대한민국 부산에서 몽골의 영사로 근무하면서 발생한 사건에 의해 직접 촉발되었다. 특히, 본 연구는 한국과 몽골 양국 간 관계를 강화하기 위해 영사 관계의 법적 근거를 마련하는 것을 목적으로 수행되었다.

이 연구는 몽골과 한국 간의 영사지원 체계를 강화하기 위해서는 몽골과 한국 間 영사조약을 체결할 필요성이 있다는 믿음에서 시작되었으며 이번 연구로 양국 관계 발전의 기반을 마련하는 계기가 될 수 있기를 기대합니다.

본 연구는 모두 6장으로 구성되어 있다.

제1장 (연구 배경)을 설명하는 서론이다.

제2장 (영사 조력의 의의와 체계)에 대해 두절로 나누어 시술되어 있다. 제1절은 영사 조력의 개념을 설명, 제2절은 일반원칙을 기술한다.

영사 제도는 오랜 역사에 걸쳐 국민 間 관계를 바탕으로 활용되어 온 국가 間 제도적 틀이며, 다양한 사례와 역사적 경험을 포괄한다. 영사 조력의 문제는 외교 관계뿐만 아니라 민간 관계를 기반으로 하는 역사적 기원과 전통을 가지고 있으며, 그 목적과 방법, 범위 또한 포함하고 있다.

제3장 (한국의 영사조력 법체계)에서는 한국의 영사조력법제에 대한 현황과 발전과정을 재외국민보호 입법과정을 통해 고찰하고, 2018년 「재외국민보호법」을 중심으로 고찰한다. 그리고 영사조약을 통한 한국의 재외국민 보호를 위한 법제를 고찰하여 그 특징과 시사점을 도출한다.

제4장 (몽골의 재외국민보호 법체계)에서는 해외에 체류 자국민 보호를 위한 몽골의 법률체계를 살펴보았다. 1929년 영사규칙부터 시작된 몽골의 해외 자국민 보호 법률 체계를 설명하고, 민주화 이후 1990년 제정된 몽골의 "외교 업무에 관한 법률"을 논의했으며, 2002년 제정된 "영사규칙"을 설명하였다.

제5장 (몽골의 영사 조력 법제의 발전 방안)을 구상하였다. 이 장에서는 재외 몽골인 보호 강화를 위한 문제점과 필요성을 설명하고, 재외국민 보호를 위한 입법 및 몽골과 한국 間 영사 협력 강화를 위해‘몽골-한국 間 영사협약안’을 제안하였다.

제6장 (결론)은 몽골의 영사 조력체계 강화에 따른 민간교류가 확대되는 미래를 위해 몽골과 한국 間 관계를 심화 발전시키는 데 기여하기를 바란다는 희망을 표현하며 결론을 맺는다.

혼자의 힘으로 결코 완성될 수 없었던 길고 긴 연구를 마무리하며 저에게 도움을 주신 모든 분들께 깊은 감사의 말씀을 드립니다.
