남북한 보험법제의 차이는 오랜 분단과 서로 다른 정치·경제 체제에서 비롯되었다. 남한은 보험을 위험관리와 경제적 회복의 제도로 인식하지만, 북한은 사회주의적 소유의 보호와 국가자금 동원의 수단으로 이해한다. 남북 경협지구인 개성공단에서 북한의 보험규정이 적용되었으나, 독점 보험회사, 과중한 의무보험, 보험목적 검열, 보상 신청 시 손해감정문건 첨부 의무, 우리보다 지연 지급되는 보험금, 우리보다 짧은 보험금 소멸시효, 북한 국가기관에 의한 분쟁 해결 규정 등 불합리한 조항들이 많았다. 결국, 보험 공백 상황 중 개성공단의 폐쇄로 인하여 참여기업들은 커다란 손해를 감수했다. 북한은 1990년 민법을 통해 보험제도를 법제화하고 1995년 보험법을 제정한 뒤 여러 차례 개정을 거쳤다. 특히 2008년 개정에서는 국가보험관리기관을 삭제하고 보험회사만을 보험자로 규정하는 진전을 이루었다. 그러나 2012년 금강산국제관광특구 보험규정을 고찰한 결과, ‘보험자 우위’를 규정하는 여러 조항을 철회하는 보헙법제의 변화는 거의 없었다. 경협지구의 보험법제인 ‘보험규정’은 북한 보험법에 대한 ‘특별법’의 역할이 기대되지만 ‘하위법’ 기능에만 충실하다. 경제특구 활성화를 위해서는 북한 보험법제 중 일부 조항의 긴급 개정이 필요하다. 보험자의 보험목적에 대한 관리 및 검열, 손해감정문건이 첨부된 보험보상청구서 제출, 금전이 아닌 수리·교체·복구 방식의 불완전한 보상 허용, 북한 국가기관에 의한 분쟁 해결 절차 등이 대표적이다. 또한 단기 소멸시효, 행위무능력자 보험 가입 제한, 당국에 의한 재보험 지도 등에 대한 남북 간 논의가 필요하며, 보험용어의 차이, 보험금 지급 기한 문제, 부모·배우자·미성년자녀의 경우 피보험자의 동의 없는 생명보험 가입 문제 역시 상호 인식과 심층적 의견교환이 필요하다. 남북 경협 재개를 위해서는 경제특구 보험규정의 개정이 선행되어야 한다. 체제정합성보다 목적정합성을 추구하는 것이 경제특구 성공의 첩경이다. 북한 당국과 보험업계도 경제특구를 새로운 시장경제를 학습하고 실험하는 기회로 삼아야 한다. 남북한 보험전문가들이 합의하여 합리적 보험규정 초안을 마련한다면, 이는 경제특구 활성화와 향후 남북 보험법제 통합의 초석이 될 것이다.

The differences in insurance law between South and North Korea stem from long division and contrasting political and economic systems. South Korea views insurance as a system for risk management and economic recovery, while North Korea understands it as a means of protecting socialist ownership and mobilizing state funds.
In the Kaesong Industrial Complex, one of the inter‑Korean cooperation zones, North Korean insurance regulations were applied. However, South Korean companies and individuals could not accept provisions such as a monopolistic insurance company, excessive compulsory insurance, inspection of insured property, mandatory submission of damage assessment documents when filing claims, delayed payment of insurance money compared to the South, shorter limitation periods, and dispute resolution procedures controlled by North Korean state agencies. As a result, an insurance vacuum persisted in the cooperation zone, and companies participating in Kaesong suffered significant losses when the complex was shut down. This situation makes it essential to prepare critical alternatives for resuming cooperation in North Korea’s special economic zones.
North Korea codified insurance in its Civil Code in 1990 and enacted the Insurance Law in 1995, revising it several times thereafter. The 2008 amendment marked progress by abolishing the “state insurance management agency” and defining only insurance companies as insurers. Yet, the 2012 Mount Kumgang insurance regulation made almost no progress in removing insurer‑favored clauses. The insurance regulations of cooperation zones were expected to function as special laws of North Korea’s Insurance Law, but in practice they remained subordinate regulations.
For the revitalization of special economic zones, urgent revisions are needed in certain provisions of North Korean insurance law. Key examples include insurer supervision of insured property, mandatory attachment of damage assessment documents to claims, incomplete compensation through repair or replacement instead of monetary payment, and dispute resolution procedures controlled by state agencies. In addition, short limitation periods, restrictions on insurance contracts by legally incompetent persons, and state‑directed reinsurance guidance require inter‑Korean discussion. Differences in terminology, deadlines for claim payments, and life insurance contracts for family members without the insured’s consent also demand mutual understanding and deeper dialogue.
To resume inter‑Korean cooperation, revision of the insurance regulations applied in special economic zones must come first. Emphasizing purpose‑based alignment rather than systemic conformity is the key to success. North Korean authorities and the insurance industry should treat special economic zones as opportunities to learn and experiment with market economy practices. If insurance experts from both Koreas can agree on a rational draft regulation, it will not only activate special economic zones but also lay the foundation for eventual integration of the two Koreas’ insurance law systems.
