본 논문은 1697년 형조 결송입안을 연구대상으로 삼아 고문서학적으로 분석한 연구이다. 1697년 형조 결송입안이 새롭게 발견됨에 따라 자료의 발견으로부터 문서에 수록된 내용 분석 및 고문서학적 특징을 다뤘다.
형조에서 발급된 결송입안은 현재까지 1697년 형조 결송입안, 1741년 형조 결송입안 2건만 알려져 있다. 결송입안의 전존현황과 연구동향을 보면 중앙관청에서 발급한 결송입안이 지방관청에서 발급한 결송입안보다 현존수량이 상대적으로 적다. 형조에서 발급된 결송입안 또한 현존수량이 적은 탓에 아직까지 연구가 상대적으로 이루어지지 못했다. 1697년 형조 결송입안은 始面에 유일하게 ‘刑曹立案’이라 기재되고, 결락된 부분이 없는 온전한 상태로 전해졌기 때문에 형조에서 담당한 토지쟁송의 일면과 고문서학적 특징을 파악하기에 좋은 조건을 갖추고 있다.
1697년 형조 결송입안에 수록된 내용을 바탕으로 토지쟁송의 전말을 세 부분으로 나눠 살폈다. 소송의 배경과 발단은 金箴 奴 金伊乭의 정소부터 咸頊의 소송 시작 취지의 정소까지, 소송의 전개과정은 시송다짐부터 결송다짐까지, 형조의 결송은 함욱의 金孝善 斜給立案 위조 취지의 정소부터 형조의 최종판결까지로 구성했다. 원고와 피고는 시송다짐을 하여 형조에서 자신의 계쟁물 소유를 주장했고, 결송다짐 이후 함욱은 김효선의 한성부 사급입안이 위조되었다는 취지로 형조에 정소하고, 형조는 한성부에 行移하여 김효선의 사급입안 엽질 자료를 취하고 위조 여부를 밝혀내어 계쟁물을 함욱에게 결급하는 것으로 6개월간의 쟁송을 끝냈다.
1697년 형조 결송입안은 소송 관련 문서인 소지, 초사, 판결문, 관문서 등을 연이어 필사했기 때문에 형태적인 특징을 본다면 등출 연서형이라고 칭할 수 있다. 다른 등출 연서형 결송입안과 비교하면 형태가 유사하다.
소송 관련문서들은 등서과정에서 문장의 앞과 뒤를 구분하기 위해 連次와 是齊를 표시했고, 그 사이에 문서의 내용을 그대로 등서하였다. 수록된 문서에 표기된 着押과 踏印 등의 중요 문서 기재 요소들은 ‘堂上着押踏印’, ‘堂上郎廳着押踏印’, ‘着手寸’, ‘着名’ 등과 같이 눈에 보이는 형태를 문장으로 묘사해 놓았다. 수록된 문서 가운데 청송식에 따른 문서가 보인다. 중앙관청에서 발급한 다른 결송입안과 비교하면 문서기재방식이 비슷했다.
결송입안에 수록된 용어로 ‘決立案’이 보인다. 결입안은 1697년 형조 결송입안에서 결송입안과 같은 개념으로 쓰였고, 이와 같이 결송입안 가운데 시면에 ‘결입안’이 기재된 결송입안도 포함되어 있다.

This study is a diplomatics analysis of the judgment document(Gyeolsong Iban) issued by the Ministry of Punishments (Hyeongjo) in 1697. Following the recent discovery of the 1697 Hyeongjo Gyeolsong Iban, this study examines the circumstances of the document’s discovery, analyzes its recorded contents, and identifies its diplomatic characteristics.
Only two cases of Gyeolsong Iban issued by the Ministry of Punishments are known to date: the 1697 document and the 1741 document. An examination of the current status and research trends of Gyeolsong Iban shows that documents issued by central government offices survive in smaller numbers than those issued by local offices. Due to the limited number of surviving Gyeolsong Iban issued by the Ministry of Punishments, scholarly research on these materials has remained relatively limited. The 1697 Hyeongjo Gyeolsong Iban is particulary valuable in that it uniquely bears the inscription “刑曹立案 (Hyeongjo Iban)” on its opening page (simyeon, 始面) and survives in complete condition without textual loss. As such, it provides favorable conditions for examining both the land dispute handled by the Ministry of Punishments and the document’s diplomatic features.
Based on the contents recorded in the 1697 Hyeongjo Gyeolsong Iban, the course of the land dispute is analyzed in three stages. The background and initiation of the lawsuit range from the petition submitted by Kim I-dol (金伊乭), the slave of Kim Chim (金箴), to the petition submitted by Ham Uk (咸頊) stating the grounds for initiating litigation. The progression of the lawsuit extends from the initial litigation pledge (sisong dajim) to the final litigation pledge (gyeolsong dajim). The Ministry of Punishments’ adjudication covers the period from Ham Uk’s petition alleging forgery of Kim Hyoseon’s Sagyeop Iban (a land grant register issued by the Hanseong Magistracy) to the Ministry’s final judgment. Both plaintiff and defendant submitted sisong dajim (a sworn affidavit submitted at the beginning of a lawsuit) to assert ownership of the disputed property before the Ministry of Punishments. After gyeolsong dajim (a final sworn statement submitted at the judgement stage), Ham Uk petitioned the Ministry, alleging that Kim Hyoseon’s Sagyeop Iban issued by the Hanseong Magistracy was forged. In response, the Ministry issued an official inquiry (haeng’i, 行移) to the Hanseong Magistracy, obtained the appended documentary materials (yeopjak, 葉作) materials related to the Sangyeop Iban, verified the forgery, and ultimately awarded the disputed property to Ham Uk, thereby concluding the six-month litigation.
From a formal perspective, the 1697 Hyeongjo Gyeolsong Iban may be classified as a deungchul yeonseohyeong (registered sequential transcription type), as it consecutively transcribes litigation-related documents such as petitions, preliminary examinations, verdicts, and official correspondence. Its overall format closely resembles that of other deungchul yeonseohyeong Gyeolsong Iban.
In the process of transcription, the litigation-related documents employ markers such as yeoncha (連次) and sije (是齊)—symbols used to separate sentences during copying—to distinguish the beginning and end of sentences, with the original text faithfully transcribed between these markers. Key documentary elements, including signatures (chackap, 着押) and seals (dapin, 踏印), are described textually in visible form using expressions such as “Signed and stamped by a high-ranking official of the Ministry of Punishment (Dang-sang chackap dapin, 堂上着押踏印),” “Signed and stamped by both senior and working-level officials (Dang-sang nangcheong chackap dapin, 堂上郎廳着押踏印),” “Stamped with handprint (Chacksu-chon, 着手寸),” and “Name directly written (Chackmyeong, (着名).” Among the transcribed documents, examples conforming to the Cheongsong format—the official format used when drafting litigation documents—can be identified. When compared with other Gyeolsong Iban issued by central government offices, the methods of documentary notation are largely consistent.
The term “Gyeol Iblan (決立案)” appears within the Gyeolsong Iban. In the 1697 Hyeongjo Gyeolsong Iban, Gyeol Iban is used interchangeably with Gyeolsong Iban, and some Gyeolsong Iban likewise record the term “Gyeol Iban” on the opening page.
