As such, the mainstream view—recognizing the seller’s conduct as embezzlement—could not be sustained under the statutory elements of the offense, and the Supreme Court of Korea and related case law have treated double sales as breach of trust. Based on the betrayal theory, the failure to fulfill obligations in transactional relationships can be punished as breach of trust, and thus Article 355(2) of the Criminal Act must be interpreted strictly.
