This study focuses on the state liability for compensation of public entities other than local governments (hereinafter referred to as “public entities”). Article 29, Paragraph 1 of the Constitution of the Republic of Korea stipulates that “citizens who suffer damage from unlawful acts in the course of official duties by public officials may claim just compensation from the State or public entities as prescribed by law.” This provision is a long-established clause existing since the enactment of the Constitution, guaranteeing the right to claim state compensation not only against the State but also against public entities as a fundamental right of the people. Despite this constitutional origin, state liability of public entities is not currently recognized. This is because the so-called “New State Compensation Act” enacted in 1967 limits the scope of application to the State and Local Governments, thereby allowing state compensation claims only against the State and Local Governments. Public entities bear liability for damages caused by unlawful acts only under tort law regardless of whether the unlawful acts are related to public administrative functions or private economic activities.
The fundamental perspective of this study is that the liability of public entities should be subsumed under the realm of state liability and thus the State Compensation Act should be applied accordingly. Although the notion that public entities should be subjects of state compensation is accepted without objection, there are few prior studies on this issue. This is partly because litigation practice over the past fifty years has been fixed on disallowing state compensation claims against public entities, resulting in a lack of sufficient recognition of the practical necessity to subsume public entities’ liability under the realm of state liability.
Therefore, this study focuses on clarifying the nature of public entities and arguing the necessity and benefits of including their liability within the scope of state compensation. In addition, it analyzes the problems in the current stance taken by the Supreme Court regarding the liability of public entities, and assuming that the State Compensation Act applies to public entities, aims to propose solutions to the issues related to state liability of public entities. Methodologically, it mainly examines domestic discussions on public entities and state liability and introduces foreign discussions as needed.
First, this study reviews the concept of public entities, as clarifying their nature is essential to explain the ground for subsuming their liability under the realm of state liability. Although public entities have been stipulated as subjects of state compensation since Article 27 of the original Constitution and have been widely used in various laws, there is little active discussion on their concept today. After reviewing previous discussions on the concept of public entities, this study concludes that they hold the status of administrative subjects within the scope of the purposes and duties prescribed by the founding laws as corporations established by the State to fulfill certain purposes.
Next, this study explores the essence of state liability for compensation and discusses the necessity and benefits of subsuming public entities’ liability under the realm of state liability. By historically examining the enactment process of the New State Compensation Act, it concludes that there is no reasonable justification for excluding public entities from its scope of application. The study then reviews discussions on the nature of the State Compensation Act and state liability, clarifies the essence of state liability as public law self-responsibility, and argues that in light of the nature of state liability, there is sufficient justification and benefit to include public entities’ liability within the scope of state compensation.
Furthermore, this study reviews and analyzes the position taken by the Korean Supreme Court concerning the liability of public entities. Specifically, it examines five Supreme Court cases where the liability of public entities was at issue and confirms that the Supreme Court has not recognized the state liability of public entities, while selectively applying the State Compensation Act. Due to the Supreme Court’s stance as reflected in the above-mentioned cases, a consistent and coherent legal doctrine regarding the liability of public entities has not been established, resulting in conflicting rulings among some lower courts.
Finally, this study discusses concrete measures for applying the State Compensation Act to public organizations in the future. Assuming that the State Compensation Act is applicable to public entities in the future, this study examines related issues concerning state liability of public entities and proposes its own solutions. Namely, it reorganizes key conceptual elements of state liability such as liable subjects, unlawful acts in the course of duty, and public officials in relation to public entities’ state liabilities, and redefines the relationship between public entities and the State concerning the status of public entities as public officials, attribution of acts to the State, and sharing of compensation responsibility between public entities and the State.
Although state compensation litigation, alongside administrative litigation, constitutes an important pillar of administrative remedies, it remains one of the slowest areas for legislative change. Nonetheless, remarkable progress has recently been achieved through relentless efforts by academia and practitioners. This study hopes to contribute, even slightly, to the activation of discussion on the state liability of public entities.

본 논문은 지방자치단체 아닌 공공단체(이하 ‘공공단체’)의 국가배상책임을 연구대상으로 한다. 대한민국 헌법 제29조 제1항은 “공무원의 직무상 불법행위로 손해를 받은 국민은 법률이 정하는 바에 의하여 국가 또는 공공단체에 정당한 배상을 청구할 수 있다”고 규정하고 있다. 위 규정은 헌법 제정 당시부터 존재하였던 유서 깊은 규정으로서 우리 헌법은 국가뿐만 아니라 공공단체를 상대로 국가배상을 청구할 수 있도록 하고 이를 국민의 기본권으로 보장하여 왔다. 이러한 헌법적 연원에도 불구하고 오늘날 공공단체의 국가배상책임은 인정되지 않고 있다. 1967년 제정된 이른바 ‘신 국가배상법’이 동법의 적용대상을 국가, 지방자치단체로 한정함에 따라 국가배상청구는 오로지 국가, 지방자치단체를 상대로만 허용되고 있기 때문이다. 공공단체는 그 직무상 위법행위가 공행정수행과 관련된 것이든 사경제활동과 관련된 것이든 오로지 민법상 불법행위로 인한 손해배상책임만을 부담하고 있다.
본 논문의 기본적인 시각은 공공단체의 배상책임을 국가배상의 영역으로 포섭하고 이에 국가배상법을 적용하여야 한다는 것이다. 공공단체도 국가배상주체가 되어야 한다는 점 자체는 이견 없이 받아들여지고 있음에도 이 부분에 관한 선행연구는 많지 않다. 그 원인에는 여러가지가 있겠지만 지난 50년간 공공단체를 상대로 국가배상청구를 허용하지 않는 소송실무가 고착화되어 있는 상황에서 공공단체의 배상책임을 국가배상법의 영역으로 포섭하여야 할 현실적인 필요성이 충분히 인지되지 못하였기 때문이라고 생각한다.
이에 본 논문은 공공단체의 실체를 규명하고, 이들의 배상책임을 국가배상의 영역에 포섭하여야 하는 당위와 실익을 논증하는데 주력하였다. 또한 공공단체의 배상책임과 관련하여 현재 대법원 판례가 취하고 있는 입장의 문제점을 분석하고, 공공단체에 국가배상법이 적용되는 것을 전제로 공공단체의 국가배상책임과 관련된 쟁점들에 대하여 나름의 해결책을 제시하는 것을 목표로 삼았다. 방법론적으로는 공공단체와 국가배상책임과 관련된 국내의 논의를 중심으로 살펴보면서 필요한 범위 내에서 외국에서의 논의를 소개하였다.
먼저 본 논문은 공공단체 개념을 검토하였다. 공공단체의 실체가 규명되어야 그 배상책임을 국가배상의 영역으로 포섭하는 이유가 설명될 수 있기 때문이다. 공공단체는 제헌헌법 제27조에 국가배상주체로 규정된 이래 각종 법률에서 폭넓게 사용되고 있음에도 오늘날 그 개념에 관한 논의가 활발하지 않다. 공공단체 개념에 관한 종래의 논의를 살펴보고, 이를 기초로 국가가 특별법을 제정하여 존립목적을 부여한 법인으로 그 설립의 근거 법률에 규정된 목적 및 사무와 관련된 범위 내에서 행정주체의 지위에 있다는 결론을 내렸다.
다음으로 본 논문은 국가배상책임의 본질을 탐구하고, 이를 공공단체의 배상책임을 국가배상의 영역으로 포섭하여야 하는 당위 및 실익과 결부시켜 논의하였다. 신 국가배상법 제정 과정을 연혁적으로 고찰하여 동법이 그 적용대상에서 공공단체를 제외한데 납득할만한 이유가 없다는 결론을 내렸다. 이어 국가배상법의 성격, 국가배상책임의 성질에 관한 논의를 살펴보고 국가배상책임의 본질을 공법적 자기책임으로 규명한 다음, 국가배상책임의 본질에 비추어 볼 때 공공단체의 배상책임을 국가배상의 영역으로 포섭하여야 할 충분한 당위와 실익이 있다는 점을 논증하였다.
나아가 본 논문은 공공단체의 배상책임과 관련하여 대법원 판례가 취하고 있는 태도를 살펴보고 문제점을 분석하였다. 구체적으로 공공단체의 배상책임이 쟁점이 된 5개의 대법원 판결을 살펴보고, 대법원이 배상주체인 공공단체의 국가배상책임은 인정하지 않으면서 국가배상법을 선별적으로 적용하는 접근방식을 취하고 있음을 확인하였다. 위와 같은 대법원 판례의 태도로 인하여 공공단체의 배상책임과 관련하여 일관성 있고 체계적인 법리가 형성되지 못하였고, 그 결과 일부 하급심 판결들간에 충돌이 발생하고 있음을 확인하였다.
마지막으로 본 논문은 향후 공공단체의 국가배상책임과 관련하여 구체적인 해석론을 제시하였다. 공공단체에 국가배상법이 적용되는 것을 전제로 공공단체의 국가배상책임과 관련된 쟁점들을 살펴보고 이들에 대하여 나름의 해결책을 제시하였다. 이 과정에서 공공단체의 국가배상책임과 관련하여 국가배상책임의 주요 개념요소인 국가배상주체, 직무상 위법행위, 공무원 개념을 재검토하고, 공공단체의 공무원 지위, 공공단체의 행위의 국가귀속, 공공단체와 국가간 배상책임 분담 등에 있어 공공단체와 국가의 배상책임 관계를 재정립하였다.
국가배상소송은 항고소송과 더불어 행정구제의 중요한 한 축을 담당하고 있는 영역임에도 입법 변화가 제일 더딘 분야 중 하나이다. 그럼에도 불구하고 학계와 실무의 부단한 노력을 통해 최근 괄목할만한 발전을 이루고 있다. 본 논문이 공공단체의 국가배상책임에 관한 논의가 활성화되는데 조금이나마 보탬이 될 수 있기를 기대한다.
