    근로자의 사직 의사표시에 의하여 해지통고 내지 합의해지 형식으로 근로관계가 종료되었으나 근로관계가 해고에 의해 종료되었다고 다투어지는 경우 대법원은 “사용자가 사직의 의사 없는 근로자로 하여금 어쩔 수 없이 사직서를 작성·제출하게 한 후 이를 수리하는 이른바 의원면직 형식을 취하여 근로계약관계를 종료시키는 경우에는 실질적으로 사용자의 일방적인 의사에 의하여 근로계약관계를 종료시키는 것이어서 해고에 해당한다.”는 법리(‘실질적 해고 법리’라 한다)를 적용하여 실질적 해고 여부를 판단하고 있다. 그러나 위 법리를 적용하면서도 구체적인 판단에 있어서는 사직 의사표시가 민법 제107조의 진의 아닌 의사표시에 해당하여 무효로 되는 경우에 실질적 해고를 인정하는 방법(본 연구에서는 ‘사직무효 필요설’이라 한다)과 사직 의사표시의 민법상 효력에 관한 검토 없이 사직서 제출 경위 등 사실관계에 의하여 곧바로 실질적 해고 여부를 판단하는 방법(본 연구에서는 ‘사직무효 불요설’이라 한다)으로 판단방법이 나뉘어 있다.
    본 연구에서는 먼저 사용자의 강요 등 개입에 의한 사직서 제출 사안에서 실질적 해고 판단이 필요한 이유와 그 목적을 강행규정인 근로기준법상 해고 규제 규정의 규범목적을 통해 찾고, 민법상 의사표시의 무효 또는 취소 사유에 의해서는 실질적 해고 법리를 통한 규제에 있어서 흠결이 발생할 수밖에 없다는 점을 논증하였다(제2장).
    이어서 실질적 해고 법리를 적용한 41건의 대법원 판결을 사실관계와 주요 판단부분 위주로 살펴보면서 두 가지 판단방법의 상관관계와 각 판단방법의 타당성을 검토하였으며, 판례에 나타난 사례를 유형화하여 그 유형별로 실질적 해고 판단의 고려요소가 무엇인지 정리하는 한편, 실질적 해고의 판단기준으로서 자기결정권이 실질적으로 보장되었는지가 고려되어야 함을 논증하였다(제3장).

    In cases where an employment relationship is terminated through a resignation notice or mutual agreement based on a employee’s expressed intention to resign, but the nature of the termination is contested as a dismissal, the Supreme Court of Korea applies the so-called “substantive dismissal doctrine.” According to this doctrine, if an employer induces a employee—who has no genuine intention to resign—to submit a letter of resignation and subsequently accepts it in the form of voluntary resignation, the employment relationship is effectively terminated by the employer’s unilateral decision, constituting a dismissal in substance.
    However, even when applying this doctrine, the Supreme Court’s specific approaches diverge. One approach—referred to in this study as the "invalid resignation requirement theory"—recognizes substantive dismissal only when the resignation is deemed invalid under Article 107 of the Civil Act (i.e., expressions of intent not reflecting true intention). The other approach—termed the "no invalid resignation requirement theory"—determines substantive dismissal solely based on the factual circumstances surrounding the submission of the resignation, without assessing its legal validity under civil law.
    This study first examines the reasons and objectives for applying the substantive dismissal doctrine in cases involving forced or employer-influenced resignations, grounding the need in the mandatory nature and normative purposes of dismissal regulations under the Labor Standards Act. It argues that relying solely on the invalidity or revocability of intent under civil law is insufficient for effectively regulating dismissals under this doctrine (Chapter 2).
    Subsequently, this study analyzes 41 Supreme Court decisions where the substantive dismissal doctrine was applied, focusing on factual backgrounds and key reasoning. It explores the correlation between the two approaches and evaluates their respective validity. Through categorizing the cases, it identifies the key factors considered in determining substantive dismissal and argues that the protection of the employee’s right to self-determination should be a central criterion (Chapter 3).
    Moreover, acknowledging that not all instances of resignation necessitate a determination of constructive dismissal, this study examines the specific circumstances under which the legal doctrine of constructive dismissal ought to be applied to cases where the employment relationship has formally ended by resignation. It further seeks to establish the substantive requirements for such application by identifying forms of employer intervention that may warrant a finding of constructive dismissal, and analyzes the corresponding legal criteria for each category of such intervention (Chapter 4).
    In conclusion, regardless of which approach is adopted, the core criterion for determining substantive dismissal should be whether the employee's right to self-determination and freedom of decision-making were meaningfully guaranteed. The study also emphasizes that, considering the nature of labor relations and the normative goals of dismissal regulation, the discussion of substantive dismissal should extend beyond formal dismissals to include other types of employment termination (Chapter 5).
