헌법 제109조의 재판공개의 원칙에 따라, 판결문은 민·형사소송법상의 규정(민사소송법 제162조의3, 형사소송법 제59조의3)에 근거하여 열람 및 복사가 가능하다. 그러나 법원은 개인정보 보호를 위해, 관련 소송법 조항과 『개인정보보호법』, 『민사판결서 열람 및 복사에 관한 규칙』, 『형사판결서 등의 열람 및 복사에 관한 규칙』, 그리고 『판결서 등의 열람 및 복사를 위한 비실명 처리기준(재판예규)』에 따라 판결문에 포함된 개인정보 및 간접식별정보를 비식별화하여 공개할 의무가 있다. 이는 판결의 투명성과 사법 접근성을 제고하는 한편, 정보주체의 프라이버시를 보호하기 위한 제도적 장치라 할 수 있다.
하지만 현행 비식별화 기준은 개인식별정보에 대한 정의와 항목 구분이 명확하지 않아 실무상 처리의 일관성이 떨어지며, 기술적 자동화에도 한계가 존재한다. 본 논문에서는 한국어 판결문을 대상으로 비식별 처리 기준의 체계화를 목적으로, 실제 판결문을 모사한 비식별화 데이터셋을 구축하고, 법률 도메인에 특화된 개인식별정보 분류 체계를 정립하였다. 이를 통해 향후 판결문 자동 비식별화 시스템 개발에 활용 가능한 기준점을 제시하고, 공공 사법정보의 안전한 활용을 위한 기반을 마련하고자 하였다.

According to Article 109 of the Constitution of the Republic of Korea, the principle of open trials ensures that court rulings can be accessed and copied under the provisions of the Civil Procedure Act (Article 162-3) and the Criminal Procedure Act (Article 59-3). However, to protect personal information, courts are obligated to de-identify personally identifiable information (PII) in judgments before disclosure. This obligation is grounded in relevant procedural laws, the Personal Information Protection Act, the Rules on the Inspection and Copying of Civil and Criminal Judgments, and the Judicial Rule on De-identification Standards for Court Judgments. This system aims to enhance transparency and access to justice while safeguarding the privacy of individuals involved.
Nevertheless, the current de-identification standards lack clear definitions and categorizations of personal information, resulting in inconsistencies in practice and limitations in automation. This study aims to establish a structured framework for de-identification criteria specific to Korean court rulings. We construct a de-identified dataset for de-identification of court judgments and develop a three-tiered PII categorization. By doing so, we present a practical foundation for the future development of automated de-identification systems and contribute to the secure and responsible use of public judicial information.
