營業 秘密의 保護에 관한 硏究 : Know how의 侵害에 대한 中止請求를 中心으로

The focus of the study is fitted to the injunction against the invasion of the know how in the trade sesrets.
The trade secrets have deep influence upon whether the enterprises succeed or fail in the competition among others.
So the opposits try to steal out the know-how developed through the long period of the study which needs greats sum of money by buying off employees or making use of industrial spy.
From this point of view, it is more urgent for the enterprises to protect their trade secrets as the technical renovation has become more rapid and the investment in R & D (Research and Development) increased vastly since the second world war. Certainly, the trade secrets can be protected by the patent law and the criminal law, etc. But these alone can not perform the role successfully because the trade secrets are very complex in their characters.
The protection of the trade secrets can be studied in all aspects, but the focus of the theme is fitted to whether the injunction can be adimitted in the protection of the trade secrets.
Some admits the injunction taking the trade secrets as absolute right, but this opinion is likely to pursue formal logic. It is more persuassive to admit the injunction on the basis of "Treu und Glouben In latter case the interests of the parties concerned should be properly calculated.
At any rate, admitting the protection of the trade secrts is very important because we have no articles unlike Swiss and Deutschland in the unfair competition prevention law, taking the legislative measure concerning the protection of the know-how in the law is very urgent.
