지적행정에서 국민의 권리구제 방안 연구 = A study on people's rights remedies in cadastral administration

Cadastral administration in accordance with the 「Spatial Data Management Act」 must have public confidence that all citizens can trust in terms of registering and managing property rights, the basic rights of citizens, in the cadastral records business processing is required.
Cadastral survey for cadastral administration and public officials' errors in surveying performance tests, interpretation of extensions and reductions in laws and regulations, handling of different tasks for the same task, etc. as a remedy for the inconvenience and dissatisfaction of the people The committee handles civil complaints, administrative appeals, administrative litigation, and constitutional complaints.
However, the rights remedies system operated in accordance with individual laws and regulations have different processing targets and procedures, and there are cases where the processing results are also different, causing confusion not only to the public but also to public officials who have to apply the processing results to their work.
The direction of this study is to prevent disputes related to cadastral administration and protect people's property rights by examining the current status, problems, and operation of the people's rights relief system in cadastral administration, such as land movement and cadastral survey, and suggesting improvement plans.
After setting the research direction, the theoretical contents of the theoretical background of cadastral administration and rights relief system were summarized through literature review, and the analysis framework and method of this study were sought through previous research and analysis. The tasks to be improved are identified by analyzing the data provided by request from the agency operating the rights remedies (the result of the cadastral survey suitability examination, the result of the civil complaint) and the data registered on the website(the decision of the Administrative Appeals Committee, the decision of the Constitutional Court) derived.
As a result of the research analysis, it was found that the subject and scope of treatment differ depending on the law and nature of the law based on the remedy system, and the interpretation of the law is different, so the treatment result may be different.
The measures to improve these problems and expand the people's rights remedies are as follows.
First, the cadastral survey suitability review system by the Cadastral Committee needs to resolve the controversy over disposition and civil litigation due to the revision of the 「Spatial Data Management Act」, and it is necessary to secure expertise through the formation of a dedicated survey team.
Second, the Anti-Corruption and Civil Rights Commission must secure the ability to implement the committee's resolutions so that the agency is bound by the recommendations and resolutions, and through the reform of the system, it is necessary to enhance its expertise, such as expanding the manpower dedicated to performing cadastral surveying tasks.
Third, Administrative Appeals Committee Administrative adjudication needs to share work processing methods and results for each city and province and to communicate organically to ensure accuracy and consistency.
Fourth, it is necessary to expand the disposition of litigation in courts and constitutional courts in the overall cadastral administration to maintain consistency in court judgments, etc., and to expand people's rights remedies.
Lastly, it is necessary to improve the people-friendly system so that the public can be accurately informed about the role of individual rights remedies, the subjects they are dealing with, claim requirements, and solutions for dissatisfaction with the results of treatment, and so on.
Through this study, it was possible to confirm the implication that the laws, systems, and operating systems need to be improved in order to minimize confusion and expand rights remedies when the people's rights relief system dealing with cadastral administration performs its original role.
Previous studies dealt with the rights remedies related to cadastral administration in a fragmentary way, so that they can compare the nature of remedies, objects, procedures, and results of remedies, or suggest broad and clear legal and institutional improvements to expand people's rights remedies. there was no However, in this study, it will be meaningful as a study that enhances the understanding of the rights relief system in general by examining the intellectual administration-related rights remedies system broadly and deriving improvement plans.

국문 초록 (Abstract)

「공간정보관리법」에 따른 지적행정은 국민의 기본권인 재산권을 지적공부에 등록하여 관리한다는 측면에서 모든 국민이 신뢰할 수 있는 공신력을 가져야 하며, 이러한 국민의 재산권을 다루는 공무원은 정확한 법령의 해석과 절차에 따른 업무처리가 요구된다.
지적행정에 대한 측량수행자의 지적측량과 공무원의 측량성과검사 오류, 법령의 확대 및 축소 해석, 동일 업무에 대한 상이한 업무처리 등 국민의 불편과 불만 등에 대한 권리구제 제도로 지적측량 적부심사, 국민권익위원회 민원처리, 행정심판, 행정소송, 헌법소원심판 등이 운영되고 있다.
그러나 개별 법령에 따라 운영되고 있는 권리구제 제도는 처리대상과 절차가 서로 상이하고 처리결과 또한 다르게 나타나는 사례가 발생하여 국민은 물론 처리결과를 업무에 적용해야 하는 공무원에게 혼란을 주고 있다.
본 연구의 방향은 토지이동, 지적측량 등 지적행정에서 국민의 권리구제 제도의 현황 및 문제점, 운영현황 등을 살펴보고 개선방안을 제시하여 지적행정과 관련된 분쟁을 방지하고 국민의 재산권을 보호하는 데 있다.
연구 방향의 설정 후, 지적행정과 권리구제 제도의 이론적 배경에 대하여 문헌고찰을 통해 이론적 내용을 정리하였으며, 선행연구 조사와 분석을 통해 본 연구의 분석틀과 방안을 모색하였다. 권리구제 제도를 운영하는 기관에 요청하여 제공받은 자료(지적측량 적부심사 처리결과, 민원처리 결과)와 홈페이지에 등재된 자료(행정심판위원회 재결, 헌법재판소 결정) 등을 분석함으로써 개선해야 할 과제를 도출하였다.
연구 분석결과, 권리구제 제도의 근거법령 및 성격에 따라 처리대상과 범위가 다르고, 법령에 대한 해석이 서로 상이하여 처리결과가 다를 수 있는 것으로 나타났다. 이러한 문제점 개선과 국민의 권리구제 확대를 위한 방안은 다음과 같다. 첫째, 지적위원회 지적측량 적부심사 제도는 「공간정보관리법」 개정으로 처분성 논란과 민사소송 등을 활용해야 하는 국민 불편 해소와 전담 측량팀 구성 등을 통한 전문성 확보가 필요하다.
둘째, 국민권익위원회는 위원회의 의결에 대한 이행력을 확보하여 처분청은 권고 의결에 기속되도록 하고 제도의 정비를 통하여 지적측량업무 수행을 위한 전담인력을 확대하는 등 전문성을 제고해야 한다.
셋째, 행정심판위원회 행정심판은 정확성과 일관성 확보를 위해 시·도별 업무처리 방식과 결과를 공유하고 유기적인 소통이 필요하다.
넷째, 법원이나 헌법재판소의 소송은 지적행정 전반에 대하여 처분성을 확대하여 법원 판결 등의 일관성을 유지하도록 하고 국민의 권리구제를 확대하는 것이 필요하다.
마지막으로 개별 권리구제 제도의 역할과 다루고 있는 대상, 청구요건, 처리결과에 불복하는 경우 해소방안 등 국민에게 정확히 안내하고 권리 구제제도를 활용할 수 있는 국민 친화적 개선이 필요하다.
본 연구를 통하여 지적행정을 다루는 국민의 권리구제 제도가 본래의 역할을 수행하는데 있어 혼란을 최소화하고 권리구제 확대를 위해 법령 및 제도, 운영체계 등의 개선이 필요하다는 시사점을 확인할 수 있었다.
선행연구는 지적행정과 관련된 권리구제 제도를 단편적으로 다루어 구제제도의 성격과 처리대상 및 절차, 처리결과 등에 대하여 상호 비교하거나 국민의 권리구제 확대를 위한 법·제도적 개선사항을 폭넓고 명확하게 제시할 수 없었다. 그러나 본 연구에서는 지적행정 관련 권리구제 제도를 폭넓게 살펴보고 개선방안을 도출함으로써 권리구제 제도 전반에 대해 이해를 높인 연구로써 의의가 있을 것이다.
