다문화가정 해체에 따른 범죄추이와 사법정책 : 다문화청소년을 중심으로

국문 초록 (Abstract)

다문화사회는 세계적 추세로서 다양한 인종만큼이나 서로 다른 문화, 생활양식, 가치관들을 수용·융합해야 하는 필요성의 제기와 전통적 미풍양속을 지키려는 주장들이 상충하며 시비와 논란거리가 되고 있다. 이러한 국제간 인적교류는 각국의 정책수립에 큰 변화를 일으킴으로서, 다양한 시설, 교육 등 환경조성에 막대한 국가예산이 배정되며, 이를 뒷받침 할 제도마련과 인력확보가 불가피한 실정이다.
우리나라도 2011년 외국인과의 혼인이 총 29,762건으로 지속적인 증가추세 속에 있고, 다문화청소년의 증가치를 연구한 결과를 보면, 2020년에는 10만명으로 늘어날 것으로 추정된다. 이러한 상황에서 우리나라 체류 외국인 범죄(검거건수)는 2002년에 5,221건에서 2010년에 22,543건으로 8년간 4배 이상 증가한 것으로 나타났다.
우리나라의 다문화청소년들은 높은 이혼율과 가정불화 등 구조적·기능적 결손 환경에 놓여있고, 외국인 범죄 증가추세로서 예측할 수 있는 비행성을 지닌 관련인과의 잦은 접촉 속에 성장하고 있는 것이다. 향후 다문화청소년들은 자국민을 포함한 다른 교우들과 유대를 통해 또 다른 비행학습이 반복될 것이 추측되는 가운데 그들이 성인이 되어 한국 사회전반에 자리 잡게 되겠지만, 현재 우리나라는 단순히 외사사범의 일부로 취급될 뿐 다문화가정 청소년의 관리와 선도, 교화를 목적으로 한 사법정책은 전무한 실정이다.
우리보다 앞서 다문화사회를 겪어온 국가들은 다문화정책과 관련한 난제를 해결하지 못하고 있다. 미국에서는 다문화주의로 인한 이민자들이 원주민들이 누려야 할 혜택을 뺏어간다는 비난의 목소리가 커지고, 유럽에서는 문화적 갈등과 인종주의적 혐오범죄(일명 제노포비아)가 만연되며, 외국인 범죄에 대응하는 정부 정책에 대해 반대하는 대규모 소요사태가 발생하기도 했다.
우리정부에서는 2012년도 외국인관련 정책 149개, 1938억 원 상당의 예산을 투입할 예정이지만 지원과 보호, 장려 위주로 치우쳐 외국인이 최초 국내입국 및 체류단계의 엄정한 범죄예방 관리 정책의 중요성이 간과되어 있다. 다문화청소년들이 성인이 될 시기를 고려한 장기적 안목에서의 사법정책 입안은 배제되고 있는 것이다.
본 연구에서는 다문화가정과 다문화청소년의 실태를 일반적인 청소년 비행에 대한 연구이론을 적용시켜 그들이 비행가능성을 추론하고, 해외사례를 소개함으로써 그 심각성을 지적하고자 하였다.
이를 토대로, 다문화청소년을 건전한 우리사회의 일원으로 성장할 수 있도록 하기위한 몇 가지 제언을 도출하였다. 첫째, 사법기관의 다문화청소년 전담부서 설치, 둘째, 결혼의 건전성을 지키고 해체가 예고된 무책임한 가정형성을 제한하기 위한 국제결혼 인증제도의 도입, 셋째, 국제결혼 자국민 배우자에 대한 자격심사요건 강화와 외국인 배우자에 대한 통보 의무화, CYS-Net(지역사회청소년통합지원체계)을 활용한 다문화청소년 지원, 전문인력으로 구성된 일원화된 행정체계 구축, 복지·지원 일변도에서 사법적 관리·규제와의 균형으로 전환 등이다.

다국어 초록 (Multilingual Abstract)

Although multicultural society became a global trend, there have been constant conflicts in our society between arguments for accepting ethnic diversity, different cultures, lifestyles, values​​, and for protecting our traditions. These international people-to-people exchanges give great influence in policy making of many countries, such as arranging huge extra national budget for additional facilities and educational institutions. Thus, securing supporting systems and human resources for these international people-to-people exchanges are essential.
The total number of international marriage of our country was 29,762 in 2011 and is still increasing. Studies estimate the number of juvenile from multicultural families would be more than 100 thousands by 2020. Besides, the number of foreigners residing in Korea who are arrested for crimes has been increased from 5,221 in 2002 to 22,543 in 2010, and this increase is more than four times during eight years.
Multicultural juveniles of our country are placed in the environment of the structural and functional deficits such as high divorce rates and family discord. In addition, they are exposed to delinquency-related factors while they are growing as we can expected from increase of domoestic foreigner crime. Although in the future, many multicultural juveniles are expected to repeat delinquency through bond with their companions and eventually be members of our society, currently there is no specific juvenile justice policy to educate, manage, and protect them from delinquency.
The countries ahead of us, suffered a multicultural society, they could not solve the challenges associated with multicultural policy. In the United states, blame to multicultural immigrants has been increased for stealing the benefits away from U.S. citizens. In Europe, cultural conflict and racial hate crimes (also known as xeno phobia) have been prevalent and massive unrest was occurred by the policy of the government to respond to the foreign crime.
Our government plans to enforce the budget of 1,398 billion won to 149 foreign-related policies in 2012. However, these policies only focuses on supporting, protecting, and encouraging foreigners, ignoring strict crime prevention policy on stage of foreigner's first domestic entry and stay. In other words, judicial policy with long-term perspective considering the time that multicultural juveniles become adults has been precluded.
The purpose of this study is (1) to investigate the possibility of their delinquency, by applying current status of multicutural families and juveniles to research and theory associated to general juvenile delinquency, and (2) to emphasize its seriousness by introducing overseas cases.
Based on this, some suggestions are derived for multicultural juveniles to grow as a healthy part of our society: First, establishment of the multicultural juvenile department in the law enforcement agencies, second, introduction of the accreditation system for international marriage, to keep the integrity of marriage and to limit the irresponsible formation of family that is easily expected family breakup in near the future, third, strengthening qualification requirements for citizen spouses and the mandatory notification for foreign spouses of international marriage, supporting multicultural juveniles through CYS-Net (community youth integrated support system), unified administrative system consisting of professionals, and switching from system focused on only wellbeing and supporting to balanced system with Judicial management and regulatory.
