最近까지 南極大陸은 일반적으로 地球上의 廣大하고도 珍奇한 陸塊이상의 것으로는 考慮의 대상이 되지 않았다. 寒冷하고도 황폐하며 地球上의 가장 위험한 얼음으로 뒤덮인 바다로 둘러 싸인 南極大陸은, 단지 대담한 探險家에게는 대단한 冒險의 對象으로서, 强忍한 少數의 科學者에게는 巨大한 自然實驗室로서 알려져 왔을 뿐이었다. 1 mile 두께의 萬年氷原 아래 매장되어 있을지도 모를 寶物들은 수고로이 調査할 價値가 있다고 생각되지 않았다.
그러나 오늘날 世界의 많은 나라들은 南極 近海의 天然資源 賦存 可能性에 대하여 好奇心을 가지고 있다. 그럼에도 불구하고 現在 南極地域에서 探査와 開發을 統制하기 위하여 確立된 法規가 不幸히도 存在하지 않는다.
비록 7個國이 南極地域의 여러 "sector"에 대하여 實質的인 主權의 主張을 하긴 했지만 이러한 主張의 그 어떠한 것도 一般的인 承認을 받지 못하고 있다. 領有權을 主張한 國家는 United Kingdom, New Zealand, Australia, France, Norway, Chile 및 Argentina이다. 그러나 19세기 이래 南極地域에서 가장 積極的인 當事國인 美國과 蘇聯은 어떠한 領土權도 主張하지 않고서 "不承認·留保"의 立場을 取하고 있다.
어떻든 發見의 航海가 18세기에 南極大陸 周邊의 바다와 叢氷에 進入했다. 그 때부터 보다 상세한 發見이 領土의 倂合 뿐만 아니라 探險, 科學的 發見, 捕鯨과 海豹 捕獲을 위하여 政府 後援의 探驗隊와 民間探險隊에 의하여 發展的으로 이루어졌다. 그 후 探險과 科學活動이 더욱 高度化되고 常設基地가 建設되었다.
그러한 關心과 活動은 南極大陸에서 12個 國家가 관여했던 1957∼58年 IGY에 절정에 달했다. 그 때 그 12個國은 긴밀하고 평화적인 協力으로 科學活動을 수행하기 위하여 政治的·法的 見解의 差異는 且置하기로 同意하였다. IGY의 成功에 따라 이 國家들은 어떤 永久的인 特殊制度가 바람직하다는 데 意見을 같이하고 南極條約에 이르는 交涉을 시작하였다.
1959年의 南極條約은 南極地域을 效率的으로 非武裝化하고 調印國間에 "科學領域" (science preserve)으로서 確立하고 있다. 그러나 南極條約은 世界共同體의 大部分을 構成하고 있는 非調印國들을 拘束하지 못한다. 더구나 南極條約은 明白히 南極地域에서의 資源活動問題에는 言及하지 않고 있다. 賦存資源 開發에 관한 法的·政治的 空白은 南極 資源活動 着手에 世界 諸國으로 하여금 殺到하게 하여 南極 資源問題를 惹起시켰다. 따라서 南極 近海에서의 現在의 衝突 可能性을 減少하려면 이 문제의 解決策이 곧 發見되지 않으면 안된다.
南極條約體制下에서 領有權 主張은 南極條約 第4條에 의하여 凍結되어 있고 南極地域의 法的 現狀은 南極條約이 發效한 1961年 이래 지금까지 維持되어 왔다. 현재 南極地域을 規律하고 있는 南極條約體制는 南極條約과 거기서 派生된 機構와 制度라고 보통 알려져 있다. 이 南極條約體制下에서 ATCPs는 南極問題에 관한 政策決定에 排他的인 權限을 行使해 왔다. 그러나 1970年代 이후 天然資源의 不足, 環境保護, 특히 新國際經濟秩序의 確立에 대한 第3世界의 要求 등과 같은 世界的 문제의 등장은 不可不 領土主權에 직결되는 南極의 法的 地位를 再檢討하게 하고 南極條約에 기초한 南極體制의 存續에 의문을 제기하게 했다.
南極條約은 世界的인 急變의 時代에 重要하고도 활기찼던 것으로 判明되었다. 그러나 우리는 南極條約體制의 歷史에 있어서 重大한 時點에 서 있다. ATCPs의 注意를 끄는 새로운 문제와 새로운 挑戰이 나타난 것이다.
ATCPs는 旣存 南極體制의 維持를 위하여 안간힘을 써 왔고 또한 쓰고 있는 反面에 開發途上國들은 經濟的 財貨의 公平한 分配와 重要한 南極문제에 관한 政策決定過程에의 參加를 新國際經濟秩序의 요체로 간주하고 新國際經濟秩序의 한 適用例로서 南極의 完全한 國際化를 追求하고 있다. 開發途上國들은 人類共同遺産의 槪念을 基本的으로 政治的 槪念인 新國際經濟秩序의 法的 槪念으로 생각하고 深海底 및 宇宙에서와 같이 人類共同遺産의 槪念이 南極에도 適用되어야 한다고 주장한다. 드디어 第40次 UN總會는 南極資源 開發의 國際的 管理와 그러한 開發利益의 公平한 配分을 決議하기에 이르렀다.
요컨대 南極地域에서 最初로 領有權이 주장된 이래 世界政治共同體는 急速히 變해 왔으며 이제 南極地域은 事實上 모든 人類의 利益을 위하여 利用되어야 할 共有地(terra communis)라고 할 수 있다. 따라서 國際的 展望으로 볼 때 南極問題解決이 理想的으로 達成될 수 있는 一定한 目標들이 있다.
a. 南極地域의 계속적인 非武裝化
b. 계속적인 科學的 調査의 自由
c. 南極地域 環境의 完全性의 維持
d. 資源活動 開始에 必要한 調査의 保障을 마련하는 데 充分한 法的 制度의 確立을 통하여 南極地域의 政治的 安定을 期하는 것
e. 國際共同體의 共同福利를 위한 南極 資源의 秩序整然하고 效率的인 開發과 分配
이러한 南極문제의 解決을 위해서는 相互 受諾할 수 있는 모든 可能한 妥協이 檢討되어야 한다.

Until recently, Antarctica was generally considered to be little more than a massive oddity on the earth's crust. Cold, inhospitable and surrounded by the globe's most dangerous ice-filled seas, the continent was known only as a great hazard for intrepid adventures and a gigantic natural laboratory for a few hardy scientists. Those treasures which might lie hidden beneath its mile-thick ice cap were not considered worth the trouble of investigation.
Today, however, many states of the world are intrigued with the offshore natural resource potential of Antarctica. Unfortunately, at the present time there is no established legal order governing resource exploration and exploitation in Antarctica.
Although seven states have made actual sovereignty claims to various "sectors" of the Antarctic continent, none of these claims enjoys general recognition. Those countries which are claimants of territorial sovereignty are the United Kingdom, New Zealand, Australia, France, Norway, Chile and Argentina. The United States, since the nineteenth century the most active party in Antarctica, has made no territorial claim, nor has the Soviet Union, which since the 1950s has developed an Antarctic program rivaling that of the United States.
Anyway, voyages of discovery first penetrated the waters and pack ice surrounding Antarctica in the eighteenth century. From then, progressively more detailed discoveries were made by government-sponsored and private expeditions, for the purposes of exploration, scientific discovery, whaling and sealing, as well as annexation of territory. Later, expeditions and scientific activity became more sophisticated and permanent stations were established. That interest and work peaked in the International Geophysical Year(IGY) in 1957∼1958 when the twelve nations involved in Antarctica, seven of which had made territorial claims, agreed that political and legal differences should be set aside in the interests of carrying out scientific research in close and peaceful coorperation. Following the outstanding success of the IGY, these nations agreed that some more permanent special regime would be desirable, and so bogan the negociations leading to the Antarctic Treaty.
The Antarctic Treaty of 1959 effectively demilitarizes Antarctica and establishes the continent as a "science preserve" among the signatory states. Treaty, however, is not binding upon the non-signatory states which constitute most of the world community. Moreover, it conspicuosly fails to address the issue of resource activity within Antarctica. The legal and political vacuum pertaining to potential resource exploitation has combined with the increasing pressures on the states of the world to initiate resource activities in Antarctica to create the Antarctic resource problem. A solution to this problem must be found soon if the current possibility of conflict over Antarctic offshore natural resources is to reduced.
Anyhow, under the present Antarctic System, territorial claims are frozen by Article IV of the Antarctic Treaty and the legal status quo of Antarctica has been maintained up to now since 1961 which the Treaty went into force. The Antarctic Treaty and its derivative legal instruments and institutions are commonly known as the Antarctic Treaty System. Under the Antarctic Treaty System, the Consultative Parties to the Antarctic Treaty designated as Antarctic Group have exercised as a whole the decision-making power over the Antarctic affairs. Since the 1970s, however, global issues such as deficiency of natural resources, environmental protection and especially the demand of the 3rd World for the establishment of New International Economic Order, made it inevitable to re-examine the legal status of Antarctica which is directly linked to territorial sovereignty and call into question the maintenance of Antarctic System based on the Antarctic Treaty.
The Antarctic Treaty has proven vital and dynamic in a time of rapid global change. But now we stand at an important point in the history of the Antarctic Treaty System. New issues and new challenges have emerged to engage the attention of the Consultative Parties.
The Consultative Parties have made and is making every effort to maintain the existing Antarctic System. The developing countries, however, regard as key-points of NIEO an equitable sharing of economic wealth and participation in the decision-making process of important international affairs, and are searching for full internationalization of Antarctica as an example of the application of NIEO. The developing countries consider the concept of Common Heritage of Mankind as a legal concept of NIEO which is fundamentally a political one, and argue that as in the case of the deep sea bed and outer space, the concept of Common Heritage of Mankind should be also applied to Antarctica. At last, the United Nations General Assemby(fortieth session) affirmed that any exploitation of the resources of Antarctica should ensure the maintenance of international peace and security in Antarctica, the protection of its environment, the non-appropriation and conservation of its resources and the international management and equitable sharing of the benefits of such exploitation. In sum, the world political community has changed radically since territorial rights were first claimed in Antarctica, and Antarctica is now in fact terra communis, to be utilized for the benefit of all mankind.
From an international perspective there are certain objectives that solution to the Antarctic problem might ideally achieve. These include : (1) the continued demilitarization of Antarctica ; (2) the continued freedom of scientific investigation and compulsory sharing of scientific information ; (3) the maintenance of the environmental integrity of Antarctica ; (4) the political stabilization of Antarctica through the establishment of a legal regime sufficient to provide security for investment necessary to commence resource activities ; and (5) the orderly and efficient exploitation and sharing of Antarctic resources for the common well-being of the international community.
While it is a simple exercise to list the laudable goals of a solution to the Antarctic issues, it is exceedingly difficult to construct a plan for implementation which would be workable and acceptable to all interested states. To create a soultion to the Antarctic issues, all possible mutually acceptable arrangements should be analyzed.
