1968년 6월 12일 제 23차 유엔총회에서 채택된 핵 비확산 조약(NPT)은 189개국이라는 지구상 거의 대부분 국가를 회원국으로 확보하고, 지난 35년 동안 핵무기 보유국 숫자를 한 자리 수 이하로 묶어 놓는데 성공하였다는 점에서 군축 및 안보분야의 모델이 될 정도로 성공적이었다는 평가를 받고 있다. 그러나 이러한 긍정적 평가에도 불구하고, NPT체재는 최근 그 규범성 자체에 대한 심각한 도전에 직면하고 있다. 북한, 이란, 이라크 등으로부터의 도전, 핵물질 및 장비에 대한 광범위한 불법거래 시장의 존재 등을 감안, NPT규범을 더욱 강화하여야 한다는 목소리가 강하게 대두되는가 하면, 또 다른 한편으로는 NPT체재가 규범 적용에 있어 이중 잣대를 적용하고, 일관성이 없을 뿐 아니라, 핵무기 보유국들의 NPT 6조 의무(핵군축) 불이행 등을 들어 NPT규범의 불공정성과 함께 NPT규범에 대한 근본적 의문을 제기하기도 한다. NPT규범의 취약점을 보강하고 규범 위반국에 대한 강제조치 등을 위해서는 이러한 조치에 대한 국제사회의 광범위한 지지가 절대적으로 필요하며, 이러한 지지를 확보하기 위해서는 NPT규범이 공정하지 못하다는 일반적 인식을 제거하고, 공정성을 제고할 수 있는 방안 마련이 시급하다.
이에 본 논문은 토마스 프랭크(Thomas M. Franck)교수가 개발한 공정성(fairness) 개념을 분석의 도구로 활용하여, NPT규범의 공정성을 측정하고, 동 규범의 공정성 제고방안을 모색하고자 한다. 공정성은 과정 및 절차에 중점을 둔 정당성(legitimacy)과 분배적 정의(distributive justice)에 중점을 둔 형평(equity)으로 구성된다. 특정 규범의 정당성은 문안의 명료성(determinacy), 규범의 전통이나 권위 등으로 나타나는 상징적 유효성(symbolic validation), 적용의 일관성(coherence) 및 규범 정립과정에서의 상위규범과의 합치성(adherence)등 4개 지표에 의하여 측정할 수 있다. 형평은 국제재판에서, 특히 해양경계 획정 관련 사건에서 중요한 역할을 하고 있으며, 최근 기후변화협약과 이의 이행을 위한 쿄오토 의정서, 오존층 파괴물질 규제를 위한 몬트리올 의정서 등 국제환경법 제정과정에서도 중요한 고려 요인이 되고 있다.
핵무기 보유국과 비 보유국간 대타협(grand bargain)의 산물인 NPT는 비 보유국들의 핵 포기 약속과 보유국에 의한 원자력의 평화적 이용 증진 및 핵 군축약속으로 구성되어 있다. 따라서 NPT규범은 핵 비확산, 원자력의 평화적 이용, 핵군축이라는 3개의 기본 축을 바탕으로 하여, 안전조치제도, 수출 통제제도, 그리고 비핵지대화라는 이행체계로 구성되어 있다 할 수 있겠다. 평화적 목적에서 군사적 목적에로의 핵물질 전용 방지를 위한 안전조치제도는 국제원자력기구(IAEA)와 당해 국가간 체결하는 안전조치협정에 따라 규율되고, 수출통제제도는 쟁거 위원회(Zangger Committee)와 원자력 공급 그룹(Nuclear Suppliers Group)에 의하여 규제 되고 있다. 그리고 NPT 7조가 규정하고 있는 비핵지대화는 지역적 비핵화를 통한 핵무기 없는 세계 구현을 목표로 하고 있다.
이러한 NPT규범에 대하여 위에 언급한 4개 지표를 이용하여 그legitimacy를 측정한 바, NPT는 일단 조약 문안협상이 유엔과 군축분야에 있어 최고의 권위를 인정받고 있는 현 제네바 군축위원회(CD) 전신인 18개국 군축위원회(ENDC)를 중심으로 이루어졌을 뿐 아니라, 유엔 총회에 의하여 조약이 채택됨으로써 symbolic validation과 adherence 부문에서 높은 평가를 받을 수 있을 것이다. 또한 문안의 명료성 부분에서도 일반적으로 긍정적 평가를 받았다. 특히, 핵무기 보유국과 비 보유국을 구분하는 결정적 기일(critical date)을 명확히 한 점은 특히 높이 평가되어야 할 것이다. 그러나 핵 군축을 규정한 NPT 6조의 애매한 규정은 determinacy 부분에서의 여사한 긍정적 평가를 무색하게 하였을 뿐 아니라, 끊임없는 심각한 분쟁의 씨앗이 되고 있다. 또한 미국을 비롯한 핵 보유국들의 인도, 파키스탄, 이스라엘과 같은 NPT 비 당사국에 대한 핵 정책은 이중 잣대 적용이라는 의혹을 불러일으키고 있을 뿐만 아니라, 전혀 일관성을 보이지 않고 있다. 특히 파키스탄에 대한 미국의 정책은 정치정세 변화에 따라 제재와 묵인 사이를 오가며 극심한 변동을 보여 주고 있다. 또한, 리비아, 이란, 이라크, 북한 등 NPT규범 위반국 처리과정에 있어서도 역시 규범 적용에 있어 전혀 일관성을 갖지 못한 것으로 나타났다. NPT 6조의 determinacy결여와 NPT 적용에 있어 coherence 결여는 NPT체재의 legitimacy에 심각한 문제점을 야기 시킨 것으로 평가된다.
한편, 핵보유국의 핵군축 약속은 비 보유국들의 핵 포기에 대한 대가로 규정된 것인 만큼, NPT체재의 equity문제는 핵보유국들이 얼마나 성실히(in good faith) 핵 군축약속을 이행하느냐에 달려 있다 하겠다. 대표적 핵보유국인 미국과 쏘련은 전략무기 제한 협정(SALT I)으로부터 공격용 전략무기 감축협정(SORT)에 이르는 일련의 전략핵무기 제한 및 감축 협정을 통하여 전략핵무기 부분에 있어서는 상당한 수준의 군축을 이행한 것으로 평가된다. 그러나 미국의 ABM조약 탈퇴와 이에 뒤따른 START II 폐기, 미국의 포괄적 핵실험 금지조약(CTBT) 비준 거부, 핵물질 생산금지 조약(FMCT) 협상에 대한 부정적 태도 등은 미국에 대한 비 보유국들의 신뢰에 돌이킬 수 없는 타격을 가하였다. 더구나 핵무기 역할을 강조한 미국의 신 핵정책은 핵보유국으로서의 6조 의무 이행에 있어 최소한의 신의성실(good faith)원칙을 저버린 것이라 아니 할 수 없다. 따라서, NPT체재는 legitimacy 와 equity 테스트에서 모두 실패함으로서 공정성이 크게 결여된 것으로 나타났다.
NPT체재가 현재 직면하고 있는 도전을 극복하고, NPT체재의 유효성과 효율성을 제고하기 위해서는 안전조치나 수출통제 제도등 제반 이행체재의 미비점 보강뿐만 아니라, NPT체재의 공정성 제고가 긴요하다 하겠다. 이러한 공정성 제고를 위해서는 첫째, NPT규범 적용과정에 있어서 일관성을 유지하고, 둘째, NPT 6조의 애매한 문구를 명료하게 재해석하여야 한다. 95년 NPT검토 및 연장회의에서 채택한 “원칙과 목표(Principles and Objectives)," 그리고 2000년 NPT검토회의에서 채택한 ”13개 조치(thirteen steps)" 는 조약법에 관한 비엔나 협약 31조 3 (a) 및 (b)항에서 규정한 “사후 합의”내지 “사후 관행”에 해당되어, 핵 보유국들의 6조 의무 이행의 road-map이 될 수 있을 것이다.
따라서, NPT 체재의 공정성 제고를 위하여서는 핵 보유국들은 NPT 6조 및 “원칙과 목표”이행을 위하여 2000년 평가회의에서 채택한 13개 조치를 성실히 이행하여야 할 것이다. 그중에서도, ABM조약 및 START II 폐기에 따른 보완책 마련, CTBT의 조속한 발효조치, 핵물질생산 금지 조약 협상의 조속한 개시, 핵무기 의존강화 정책의 폐기 등이 조속히 이루어 져야 할 것이다. NPT규범의 유효성과 효율성확보는 강화된 NPT체재가 비차별적으로 일관성 있게 적용되고, 13개 조치의 착실한 실행을 통한 핵보유국들의 군축의무 이행이 성실히 이루어질 경우에만 가능할 것이라는 점을 명심하여야 할 것이다. 세계는 미국을 비롯한 핵보유국들의 태도를 주시하고 있다.

The Nuclear Non-proliferation Treaty(NPT) is generally evaluated to be a success story in the sense that it has limited the number of states with nuclear capacity to a single digit instead of twenty-eight or even more which had been predicted thirty five years ago. However, despite all the positive assessments, the NPT regime is now facing a serious challenge. Witnessing the challenge to the NPT regime made by North Korea, Iraq and Iran, and A.Q. Khan's wide-spread network of illegal trafficking of nuclear materials and facilities, many concerned states are advocating urgent measures to strengthen the NPT regime. On the other hand, many NNWS are contesting the fairness of the regime itself, by either complaining a double standard being applied or NWS' non-implementation of their obligations under the regime. Given that any measures to close the loopholes of the NPT regime or any coercion against States of non-compliance cannot work without the support of a vast majority of the international community, it is absolutely necessary to enhance the perception of fairness about the NPT regime among NNWS in order to strengthen the it.
Against this backdrop, this dissertation intends to test the fairness of the NPT regime, using the tool of analysis developed by professor Thomas M. Franck. According to professor Franck, fairness is determined by legitimacy which puts emphasis on the right process and distributive justice which is interpreted into equity in international law. There are four indicators which may be used to judge a rule's legitimacy: determinacy, symbolic validation, coherence and adherence. Equity as distributive justice tends to focus on distributive modalities and seek to make an adjustment to the result coming from a strict and literal application of law. Equity has played an important role not only in international adjudication, especially in maritime boundary disputes, but also in international rule-making process, especially in the international environmental law field.
The NPT regime is a result of a grand bargain between NWS and NNWS. In return for the commitment of NNWS to non-acquisition of nuclear weapons, NWS pledged to promote the peaceful use of nuclear energy and made a commitment to nuclear disarmament. Consequently, non-proliferation of nuclear weapons, promotion of peaceful use of nuclear energy and nuclear disarmament constitute three pillars of the NPT regime. In order to deter the dissemination of nuclear weapons, the NPT provides for three mechanisms: safeguards, export control and the nuclear-weapon free zone(NWFZ). Safeguards designed to prevent the diversion of nuclear materials from peaceful uses to military purposes, are regulated by the safeguards agreement to be concluded between the IAEA and State Party to the NPT and export of nuclear material and facilities is controled by the Zangger Committee and Nuclear Suppliers Group. NWFZ is recognized by article VII of the NPT as a way to achieve a nuclear-weapon-free world through regional approach.
Applied with the legitimacy test, the NPT regime is well appreciated in its adherence and symbolic validation. It is quite positively rated in general in determinacy also; especially, the clear provision of critical dates distinguishing the NWS and NNWS cannot be too much appreciated. Yet, one indeterminate language in article VI providing for the nuclear disarmament not only outweighs all other merits in determinacy but also provides a permanent source of concern and conflict. Moreover, the NPT regime manifests a serious lack of coherence. Not only not mindful of their article I obligation not to assist NNWS in acquiring nuclear weapons, NWS, especially the United States did not show any consistency in dealing with three states lying outside the NPT-Israel, India and Pakistan-by acquiescing to Israeli nuclear weapons while applying sanctions to nuclear tests by India and Pakistan. Especially, the U.S policy vis-a-vis Pakistan was marked by an extreme fluctuation between sanctions and acquiescence depending on the whimsical political situation. No consistency is found, either, in the treatment of the non-compliance cases of Libya, Iraq, Iran and North Korea.
Given that nuclear disarmament by NWS is provided for in return for NNWS' forswearing of nuclear weapons, the equity test largely depends upon how faithfully NWS implement their obligations under article VI. The United States and Soviet Union, the two principal NWS, is evaluated to have achieved a significant reduction in strategic nuclear weapons through a series of strategic arms limitation and reduction treaties spanning from SALT I to SORT. However, U.S. withdrawal from the ABM Treaty followed by the abrogation of START II, and U.S. rejection of ratifying the CTBT and negative attitude toward the Cutoff Treaty dealt a serious blow to the confidence the NNWS had in the United States. Furthermore, the new U.S. nuclear policy stressing the role of nuclear weapons cannot meet the minimum requirements of good faith in implementing article VI obligations. As such, the NPT regime manifests a serious lack of fairness by failing both the legitimacy and equity test.
Applying the fairness test, it became clear that the most serious problem of the NPT regime was the lack of coherence in its application and the avoidance by NWS to carry out in good faith their article VI undertakings. Consequently, in order to enhance the fairness of the NPT regime, the regime should be applied, first of all, in a coherent way.
Secondly, as the deficiency of determinacy in article VI was astutely taken advantage of by NWS to avert their obligations imposed upon them by the article, the determinacy of article VI needs to be enhanced. The decision and final declaration adopted at the NPT Review Conference is interpreted to constitute the "subsequent agreement" or "subsequent practice" in the meaning of article 31, paragraph 3(a) and (b) of the Vienna Convention on the Law of Treaties, to be taken into account in the interpretation of treaty obligation.
Finally, what is most important to enhance the fairness of the NPT regime is for the NWS to implement in good faith their article VI obligations, which are outlined in 13 practical steps.
In conclusion, the validity and effectiveness of the NPT regime can be secured only when a tightened rule against proliferation is applied in a coherent way and is accompanied by the implementation in good faith of the 13 practical steps by NWS.
