The study has a critical mind on that the existing researches on prostitution only consider the process of introducing state‐regulated prostitution and abolition of unlicensed prostitution campaign. A lot of researchers are commonly appointing that prostitution form and its industrial structure marking Korean society now were started from the period of the Japan’s colonial rule of Korea. However, they don’t give us accurate answer that prostitution has been publicly carried out in Korean society after the restoration of independence abolishing the state‐regulated prostitution. The state‐regulated prostitution is proposed as one of methods to settle a problem of prostitution whenever prostitution is at issue in Korean society since recognition on history of Korean government‐regulated prostitution is fragmentary.
Realistic diagnosis and solution on prostitution of Korean society can be explained through historical consideration of prostitution policy including the state‐regulated prostitution. During the period of Japan’s colonial rule of Korea, Japan carried out state‐regulated management and prohibited unlicensed prostitution through the state‐regulated prostitution in Korea. However, actually Japan permitted and managed partial prostitution in unlicensed prostitution. Therefore, the prostitution policy during the period of Japan’s colonial rule of Korea will be able to be grasped in a proper way through recognition and regulation attitude of the police on licensed prostitution under the control of the police and unlicensed prostitution out of the control of the police.
The state‐regulated prostitution which is a system to permit prostitution officially appeared in the process that Japanese imperialism went on securing political domination in Korea. Having developed prostitute quarters from the Edo Age, Japan newly reorganized modern state‐regulated prostitution in a way of strengthening venereal disease research laboratory in collecting area of prostitution already formed in the modern times. After opening Joseon compulsively in 1876, Japanese prostitution was developed on the basis of prostitute quarters in foreign concession based on the open port. However, official state‐regulated prostitution was not carried out, and Japan controlled prostitution by regulating only sate‐regulated prostitution in collecting area of prostitution. The above form of ‘Semi‐state‐regulated prostitution’ was a result of considering ‘Dignity of the nation’ to avoid eyes of the world powers.
Expansion of prostitution to Joseon society was started with introduction of Japanese prostitute quarters. However, in the early period, prostitution was connected with amusement like Sampae Gisaeng for the most part than a naked form of prostitution. Most of them were scattered here and there than spatially collected. Japanese imperialism changed female receptionists with complex characteristics to a prostitute by introducing the state‐regulated prostitution to Joseon society. For, Japan needed to prescribe venereal disease research laboratory (VDRL) by law for the female receptionists by changing female receptionists against venereal disease research laboratory (VDRL) to a prostitute.
When the state‐regulated prostitution was nationally carried out in 1916, the prostitution policy had differences between Japanese society in Joseon and Joseon society. The state‐regulated prostitution of Japanese society in Joseon was more gathered and received strict VDRL. However, the state‐regulated prostitution of Joseon society received a little loose VDRL in a form of scattered prostitution. The state‐regulated prostitution business depended on consumption of the Japanese in Joseon for the most part, and the Joseon’s business was carried out for the most part in a form of unlicensed prostitution.
Regulation of prostitution was carried out with differences by each region by ‘Discretion’ of each customs police. Therefore, there were areas where prostitution was managed in almost the same way as state‐regulated prostitution although a lot of areas were not belong to the prostitution area. Regulation of female receptionists’ business including the state‐regulated prostitution put a focus on venereal disease prevention through regulation of prostitution. Therefore, the police regulated gisaeng or barmaid as a prostitute, and substantially permitted their prostitution.
Because of criticism toward the state‐regulated prostitution, the state‐regulated prostitution was reduced as time went on. By pressure of international society with a problem of human traffic and anti‐prostitution activists’ activities, the state‐regulated prostitution went on losing its position. Unlicensed prostitution and venereal disease were increased for all that the state‐regulated prostitution was carried out, which made the state‐regulated prostitution lost its justification.
Japanese imperialism managed prostitution by strengthening control of unlicensed prostitution as well as reducing the scale of the state‐regulated prostitution. The assumption of the state‐regulated prostitution was to prohibit unlicensed prostitution. However, Japan thought that unlicensed prostitution could not be ineradicable from the first. Thus, Japan managed unlicensed prostitution by limiting their outgoing and carrying out VDRL. Such a management of unlicensed prostitution was realized with entertaining business which got business permission from the police under the control of the police. On the other hand, Japan made a relatively strict execution of unlicensed prostitute quarters or entertaining business.
As soon as Japan had confidence for management of unlicensed prostitution, Japan examined a policy to abolish the state‐regulated prostitution. However, Japan didn’t abolish the state‐regulated prostitution to the end for all that a lot of areas in Japan abolished the state‐regulated prostitution. The contents of abolition of licensed prostitution were to abolish the state‐regulated prostitution formally and to control unlicensed prostitution in a way of the state‐regulated prostitution, not to prohibit prostitution itself. Abolition of licensed prostitution was not realized in Joseon although it was a formal policy since VDRL system in Joseon was not enough. It was difficult to abolish the state‐regulated prostitution that Japanese people in Joseon used for the most part since <Act on VD Prevention> which was a precondition of abolition of prostitution was not carried out in Joseon.
Abolition of prostitution was not realized. However, in the form of Joseon’s prostitution, the state‐regulated prostitution was gradually reduced and unlicensed prostitution was expanded little by little. For, people avoided the state‐regulated prostitution by an effect of abolition of prostitution, and preferred enjoying amusement and prostitution at once for cheap expenses. The attitude of the police aiding and abetting expansion of unlicensed prostitution, taking action of management, not prohibiting changed unlicensed prostitution, was a cause of the above situation. Japan went on strengthening management of unlicensed prostitution by strengthening VDRL, gathering prostitutes and converting unlicensed prostitution to licensed prostitution such as a barmaid or a waitress.
During the period of wartime in a form of total war, the state‐regulated prostitution was advocated and unlicensed prostitution was restricted. The entertaining business such as food restaurant, café and bar was regarded as ‘Merrymaking pleasure business’ giving damage to the spirit of the situation in emergency, and so was restricted. Through the strengthening of business control and an increase in tax of amusement & food restaurant, the entertaining business was restricted and was closed their door. On the other hand, the state‐regulated prostitution such as Daejwabu getting loose control relatively didn’t received a large damage even during the period of wartime and continued to open their door. Daejwabu focused on prostitution was judged as a business with a few ‘Amusement elements’. First of all, Dajwabu continued to open the door since major users of the state‐regulated prostitution were Japanese people in Joseon and military men for the most part.
In the general mobilization system, female receptionists were rearranged in the frame of Japan’s women mobilization policy. To secure women resources during the period of wartime, Japan attempted to intercept channels of female receptionists to prostitution by quitting business of female receptionists or strengthening regulation of human traffic. In addition, Japan made female receptionists participate in labor mobilization or nursing mobilization, and made female receptionists play a role of ‘Wartime consolation’ by making consolatory visit groups or comfort bags.
Under Japan’s control policy, receptionists strived to overcome difficulties in their business with unlicensed prostitution or to find a way out by entering into new areas such as China and Southeast Asia. Female receptionists quitting their business also transferred to new unlicensed prostitution places or earned money for their life by existing as an unlicensed prostitute. Japan strived to manage unlicensed prostitution positively at that time by strengthening regulation of unlicensed prostitution, registering them or strengthening their VDRL. In its background, there was an advance notice for execution of <Act on VD Prevention> at that time. <Act on VD Prevention> gave the police a help in strengthening VDRL by only raising its anticipation and discussing on the need of its execution although it was not carried out in Joseon.

본 연구는 일제시기 성매매 문제에 대한 기존연구가 공창제의 도입과정과 폐창운동을 고찰하는 데 머물러 있다는 사실에 문제의식을 갖는다. 오늘날 한국 사회를 특징짓는 성매매 형태와 그 산업구조가 일제시기로부터 비롯되었다는 사실은 많은 연구자들이 공통적으로 지적을 하고 있다. 그러면서도 공창제가 폐지된 해방 이후의 한국사회에서 성매매가 공공연하게 이루어지고 있는 현상에 대해서는 제대로 해명을 하고 있지 못하다. 한국사회에서 성매매 문제가 불거질 때마다 그 해결방법의 하나로서 공창제가 제기되는 것도 한국 공창제의 역사에 대한 인식이 단편적이기 때문일 것이다.
한국사회의 성매매 문제에 대한 현실진단과 해결방안은 공사창을 포함하는 성매매 정책에 대한 역사적 고찰을 통해서 해명할 수 있다. 일제는 공창제를 시행하면서 공창 관리와 사창 금지를 표방하였지만, 실제로는 사창 안에서 이루어지고 있는 성매매의 일부까지 허용하고 관리했기 때문이다. 따라서 일제시기 성매매 정책은 경찰의 관리 안에 있던 면허영업과 관리 밖에 있던 무면허 영업에 대한 경찰의 인식과 단속 태도를 통해서 제대로 파악될 수 있을 것이다.
성매매를 공인하는 제도인 공창제는 한반도에서 일제가 정치적 지배력을 확보해가는 과정에서 등장하였다. 에도시대부터 유곽이 발달했던 일본에서는 근대시기에 들어와 기왕에 형성돼 있던 성매매 집결지역에 성병검진을 강화하는 방식으로 근대 공창제를 새롭게 재편하였다. 1876년에 조선을 강제로 개항하고 난 뒤, 개항장을 중심으로 형성했던 거류지에서도 일본인의 성매매는 유곽을 중심으로 발달하였다. 그러나 공식적인 공창제는 시행하지 않은 채, 성매매 집결지에서 공창방식의 관리단속을 펴는 것으로 성매매를 관리했다. 이러한 ‘준공창’의 상태는 세계 열강의 시선을 의식하여 ‘국가의 체면’을 고려한 결과였다.
조선인 사회의 성매매 확대는 일본 유곽문화의 도입과 함께 시작되었다. 그러나 초기에는 노골적인 성매매 형태를 갖기보다는 삼패기생의 경우와 같이 유흥에 성매매가 결합된 방식이 많았다. 공간적으로도 집결되기보다는 여기저기 산재되어 있는 형태가 많았다. 일제는 조선인 사회에 공창제를 도입하면서 복합적인 성격의 접객여성들을 창기화하는 방식을 취하였다. 성병검진에 저항이 심했던 접객여성들을 창기로 정체성화하고 이들에게 성병검진을 규범화할 필요가 있었기 때문이었다.
1916년에 전국적으로 공창제가 시행되었을 때, 성매매 정책은 재조일본인 사회와 조선인 사회에 대해 차이를 두고 있었다. 재조일본인 사회의 공창이 좀 더 집결화되고 엄격한 성병검진을 받는 특성을 가지고 있었다면, 조선인 사회의 공창은 散娼의 형태에 약간은 느슨한 성병검진을 받는 특성을 갖고 있었다. 공창영업은 재조일본인의 소비에 의지한 바가 컸으며, 조선인의 영업은 사창 형태를 띄고 있는 경우가 많았다.
성매매 단속은 각 지역의 풍속경찰이 각자의 ‘재량’에 의해 지역마다 차이를 두고 시행하였으며, 이 때문에 공창지역이 아니면서도 공창에 버금가는 방식으로 성매매가 관리되는 지역도 있었다. 공사창을 아우른 접객업 단속의 중점은 무엇보다 성매매 관리를 통한 성병예방에 있었다. 이 때문에 경찰은 예기나 작부에 대해서도 창기에 준하는 관리와 단속을 하여 이들의 성매매를 실질적으로 허용하였다.
공창제에 대한 비판 속에서 공창은 시간이 흐를수록 위축되는 경향을 보였다. 인신매매 문제를 내세운 국제사회의 압박과 폐창운동가들의 활동으로 공창제는 설 자리를 잃어가고 있었다. 공창제가 시행되고 있으면서도 사창과 성병이 증가하는 상황 또한 공창제의 명분을 잃게 했다.
이에 대해 일제는 공창의 축소를 추인하면서 사창에 대한 관리를 강화하는 것으로 성매매를 관리하였다. 공창제 시행의 전제는 사창에 대한 금지였지만, 일제는 애초부터 사창을 근절할 수 없는 것으로 보았다. 그리고 접객여성에 대한 외출제한과 성병검진을 시행하는 것으로 사창의 성매매를 관리하였다. 이러한 사창 관리는 경찰에게 영업허가를 받고 경찰의 관리 영역 안에 있는 접객업을 대상으로 이루어졌다. 반면 무허가 유곽이나 접객업에 대해서는 상대적으로 엄격하게 처분을 하였다.
사창 관리에 대해 자신감이 생기자 일제는 공창을 폐지하는 방침을 검토하기도 하였다. 그러나 일본에서는 실제로 폐창을 실현하는 지역들이 출현했음에도 불구하고 조선에서는 끝내 폐창을 실현하지 못했다. 폐창의 내용은 성매매를 금지하겠다는 것이 아니라 형식상의 공창제를 폐지하고 사창에 대해 공창방식의 관리를 하겠다는 것이었다. 형식상의 정책이었다고는 해도 조선에서 폐창이 실현되지 않았던 이유는 성병검진 시스템이 미비했기 때문이었던 것으로 보인다. 폐창의 전제조건인 <화류병예방령>이 조선에서는 시행되지 않은 상황에서 재조일본인들이 주요 이용자였던 공창을 폐지하기가 곤란했던 것이다.
폐창이 실현되지는 않았지만, 조선의 성매매 형태는 점차 공창이 위축되고 사창이 확산되는 경향을 보였다. 폐창론의 영향으로 공창을 기피하는 풍조가 생겼고, 저렴한 비용으로도 유흥과 성매매를 할 수 있는 성매매 형태가 선호되었기 때문이었다. 이러한 변화는 사창에 대해 금지가 아닌 관리방침을 취하면서 사창의 확산을 방조했던 경찰의 태도 때문이기도 했다. 일제는 성병검진의 강화, 집결화, 무면허 사창을 작부나 여급 등의 면허사창으로 전환시키는 방식을 통해 사창에 대한 관리를 강화해 나갔다.
총력전체제로 특징지을 수 있는 전시체제기에는 공창이 옹호되고 사창이 억제를 받았다. 요리점, 카페, 바 등의 접객업은 비상시국의 정신을 해치는 ‘유흥향락업’으로 치부되어 억제의 대상이 되었다. 영업통제의 강화, 유흥음식세 등의 증세를 통하여 접객업은 억제되고 전폐업의 대상이 되었다. 반면 상대적으로 통제가 느슨했던 대좌부 등의 공창은 전시체제기에도 그다지 타격을 받지 않고 영업을 계속할 수 있었다. 성매매를 위주로 하는 대좌부는 ‘유흥적 요소’가 적은 영업으로 판단되었고, 무엇보다 이시기 공창의 주요한 이용자가 당시 조선 내에 증가했던 재조일본인과 군인이었기 때문이다.
총동원체제 속에서 접객여성은 일제의 여성동원정책의 틀 안에서 재배치되었다. 전시의 여성인력 확보를 위해 일제는 접객여성을 전폐업시키거나 인신매매 단속강화를 통하여 접객여성의 유입경로를 차단하려고 하였다. 또한 접객여성들을 단위로 노무동원이나 간호동원을 하였으며, 위문단을 꾸리거나 위문대를 제작하게 하여 ‘전시 위안’의 역할을 담당하도록 하였다.
일제의 통제정책 속에서 접객업자들은 무면허 사창을 두고 영업난을 타개하려고 하거나 중국, 동남아시아 등 새로운 지역에 진출하여 활로를 개척하려고 하였다. 전폐업을 했던 접객여성들도 새로운 사창업소로 전업하든가 무면허 사창으로 존재하면서 생계를 이어가고 있었다. 일제는 무면허 사창에 대한 단속을 강화하는 한편 이들을 등록시키거나 접객여성에 대한 성병검진을 강화하는 것으로 이시기 사창을 적극적으로 관리하려고 하였다. 그 배경에는 이 시기 <화류병예방령>의 시행예고가 있었다. <화류병예방령>은 조선에서 결국 시행되지 않았지만 시행의 기대감을 높이고 그 필요성을 논의한 것만으로도 경찰이 성병검진을 강화하는 데 일조를 했던 것이다.
