디지털 개인정보의 보호기술과 효과적인 활용에 관한 연구

국문 초록 (Abstract)

우리나라는 지난 1975년 박정희 대통령의 지시에 의해 시작된 행정전산화 사업을 기반으로 꾸준히 정보화 정책을 추진해 왔으며, 그 결과 오늘날 세계 최고 수준의 정보통신 인프라를 갖추게 되었다.

오늘날 인터넷, 컴퓨터, 휴대폰 등 정보통신 기기 사용과 각종 전자거래 서비스가 확대되면서, 인터넷 기업들에 의해 수집된 개인정보가 무단으로 거래되거나 부주의하게 제3자에게 유출되는 등 무분별한 개인정보의 수집과 오·남용 사례로 인해 인터넷 이용자들 사이에 개인정보의 침해에 대한 우려가 확산되고 있는 실정이다.

인터넷 기반의 다양한 고객 맞춤형 광고와 서비스 등 디지털정보산업은 디지털 경제를 이끄는 수단이지만 동시에 사용자에 관한 정보 침해의 우려가 존재한다. 따라서, 온라인 개인 맞춤형 서비스와 정보 보호 사이의 균형을 이룰 수 있도록 이에 맞는 제도를 마련하는 일이 시급하게 요구되고 있다.

현행 개인정보보호 관련 법률은 정보 관련 기술의 발전을 충분히 뒤따르지 못하고 있으며, 이로 인해 사회 전반에 걸쳐 광범위하게 수집·처리되는 다양한 형태의 개인정보들에 대해 적절한 보호 조치가 이루어지지 못하고 있다.

본 연구는 디지털 개인정보의 생성과 침해 현황, 디지털 개인정보를 활용한 정보 서비스 산업, 개인정보 보호를 위한 국·내외의 입법 현황과 문제점을 연구하였다. 특히, 국민들의 우려가 높은 디지털 개인정보의 유출과 오·남용 등을 막고, 개인정보보호 조치를 위한 정보보호 기술을 연구분석하고 그 현황을 분석하였다. 그리고 디지털 개인정보를 안전하게 활용하기 위한 제도적 방안을 제시하였다.

Since the national project for computerization of administration commenced in 1975 according to the late President Park, Jung Hee's instruction, the project has been implemented continuously, consequently leading the nation to establish the world's best information and telecommunication infrastructures.

As the use of the Internet, computers, and mobile phones, and a variety of electronic transaction services continues to expand, however, companies in the Internet business have recklessly collected and misused personal information, even getting involved in illegal transactions or imprudent release of personal information to third parties. This has heightened the concerns among internet users about the infringement of personal information.

While the digital information industry, which can provide internet-based customized advertisements and services, has become a means with which to lead the digital economy, it simultaneously has the potential to infringe upon the users' personal information. As a consequence, it is urgently required to establish a scheme which can secure the balance between the use of customized online services and the protection of information.

The current laws and regulations concerning the protection of personal information are not fully up to date with current information technology, thus failing to provide proper measures to protect a variety of personal information collected and processed in a range of areas of our society.

This study, therefore, has investigated the current status of the creation and violation of digital personal information, the information service industry which uses digital personal information, and the related legislation and its issues both at home and abroad. Furthermore, it has researched the status of the technology and measures for the information protection and prevention of its misuse, proposing institutional measures for the safe use of digital personal information.
