人間複製의 倫理적 고찰

Human cloning is one of controversial issues coming into the 21st century. Currently controversy on human cloning concerning Dr. Wu-Seok Hwang is accelerating in terms of ethics, religion, society and law. There has been only recognition that the human cloning is generally good or bad, but so few citizens might have contacted information in detail. Therefore this study will develop logics centering around the basic implication of human cloning, its present situation and about four viewpoints, focusing on esthetic viewpoint.
This study presents following research questions ; First, what is the implication of human cloning? Second, how far has the human cloning come now? Third, why is the human cloning ethical issue? Fourth, what is the social and legal issue of human cloning?
Followings are the four hypotheses ; First, human cloning seems to have basically too many unreasonable things in terms of ethics. Second, the biggest point of human cloning is to facilitate the tendency of negligence of life. Third, human life comes into existence from the providence of God, the creator, but it is not created by creature. Lastly, human cloning should not be permitted in full scale, but within minimum scope.
There are two opinions about human cloning. Americans argue overall prohibition on research of human cloning. Koreans maintain that the way that humankind can be benefited through scientific development must not be blocked and the research of human cloning should be permitted if it aims medical cure. Human cloning is opposed to the religion. However animal cloning is permitted restrictively if it does not destroy biodiversity. In social terms, the behavior of cloning is regarded basically scientists' intervention in nature. Its seriousness is warned away that it can bring about a serious crisis to marriage and family system, and duplicated man can be treated as means not as aim. resulting in commercialization. In ethical terms, it is controversial that the unethical experiment might violate personal rights, dignity and human esteem. It will be right and necessary to synthesize the basic understanding and situation of the cloning, the problems in four viewpoints and actual discussion.
Men came to be beneficial and convenient in various fields of life as information, science and technology develop day by day. The development of science and technology, however, confuses the ethical and social consciousness (sense of values). Chaos and collision is clear especially in the field of biotechnology concerning the enlargement of life span and health that is the absolute desire of men. Therefore the researcher is opposed to the scientific research on human cloning. The reason of opposition is that science fabricates the dignity of human being blessed by God.
This thesis is expected to incite people to think over the dignity of human life taking a step backward from the development of science.

국문 초록 (Abstract)

인간복제는 21세기에 들어와 논란이 되고 있는 문제 중 하나이다. 최근 들어 황우석 박사에 의해 인간복제에 대한 논란이 가속화 되고 있는 시점에서 인간복제에 대한 윤리적․종교적․사회적․법적인 관점에서 상당한 논란이 분분하다. 그러나 인간복제에 대해서 전반적으로 좋다, 나쁘다는 인식만 있어왔지 일반 시민이 자세한 정보를 접하는 것은 극소수에 불과하다고 할 수 있을 것이다. 따라서 본 논문에서는 인간복제에 대한 기본적인 함의와 그 현주소, 인간복제에 대한 위의 4가지 관점을 중심으로 논거를 펼쳐 나갈 것이며 윤리적 관점을 그 중심으로 하겠다.
본 논문의 문제제기는 첫째, 인간복제의 함의는 무엇인가? 둘째, 인간복제의 현주소는 어디까지 왔는가? 셋째, 인간복제가 왜 윤리적 문제인가? 넷째, 인간복제의 사회적 ․ 법적 쟁점은 무엇인가?
가설은 첫째, 인간복제는 기본적으로 윤리적 차원에서 반대한다.
둘째, 인간복제의 가장 큰 쟁점은 생명외경의 경시풍조이다. 셋째, 인간의 생명 창조는 신의 영역이다. 넷째, 인간복제는 전면적인 허용보다는 필요한 한도내에서 허용해야 한다.
복제에 대한 논란은 크게 인간복제 연구에 전반적인 금지를 하자는 미국 등의 의견과 과학기술 발전을 통해 인류가 혜택을 입을 수 있는 길을 막아서는 안 된다는 치료 목적의 인간복제 연구는 허용되어야 한다는 한국의 의견으로 나누어진다. 종교적 관점에서는 복제에 대해서 반대의사를 표명한다. 그러나 생명의 다양성을 파괴하지 않는 범위내에서 동물복제는 제한적으로 허용한다. 사회적 관점에서는 복제행위를 과학자들이 자연에의 간섭으로 기본입장을 취한다. 결혼과 가족제도 심각한위기, 복제인을 목적이 아닌 수단으로 취급함으로써 상품화가 나타날 수 있기에 심각성을 경고하고 있다. 윤리적 관점에서는 고유한 정체성을 지닐 권리인 인격권을 침해, 존엄성침해, 비윤리적 실험을 행함으로써 인간 정체성을 위협 등을 이유로 찬반 공방이 빈번하다. 이러한 의견을 종합하여 복제에 대한 기본적이 이해와 현황, 4가지 관점에서 바라본 문제와 현실에 대한 논의를 종합적으로 거칠 필요성은 당연하다 하겠다.
하루가 다르게 진보하는 정보, 과학기술 발전에 따라 우리들은 여러 생활 분야에서 많은 편리와 이익을 얻고 있다. 그러나 이러한 과학기술의 발전은 우리들의 윤리, 사회적 의식(가치관)에 큰 혼란을 주고 있다. 특히 인간의 절대적 욕구인 생명연장과 건강에 관련된 생명공학 분야에서 이러한 가치관의 혼란 및 충돌은 명확해진다. 그럼으로 본 연구자는 본 논문에서 과학연구에 대한 인간복제에 대해선 반대 입장을 취한다. 복제연구는 신이 주신, 인간의 존엄성을 과학의 틀 위에서 조작한다는 점에서 반대 입장을 표명한다.
본 논문을 통해서 과학의 진보 위에서 한걸음 물러서서 인간 생명의 존엄을 다시 한 번 생각해 보기를 바란다.
