The dictionary definition of mother is “a woman in relation to a child to whom she has given birth.” And the Mother and Child Health Act
defines a pregnant woman as a woman in the period of maternity or within a period of six months after childbirth and maternity as pregnant women and women of reproductive age (Article 2 of the Mother and Child Health Act). According to these definitions, a woman becomes a mother by
pregnancy and childbirth and her maternity should be protected. However, there are women in the society who cannot be protected when being with a child and who cannot be a mother even though they give birth to a child. They are unmarried mothers. In this presentation, we will go back to the dictionary definition, regarding unmarried pregnancy and childbirth in the same light as those of married women, and investigate what discriminatory circumstances are laid on their way to become a mother.
Firstly, during pregnancy and after childbirth, unmarried mothers’maternity does not fully exercise the reproductive rights of women and
experiences a disconnection between childbirth and child rearing. It is because that unwed mothers are being located in the social situation which forces to select either abortion or adoption due to the stigma on unwed pregnancy.
Secondly, unmarried pregnancy and childbirth out of marriage are not protected at workforce, even though the Mother and Child Health Act, the Labor Standard Act, the Employment Insurance Act and the Act on Equal Employment and Support for Work-Family Reconciliation provide provisions on the prohibition of discrimination regarding pregnancy and childbirth. While maternity protection has been expended to married immigrant women and adoptive parents (maternity leaves for adoptive parents) during last few years, unmarried pregnancy and childbirth out of marriage are still being neglected. It is necessary to establish regulations or recommendations on the protection of unmarried motherhood.
Thirdly, the education right of unmarried parenting adolescents is not fully protected. Recently, alternative schools for unmarried parenting
adolescents have been established. However, many teenagers are likely to be pregnant after quitting school, but the only mean to secure their right of education is a qualification examination. Furthermore, even though juveniles refer to the young in their age of 18 to 24 in Korean society, the effort to protect education right is mainly being made focusing on teenager unmarried women. Unmarried collegian women in their 20s are also threatened in both their maternity right and education right hesitating about either selecting education which means throwing up her maternity or selecting maternity which means surrendering her study.
Lastly, housing support for unmarried pregnant women or unmarried mothers and their children is very poor. Historically, these women were
considered as being who need to be accommodated in separate facilities such as maternity homes or group homes. The old stigmatic perspective on
unwed pregnancy still remains and it hinders unwed motherhood from securing the right to live within local communities. Since ensuring
unmarried mothers’ housing rights is directly related to the survival of them and their child, it is necessary to urgently prepare measures to protect them.
In conclusion, it is required to provide legal and institutional efforts to protect unmarried maternity in broader areas. Currently, about 90% of adopted children were born to unmarried mothers. This means that children who already have a mother are being kept apart from their mother.
Unmarried mothers may be the target of criticism and rebuke in that they became pregnant without preparations. However, the “preparations” should refer to not only psychological preparations of being a mother but also institutional and social supports. Therefore, it is time for the society to provide legal, institutional and social “preparations” that allow them not to be shunned as a mother.

어머니의 사전적 정의는“자기를 낳아 준 여자를 이르거나 부르는 말, 무엇이 배태되어 생겨나게 된 근본을 비유적으로 이르는 말”이다. 또한 모자보건법에서“‘임산부’란 임신 중이거나 분만 후 6개월 미만인 여성, ‘모성’이란 임산부와 가임기 여성, ‘신생아’란 출생 후 28일 이내, ‘영유아’란 출생 후 6년 미만의 사람을 말한다(모자보건법 제2조).”고 정의되어 있다. 특별히 혼외의 임신과 출산을 제외한다는 부언이나 명시가 없어, 여성은 임신과 출산으로 어머니가 되는 것이라고 보면 맞을 것이다.
하지만 우리 사회에서 임신과 출산을 했음에도 불구하고 어머니가 될 수 없는 여성들이 있는데 바로 미혼모다. 미혼의 임신과 출산은 성도덕적 관점에서 비난과 낙인의 대상이었거나, 피해자적 관점에서 보호 및 복지 시혜의 대상 정도로 여겨지고 있었다. 미혼 임신과 출산에 대한 낙인적 관점으로 인해‘미혼의 모성은 마땅히 포기되어야 하는 것’이란 암묵적 동의가 우리 사회에서 통용되어 왔던 것 같다.
본 발제문에서는 사전적 정의로 돌아가서, 미혼의 임신과 출산을 기혼의 그것과 동일 선상에 놓고 그들의 어머니 되는 경험과 과정이 어떠한 차별적 상황에 놓이는지를 살펴보고자 한다. 제도 밖에 있는 어머니들을 모성의 관점으로 봤을 때 이들이 겪는 어려움과 차별적 상황은 거의 법의 사각지대에서 방치되고 있음을 알 수 있다.
우선 임신부터 출산 후까지 이들의 모성은‘낙태’와‘입양’을 선택하도록 하는 구조 - 미혼임신에 대한 낙인적인 정서와 법적 보호장치 및 지원제도의 부재 - 속에 서 여성의 재생산권을 충분히 누리지 못하고 출산과 양육 사이의 심각한 단절을 경험하는 것으로 나타난다.
또한 모자보건법 및 근로기준법, 고용보험법, 남녀고용평등법 등에서 임신과 출산으로 인한 차별이 금지되고, 경미한 업무로의 전환, 출산 휴가 등이 보장되어 있으나, 미혼임신을 한 임산부는 미혼임신에 대한 심각한 낙인으로 인해 이러한 권리를 전혀 누리지 못하고 있다. 지난 몇 년간 모성보호가 점차 결혼이민자 여성이나 입양부모 (입양부모 출산휴가제)까지 확대 적용되고 있는 것과 대조적으로 미혼임신과 출산은 여전히 방치되고 있다. 미혼임신 역시 모성으로서 보호받을 수 있도록 새로운 조항의 명시 또는 미혼임산부 및 태아 보호에 관한 권고안이 만들어져야 할 것으로 보인다.
최근 청소년 미혼모 학습권에 대한 국가인권위원회의 권고안이 나오고, 청소년 미혼모를 위한 대안학교가 설치되며 청소년 미혼모가 학습을 계속할 수 있는 사회적 안전망은 정비되어 가는 것으로 보인다. 대안학교 제도는 미혼모 청소년이 학교에 적을 두고 있는 경우 대안학교로 연계되어 교육을 받고, 과정을 모두 이수했을 때 원래 다니던 학교의 졸업을 인정받는 것이다. 매우 이상적인 제도라고 할 수 있다. 하지만 많은 청소년들이 학교를 이미 그만두고 난 후 임신을 할 가능성도 높은데, 이들의 교육권 보장은 검정고시 외에는 없다. 이들의 교육권 보장에 대해서도 고민이 필요할 것이다. 더구나 청소년은 만 18세에서 만 24세임에도 불구하고 교육권 보호는 십대 청소년 미혼모 중심으로 이루어지고 있다. 한 상담사례에서 20세 이상 대학생 미혼모 역시 시설과 입양을 권하는 구조 속에서 학습을 선택하고 모성을 포기할지, 모성을 선택하고 학습은 중단 또는 포기해야 할지 두 개의 모순된 상황 속에 놓이는 것을 알 수 있었다. 이들의 교육권 보장 역시 더 이상 간과되어서는 안 될 것이다.
마지막으로 미혼모는 시설을 권하는 사회에서 지역사회에 살 수 있는 원초적인 가능성을 차단당하고 있다. 이러한 가운데 양육의지가 상대적으로 높은 것으로 나타나는 나이가 많은 미혼모일수록 주거 문제로 인한 어려움이 많을 것으로 짐작된다. 미혼모의 주거권 보장의 문제는 미혼모 당사자의 문제를 넘어 엄마와 아이의 생존문제와 직결되는 것이기에 더욱 긴급히 그 보장책이 마련되어야 할 것이다.
보다 광범위한 영역에 걸쳐 미혼모성을 보호할 수 있는 법적 제도적 노력이 신속히 마련되어야 한다. 현재 우리 사회에서 입양보내지는 아동의 90% 가량이 미혼모에게서 태어난 아동들이다. 이미 엄마가 있는 아동들이 엄마로부터 격리되고 있다. 미혼모에게‘준비 없이 임신한 무책임한 여성들’이란 비난과 질책이 있을 수 있다. 하지만‘준비’는 어머니가 될 마음의 준비를 의미하는 것이기도 하지만, 제도적 지원과 사회적 지지를 말하는 것이기도 하다. 따라서 우리 사회는 어머니가 더 이상 어머니로서 소외받지 않도록 법적, 제도적, 사회적‘준비’를 해 줄 때이다.
