벨기에의 외국인 참정권에 관한 연구 = Study on the Suffrage of Non-national Immigrants in Belgium

Traditionally, political rights were linked to nationality; only full citizens could participate in political decision-making. But since the end of 20th century, some countries has extended the suffrage to non-nationals in anticipation that granting voting rights would stimulate the political participation of immigrants and thus their integration in the host countries.
In Belgium, granting suffrage to non-nationals has argued since the end of 1970s. After long debates, in 2004, the Belgian election law amended and voting rights were given to foreigners who have their residence in Belgium more than 5 years. However, the analysis of the results of the regional election in 2006, where the non-nationals in Belgium could vote for the first time, showed that the new law didn't do much to integrate immigrants in Belgian society. Many non-national voters abstained not only because they didn't have strongly supporting candidates in condition that non-nationals can't be eligible, but also voter registration is not automatic but troublesome. Moreover, extreme right wing who opposed suffrage for foreigners closed ranks against foreigners and gathered weight through this election. The Belgian case tell us that a careful consideration for foreigners is needed for integration of multi-cultural society through non-national suffrage system.

국문 초록 (Abstract)

과거 참정권은 거주국의 시민권자만이 누리는 특권이라고 간주되었으나 최근에는 외국 국적의 이주민에게도 일정기간 거주하면 지방선거 참정권을 부여하는 국가가 증가하고 있다. 외국인에게 참정권을 부여하는 주된 이유는 외국인이 참정권 행사를 통해 주인의식을 가진 사회구성원이 될 수 있고, 나아가 다문화사회의 사회통합이 가능하다는 기대감이다. 벨기에의 경우, 1960년대에 터키나 북아프리카 출신 노동자의 이민이 늘어나자 1970년대부터 이주민의 지방선거 참정권 부여에 대한 진지한 논의가 시작되었다. 그러나 지역간, 정당간 대립이 극심하여 외국인 참정권 법안은 30년 가까이 표류하다 2004년에 비로소 통과되었다. 2004년 법령에 따라 벨기에 거주 외국인은 2006년 지방선거부터 5년 이상 거주하였을 경우 가장 기초단위 지방선거에서 투표할 수 있다. 그리고 지난 2006년 외국인이 참정권을 행사할 수 있는 첫 번째 지방선거가 실시되었다. 그 결과를 살펴보면 외국인의 투표 참여율은 매우 저조하였고, 외국인 참정권을 반대하던 극우정당의 세력이 증가하였음을 알 수 있다. 즉, 벨기에의 외국인 참정권은 다문화사회의 통합이라는 기대와는 달리, 외국인에게는 그다지 큰 의미를 부여하지 못한 채, 오히려 외국인을 경계하는 극우파의 결집의 계기를 제공했다. 상당수의 나라들이 외국인에게 피선거권과 선거권을 모두 부여한 것과 달리, 벨기에는 선거권만 부여하였기 때문에, 벨기에의 외국인들은 적극 지지하는 입후보자가 많지 않았고, 선거인명부에 이름을 올리는 과정이 번거로웠기 때문에 투표에 적극 나서지 않았다. 그리고 오히려 극우파들은 참정권 그 자체에 문제를 삼으며 결집했다. 벨기에 사례는 외국인 참정권을 통해 사회통합의 효과를 거두기 위해서는 형식적인 참정권이 아니라 외국인 입장을 진지하게 배려하여 부여한 참정권이 필요하다는 사실을 말해준다.
