生命保護의 觀點에서 본 自殺 敎唆·幇助罪의 검토 = A Study on the assisting suicide on the criminal law

다국어 초록 (Multilingual Abstract)

The Life of Human Beings is mysterious. And the personality is more mysterious. The personality of Human Beings is realized to the dignity. This dignity is based on not concerning to the determination of other"s life.
This means that one must not concern not only determination of survival of other"s but also the determination of death of other.
Korean Criminal Law prescribe crime of assisting suicide as well as murder by agree and entrust, therefore Korean Criminal Law has a more wide provision about violation to other"s life than another country.
And inciting to the suicide is a crime to the man who has not yet decision of suicide, but aiding to the suicide is a crime to the man who already has a decision of suicide, therefore the incite is more bigger than the aid as to the grade of unlawfulness.
Accordingly legislative consideration which make the punishment of inciting suicide to be bigger than aiding suicide and make the punishment of murder of agreement to be bigger than murder by entrust is needed.
