    인도적 개입과 보호책임 -인도적 개입 논의에 대한 보호책임의 의의와 한계를 중심으로-

    Whether to allow humanitarian intervention, especially “unilateral humanitarian intervention” entailing military action without UN Security Council resolution, is still a matter of controversy concerning the principle of non use of force, the principle of sovereign equality and the principle of respect for human rights.
    In December 2001, the International Commission on Intervention and State Sovereignty(ICISS) introduced the principle of “Responsibility to Protect(RtoP)”. It is based on the “sovereignty as a responsibility”, which is a paradigm shift from a sovereign state‘s “right” to “responsibility” to protect its populations. According to the ICISS report, if a State is unwilling or unable to protect its populations or is in fact the perpetrator of crimes against humanity, the principle of non-intervention yields to the international responsibility to protect. Several official UN documents and resolutions have accepted “RtoP” and developed its concept since then.
    The principle of “RtoP” is a kind of ‘soft law’ which can provide a legal basis for and set a criteria of collective use of force as an exercise of humanitarian intervention for the protection of “human security” including human rights and dignity. The principle of “RtoP” based on the concept of “human security” can also strengthen the global governance led by the UN.
    On the other hand, some critics say that the concept of “RtoP” is still ambiguous and its status as a legal principle is uncertain. In other words, it is at best an ‘emerging norm.’ So, they argue, it can hardly make a practical and sufficient effect to the controversy over humanitarian intervention.
    But, considering that the concept of “RtoP” is still in the process of being created, it could be developed into both a theoretical principle and a practical system that contribute to resolve the problems of the legality and legitimacy of humanitarian intervention.

    본 논문에서 논하고자 하는 ‘인도적 개입,’ 즉 ’일방적 인도적 개입(Unilateral Humanitarian Intervention)이란 “한 국가 내에서 정치, 종교, 인종 기타의 이유로 그 주민의 일부 또는 전부가 박해를 받는 등 인도에 반하는 사태가 발생하는 경우, 피개입국의 동의 및 UN의 허가 없이, 타국이 이러한 비인도적 행위 또는 사태를 중지시키고 인권을 회복하기 위해 무력을 사용하여 개입하는 것”을 말한다. 이러한 인도적 개입이 국제법상 허용될 수 있는지 여부는 무력사용금지의 원칙, 주권평등의 원칙 및 국내문제불간섭의 원칙 등과 인권존중의 원리 등이 맞물려 논란이 되고 있다.
    인도적 개입을 지지하는 입장으로는 국가주권보다 인권보장을 우선시해야 한다는 주장 및 이를 위해서는 무력사용금지의 원칙을 규정한 UN 헌장 제2조 4항을 제한적으로 해석해야 한다는 견해, 그리고 불가피한 경우 제한된 요건 하에서 관습국제법상 인도적 개입이 허용되어 왔다는 견해 등을 들 수 있다. 반면에 이를 반대하는 논거로는 UN 헌장 제2조 4항은 원칙규정으로서 엄격히 해석해야 하며, 기타 일방적 인도적 개입을 허용하는 법적 근거나 국가 관행이 없다는 점과 정치적인 이유로 남용될 우려 등을 들 수 있다.
    이와 관련하여 2001년 ‘간섭과 국가주권에 관한 국제위원회’(ICISS)가 주장한 이래 다수의 UN 공식 문서 및 결의 등을 통해 발전되어 온 ‘보호책임’(Responsibility to Protect, RtoP)의 원칙이 주목받고 있다. 보호책임이란 지배권으로서의 주권 개념에서 책임으로서의 주권 개념으로의 인식의 전환에 기초하여, 자국민 보호의 1차적 책임은 주권국가가 지되, 주권국가가 자국의 시민을 보호할 의사가 없거나 보호할 능력이 없는 경우에는 국제공동체가 2차적으로 보호할 책임을 진다는 것으로서, 구체적으로는 ‘예방-대응-재건’의 3단계 책임 구조로 이루어져 있다.
    특히 일방적 인도적 개입과 관련하여 보호책임에서의 대응 책임이 그 근거가 될 수 있는가가 문제될 수 있다. 비록 보호책임의 원칙이 책임으로서의 주권으로 인식의 전환을 이루었고 생성중인 연성법으로서 인도적 개입의 법적 근거가 될 수 있을 것으로도 볼 수 있으나, 그 법적 개념으로서의 지위 및 구체적인 적용범위 등이 여전히 확립되어 있지 아니하며, 현재까지의 보호책임의 논의 경과로 볼 때, UN 안보리 결의의 승인이 없는 일방적 인도적 개입을 정당화 시켜줄 수는 없을 것으로 보인다.
    그럼에도 보호책임의 원칙은 인도적 개입에 대한 UN 안보리 결의의 정당성을 제고하는 한편 UN 중심의 예방‧대응‧재건 체계를 구축함으로써 인간안보의 보장 및 UN 중심의 글로벌 거버넌스의 확대에 기여할 것이라 평가할 수 있다. 더구나 보호책임의 원칙이 아직 발전 중인 개념임을 감안한다면, 활발한 법적 논의와 실제 관행의 축적을 통해 더욱 정교한 이론적, 제도적 장치로 발전할 수 있으리라 본다.
